Event Liability Waiver and Release

City of Santa Clara and Santa Clara Stadium Authority CELEBRATE SANTA CLARA EVENT LIABILITY WAIVER AND RELEASE AND NAME / IMAGE CONSENT

I approve of my and/or my child's attendance and participation in the City of Santa Clara (“City”) and Celebrate Santa Clara Watch Parties events on July 9 - 11, 2026, at the Santa Clara Convention Center in Santa Clara, California (hereinafter, the “Event”). I certify that I and my child(ren), if any are listed below, are in good health and able to participate fully in any and all of the program activities.

I fully understand that my and/or my child’s participation in such an Event may be physically demanding and may involve the risk of injury, sickness or disease including economic losses which may result not only from my child’s actions, inactions or negligence, but from the actions, inactions or negligence of others, the condition of the facilities, equipment or areas where the Event is being conducted. I voluntarily assume full responsibility on behalf myself and my child(ren), if listed below, for all risks of personal injury or sickness while participating in the Event, including the risk of passive or active negligence on the part of TRAFFIK LLC, Oak View Group, City of Santa Clara, and/or their general partners, officers, directors, employees, representatives, affiliates, sponsors, licensees, volunteers, and agents (collectively, “Sponsors”).

I knowingly release and will not bring any legal action of any nature against, and indemnify and hold harmless and discharge the partners, officers, related entities, volunteers, employees, representatives, agents and assigns of the Sponsors, and the employees, officers, directors, owners, representatives, volunteers, and agents of such related entities, parents, affiliates, divisions, employees, agents or assigns (collectively, "Benefited Parties") from any and all loss, claim, expense (including attorney's fees) or liability that may arise in any way out of my and/or my child's attendance at or participation in the Event, whether the injury, disability, or loss or damage to person or property is caused in any way in whole or in part by negligence, gross negligence, carelessness or other acts of the Benefited Parties.

I AGREE TO WAIVE ANY RIGHTS I OR MY CHILD MAY HAVE UNDER THE CALIFORNIA CIVIL CODE SECTION 1542 WHICH STATES, “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY,” OR SIMILAR RIGHTS UNDER APPLICABLE AND/OR ANALOGOUS LAWS IN OTHER JURISDICTIONS.

I know of no medical reason why I or my child(ren) should not participate in the Event. I authorize the Event staff to attend to any health problems or injury that I or my child(ren) may sustain while participating in the Event. I acknowledge that I am responsible for any and all medical expenses, damages or other costs related to treating any injury or illness to myself and/or child(ren).

I agree to comply, and to ensure that my child(ren), if any, will comply with all facility rules and regulations and acknowledge that failure to do so may result in removal from the Event or denial of entrance into the Event. I further acknowledge that the City and Stadium Authority reserve the right to remove or to deny entry to me and/or my child(ren) to the Event if I or my child(ren) engage in disruptive behavior, or annoy, abuse, threaten or harass any person at the Event.

I further authorize the Sponsors and the Benefited Parties to use any and all photos or videos uploaded by me or my child in connection with or participation in the Event, take photographs and/or record video or audio tapes that include my and/or my child’s image and/or voice (collectively, “Photos”) while participating in the Event and to use, at their sole discretion, the Photos and my and/or my child’s name and likeness without compensation to me or my child in any promotional campaigns or materials or publicity for the Event, Benefited Parties, or Sponsors and their successors, licensees, and assigns. I hereby release and waive any and all interest in and with respect to the Photos and agree to release the Benefited Parties from any and all claims, actions, causes of action and demands arising out of or in any way related to the Photos and the Benefited Parties' use thereof.

I HEREBY AFFIRM AND ACKNOWLEDGE THAT I HAVE READ THIS DOCUMENT, UNDERSTAND ITS CONTENTS AND AGREE TO BE BOUND THEREBY ON BEHALF OF MYSELF AND, IF APPLICABLE, MY CHILD(REN) LISTED BELOW.
