• Terms of Service

  • These Terms of Service ("Terms") govern your purchase of and participation in programs, workshops, courses, classes, events, and other services offered by Abby Lopac, doing business as Hootenanny Abby ("Company," "we," "our," or "us").
  • By purchasing, registering for, or participating in any program or service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
  • 1. Eligibility

  • By enrolling in this program, you represent that:
    • You are at least 18 years of age.
    • You have the legal capacity to enter into this agreement.
    • You are voluntarily choosing to participate.
    • You understand that this program is educational in nature.
  • 2. Nature of the Program

  • The Company provides educational programming focused on nervous system education, somatic practices, chronic illness, chronic pain, community support, and personal growth.
  • Participation in this program does not establish a therapist-client, physician-patient, counselor-client, or other healthcare provider relationship.
  • Participation is subject to the separate Informed Consent & Liability Waiver and Community Participation Agreement.
  • 3. Registration & Payment

  • Payment must be received in full prior to the beginning of the program unless an alternative
    payment arrangement has been approved in writing.
    Enrollment is not guaranteed until payment has been successfully processed.
    The Company reserves the right to cancel or postpone a program due to insufficient enrollment
    or unforeseen circumstances.
    Should the Company cancel a program before it begins, participants will receive either:
    • A full refund, or
    • The option to transfer enrollment to a future cohort.
  • 4. Refund & Cancellation Policy

  • Participant cancellations made before the program begins are subject to the refund policy
    outlined at the time of registration.
    Once the program has started, no refunds will be issued unless otherwise required by
    applicable law.
    Failure to attend live sessions does not entitle participants to refunds, credits, or future
    enrollment.
    If a participant voluntarily withdraws from the program after it has begun, no refund will be
    provided.
  • 5. Community Standards

  • Participants agree to comply with the Community Participation Agreement.
    The Company reserves the right to remove any participant whose behavior is disruptive,
    abusive, discriminatory, threatening, or otherwise inconsistent with maintaining a respectful
    learning environment.
    Removal from the program for violation of the Community Participation Agreement may occur
    without refund, subject to applicable law.
  • 6. Intellectual Property

  • All program materials, including but not limited to:
    • Videos
    • Slides
    • Worksheets
    • PDFs
    • Workbooks
    • Audio recordings
    • Written materials
    • Exercises
    • Logos
    • Branding
    • Course curriculum
  • remain the intellectual property of Abby Lopac unless otherwise stated.
  • Participants receive a limited, non-transferable license to use these materials for their own personal, non-commercial use.
  • Participants may not reproduce, distribute, sell, share, upload, modify, teach, or publish any program materials without prior written permission.
  • 7. Recording Policy

  • Live sessions may not be photographed, recorded, copied, or distributed by participants.
  • Unauthorized recording or distribution of program materials or live sessions may result in immediate removal from the program and may constitute copyright infringement.
  • 8. Technology

  • Participants are responsible for obtaining and maintaining adequate internet access, devices, software, and technology necessary to participate.
  • The Company is not responsible for interruptions caused by internet outages, platform failures, equipment malfunctions, or other circumstances beyond its reasonable control.
  • 9. Privacy

  • Participant information is handled in accordance with the Company's Privacy Policy.
    By participating in the program, you acknowledge that electronic communication platforms (such as email or video conferencing software) involve inherent privacy risks despite reasonable security measures.
  • 10. Disclaimer

  • The Company makes no guarantees regarding specific outcomes or results from participation in any program.
    Every participant's experience is unique.
    Educational information provided through the program should not be interpreted as medical advice, mental health treatment, diagnosis, or individualized healthcare recommendations.
    Participants should consult their own qualified healthcare providers regarding personal medical or mental health concerns.
  • 11. Limitation of Liability

  • To the fullest extent permitted by applicable law, the Company's total liability arising from participation in this program shall be limited to the amount paid by the participant for the applicable program.
    Nothing in these Terms limits liability where such limitation is prohibited by law.
  • 12. Indemnification

  • Participants agree to be responsible for their own conduct while participating in the program. Participants agree to indemnify and hold harmless Abby Lopac and Hootenanny Abby from claims arising out of the participant's own actions, misconduct, or violation of these Terms, except to the extent prohibited by law.
  • 13. Third-Party Interactions

  • Participants may choose to communicate or connect with other participants outside of official program activities. The Company does not supervise or assume responsibility for interactions, communications, relationships, meetings, advice, or transactions occurring outside official program sessions.
  • 14. Force Majeure

  • The Company shall not be liable for delays, cancellations, or inability to perform services due to circumstances beyond reasonable control, including but not limited to natural disasters, internet outages, illness, government actions, power failures, or other unforeseen events.
  • 15. Changes to Services

  • The Company reserves the right to make reasonable modifications to program content, scheduling, facilitators, delivery methods, or materials when necessary to improve participant experience or address unforeseen circumstances.
  • 16. Governing Law

  • These Terms shall be governed by the laws of the State of Idaho without regard to its conflict of law principles.

  • 17. Dispute Resolution

  • In the event of a dispute arising from these Terms or participation in the program, the parties agree to first attempt to resolve the matter through good-faith informal discussion. If the dispute cannot be resolved informally, it shall proceed according to applicable Idaho law.

  • 18. Severability

  • If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
  • 19. Entire Agreement

  • These Terms, together with the Privacy Policy, Community Participation Agreement, and Informed Consent & Liability Waiver, constitute the entire agreement between the participant and the Company regarding participation in the program.
