E-Bike and Paddle Board Rental Agreement, Assumption of Risk, Liability Waiver, and Release

This agreement applies to the rental of either an e-bike or a paddle board (collectively referred to as the "Equipment"). The terms of this agreement apply only to the Equipment rented by the customer during the rental period.
Throughout this agreement, the term "Equipment" refers to the specific rental item provided to the customer, whether it is an e-bike or a paddle board.

1. Acknowledgment of Risk

I understand that renting and using the Equipment involves inherent risks that cannot be eliminated regardless of the care taken by HOH Rides. These risks include, but are not limited to:

Falls, collisions, and accidents.
Mechanical failure or equipment malfunction (when applicable).
Water, road, trail, weather, and environmental hazards.
Actions of pedestrians, motorists, cyclists, boaters, swimmers, or other individuals.
Serious bodily injury, permanent disability, property damage, drowning (for paddle board rentals), or death.

I voluntarily choose to rent and use the Equipment despite these known and unknown risks.

2. Renter Qualifications

By signing this agreement, I certify that:

I am at least 18 years old, or I am the parent or legal guardian signing for a minor.
I am physically capable of safely operating or using the Equipment I have rented.
If renting an e-bike, I understand how to safely operate it before riding.
I will not use the Equipment while under the influence of alcohol, drugs, or any substance that may impair my judgment or ability.

3. Safety Rules

I agree to:

Follow all applicable federal, state, and local laws.
Use the Equipment responsibly and safely.
Wear a helmet while riding an e-bike.
Wear a properly fitted U.S. Coast Guard-approved life jacket and whistle while using a paddle board.
Not allow anyone else to use the rented Equipment.
Return the Equipment in substantially the same condition in which it was received, excluding normal wear and tear.
