Parties to this Agreement

This agreement is entered into between the Parent/Guardian and TOCA Creative LLC (doing business as "TOCA," and referred to herein as "TOCA").

Release of Liability

I acknowledge that TOCA is organized and always maintained  with the students’ safety and security a top priority, but accidents may happen. I understand that playgroup is held outside in a public park and that my child will be participating in physical outdoor activities (incl. running & climbing),  which may involve wood branches, sticks, stones and earth.

Regardless of any steps taken by TOCA to reduce the risks associated with outdoor activities, I knowingly and freely, assume all such  risks, both known and unknown, relating to my child’s care at TOCA.

In consideration of TOCA accepting this registration and  permitting the participation  of the above named child in such  activities, which I believe to be  educational, on behalf of myself and  my family, I hereby release, discharge, indemnify and hold harmless TOCA, its employees, representatives and agents from any and  all claims,  actions and  liabilities arising out of or in connection with the above named child’s participation in any aspect of the activities provided, even in the  case of TOCA's negligence.

TOCA encourages all children and parents to adhere to all safety and health guidelines, as outlined  in TOCA’s Fall 2026 guidelines.

Tuition & Payment

Tuition for After School and/or School Holiday programs totaling up to $1500 is due in full to TOCA upon execution of this agreement. Tuition fees exceeding 1500 may be paid in optional installments, with the first installment serving as a non-refundable deposit. Installment tiers are as follows:

• $ 1500 - $ 2999: may be paid in up to two installments.
• $ 3000 - $ 4499: may be paid in up to three installments.
• $ 4500 and above: may be paid in up to four installments.

Should your plans change and you need to cancel up to 30 days before Fall 26 TOCA starts (deadline August 15th, 2026) and the tuition was paid in full, TOCA will refund 50% of the tuition (minus registration fee and any applicable, non-refundable credit card charges). If the tuition was paid in installments, no further payment is required; the first installment (considered a deposit) is non-refundable.

Should your plans change and you need to cancel less than 30 days before Fall 26 TOCA starts or any time after the semester started and the tuition was paid in full, TOCA is unable to refund any part of the tuition. If the tuition was paid in installments, full payment of the remaining installments remains a binding financial obligation to TOCA. 

Suitable replacement - After School only:
Should your plans change and you need to cancel less than 30 days before Fall 26 TOCA starts, or any time after the semester started, you may have another parent/family take over your child’s After School spot. In this instance, you are solely responsible for all communications and financial negotiations or transactions with that family. The replacement family must register with TOCA (including payment of a registration fee for new families), and the child must meet all program requirements (e.g., age) as all other registered students.

*** Important Note on Credit Card Payments Most payment gateways no longer refund processing fees (typically 2.9% + $0.30 for credit cards or 1.5% for ACH). Therefore, if a situation arises that warrants a refund, any approved refund will be issued minus the applicable non-refundable payment processing fees, unless the refund is issued as a credit for future use or payment.***

Media Release

Photographs and videos are an essential part of TOCA; they help document the work we do and are important for all parents, new, current, or past, to get an idea of our work, the environment the children are in and their daily activities.

I do hereby consent and agree that TOCA has the right to take pictures and short videos of my child and use them on their own website and social media accounts without compensation. My child’s name and identity will not be revealed.

Enrollment & Participation

By enrolling my child in the TOCA Fall 26 program and remitting tuition fees, I acknowledge that participation equates to a membership arrangement, wherein regular attendance is expected. I understand that unforeseen circumstances such as inclement weather, illness or travel may occasionally prevent attendance. TOCA operates on the understanding that tuition fees secure a place for the enrolled child, and the entity incurs costs and commitments based on this enrollment.

Therefore, missed days due to inclement weather, illness, travel, scheduling conflicts, or other personal reasons do not qualify for credits or refunds. TOCA will offer make-up sessions for cancellations due to inclement weather, air quality issues, or a teacher's illness. We will not offer make-up sessions for days missed due to a child's illness, travel, scheduling conflicts, or any other personal reasons. Please refer to the TOCA Fall 2026 guidelines for specific information.
