OFF-DUTY LAW ENFORCEMENT OFFICER ELIGIBILITY & COMPLIANCE ACKNOWLEDGMENT
Guardian Investigations & Security LLC is licensed by the Texas Department of Public Safety (DPS) Private Security Program. All Off-Duty Law Enforcement Officers working assignments through Guardian must comply with all applicable laws, their employing agency's off-duty employment policies, and Guardian's policies.
Texas Peace Officer Exemption Pursuant to Texas Occupations Code §1702.322, qualifying full-time Texas Peace Officers are exempt from obtaining a Texas DPS Private Security Registration or Commission while performing authorized off-duty security duties. To qualify, an officer must be a commissioned full-time Texas Peace Officer, average at least 32 hours per week, receive normal pay and benefits from their law enforcement agency, be authorized by their agency to work off-duty employment if required, and perform only security functions permitted by law. Qualified officers may perform duties such as uniformed security, patrol, event security, access control, traffic control, property protection, loss prevention, and similar security functions. This exemption does not authorize work requiring separate licensure, including private investigations, locksmith services, alarm or electronic access control installation, or other regulated occupations under Chapter 1702. Reserve Peace Officers generally do not qualify for this exemption and must possess any DPS registration or commission required by law.
