1. Acknowledgment of Risk
I understand that operating an electric bicycle (e-bike) involves inherent risks that cannot be eliminated regardless of the care taken by the rental company. These risks include, but are not limited to:
- Falls, collisions, and accidents.
- Mechanical failure or equipment malfunction.
- Road, trail, weather, and traffic hazards.
- Actions of pedestrians, motorists, cyclists, or other riders.
- Serious bodily injury, permanent disability, property damage, or death.
I voluntarily choose to participate despite these known and unknown risks.
2. Rider Qualifications
By signing this agreement, I certify that:
- I am at least 18 years old, or I am the parent/legal guardian signing for a minor.
- I am physically capable of safely operating an e-bike.
- I understand how to operate the brakes, throttle (if applicable), gears, and pedal-assist features before riding.
- I will not operate the e-bike while under the influence of alcohol, drugs, or any substance that may impair my judgment or ability.
3. Safety Rules
I agree to:
- Obey all federal, state, and local traffic laws.
- Ride responsibly and at safe speeds.
- Wear a properly fitted helmet while riding.
- Yield to pedestrians where required.
- Not allow anyone else to operate the rented e-bike.
- Not carry passengers unless the bicycle is specifically designed for passengers.
- Not perform stunts, jumps, racing, or reckless riding.
- Return the e-bike in substantially the same condition in which it was received, excluding normal wear.
4. Inspection of Equipment
Before riding, I have inspected the e-bike and acknowledge that it appears to be in good working condition. If I discover any issue before or during the rental period, I will stop riding immediately and notify the rental company.
5. Responsibility for Damage
I accept responsibility for damage caused by misuse, negligence, theft resulting from my failure to properly secure the bicycle, or intentional acts. I understand I may be responsible for repair or replacement costs as permitted by law and the rental agreement.
6. Assumption of Risk
I knowingly and voluntarily assume all risks associated with renting and operating the e-bike, whether known or unknown, foreseeable or unforeseeable.
7. Release of Liability
To the fullest extent permitted by applicable law, I release, waive, and discharge the rental company, its owners, officers, employees, contractors, agents, affiliates, successors, and assigns from any claims, liabilities, demands, damages, losses, or causes of action arising out of or related to my rental or use of the e-bike, including claims arising from ordinary negligence.
This release does not apply where liability cannot legally be waived under applicable law.
8. Medical Authorization
If I become injured or require emergency medical treatment and cannot provide consent, I authorize emergency medical personnel to provide treatment they consider reasonably necessary. I understand I am responsible for all associated medical expenses.
9. Photo and Video Release (Optional)
☐ I authorize the rental company to use photographs or videos taken during my rental for promotional and marketing purposes.
☐ I do not authorize the use of my image.
10. Governing Law
This agreement shall be governed by the laws of the state in which the rental takes place.
11. Severability
If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. Acknowledgment
By signing below, I acknowledge that:
- I have carefully read this entire agreement.
- I understand its contents.
- I understand that I am giving up certain legal rights by signing it.
- I sign this agreement voluntarily and without coercion.
