WAIVER OF LIABILITY
I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing and mask wearing. I acknowledge that AAU/Select basketball is a competitive sport, at which my child may be injured at any time due to the physical nature and contact of the sport - basketball. I further acknowledge that DARK HORSE HOOPS EMPIRE has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19 to my child(ren) if mandated by the state of Texas. I am aware that I can purchase and provide my child with safety gear to further protect them from injury, but am not required to nor is DARK HORSE HOOPS EMPIRE responsible for providing safety gear. Examples of safety gear include but are not limited to: face masks, mouth guards, knee pads and etc. I am aware that DARK HORSE HOOPS EMPIRE will train my child how to execute (play) the game plays properly without injuring oneself, however injuries may occur even when properly executing game plays. I am aware that even with safety gear, proper stretching, proper hydration, and during active training/exercises, that my child is subject to the possibility of injury. I further acknowledge that DARK HORSE HOOPS EMPIRE can not guarantee that I nor my child will not become infected with the Coronavirus/Covid-19 or any ther variant of COVID or any other contagious illnesses. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19/other contagious illnesses may result from the actions, omissions, or negligence of myself and others, including, but not limited to, non-sanitation of hands or gear, not distancing self from others, or not wearing a facial mask to prevent exposure. I also acknowledge that injuries may occur due to accidents, other players, my child, or any other reason due to physical contact with other children.
I am voluntarily registering my child (name listed above) to try out in the year 2025 for DARK HORSE HOOPS EMPIRE organization and acknowledge that I am increasing my risk as well as my child's to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending practices and/or tournaments.
I attest that my child (name listed above):
* Is in good health mentally/physically
*Has a updated physical within the last year (that clears them for sports)
*Has a valid report card for the current school year
I hereby release and agree to hold DARK HORSE HOOPS EMPIRE harmless from, and waive on behalf of myself, my child participant, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the DARK HORSE HOOPS organization, or that may otherwise arise in any way in connection with any services received from DARK HORSE HOOPS. I understand that this release discharges DARK HORSE HOOPS from any liability or claim that I, my child participant, my heirs, or any personal representatives may have against the DARK HORSE HOOPS organization with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from DARK HORSE HOOPS. This liability waiver and release extends to the DARK HORSE HOOPS organization together with all owners, partners, coaches and volunteer staff.
