      •  Exclusive and Non-Transferable Use. The permit holder has exclusive use of the designated reserved sports facility during the approved rental period. Any adjoining area is included only when specifically identified on the permit. • Youth Sports Safety Compliance Agreement

    • LGS RECREATION YOUTH SPORTS SAFETY COMPLIANCE AGREEMENT

      (California Assembly Bills 379 (2019) and 310 (2025)

This Compliance Agreement ("Agreement") is entered into by and between LGS Recreation ("Agency") and the undersigned Youth Sports Organization ("YSO"). This Agreement governs the YSO's use of outdoor athletic fields and facilities managed by the Agency on behalf of the City of Saratoga and applies notwithstanding anything to the contrary in any other agreement or document concerning use of the facilities that are the subject of this Agreement.

Information about Assembly Bills 379 and 310

California Health & Safety Code sections 124235 through 124238.5 (the “Act”)

IT IS YOUR ORGANIZATION'S RESPONSIBILITY TO MEET ALL ACT LEGAL REQUIREMENTS IN A TIMELY MANNER

The following is a general summary of AB 379 and AB 310 rules applicable to Youth Sports Organizations (“YSOs”). A YSO is “an organization, business, nonprofit entity, or a local governmental agency that sponsors or conducts amateur sports competitions, training, camps, or clubs in which persons 17 years of age or younger participate.

The following is a summary. Please refer to the specific statutes for details.

      • Athletes suspected of sustaining a concussion or other head injury, or who have passed out or fainted, must be immediately removed from the athletic activity for the remainder of the day. The athlete may not return to any athletic activity until evaluated by a licensed healthcare provider and given written clearance to return. If the provider determines the athlete sustained a concussion or other head injury, the athlete must also complete a graduated return-to-play protocol of no less than seven days under that provider's supervision. If the healthcare provider suspects a cardiac condition placing the athlete at risk of sudden cardiac arrest or other heart-related issues, the athlete must remain under the provider's care for follow-up testing until cleared to play.

      • If an athlete 17 years of age or younger is removed from activity due to a suspected concussion, fainting, or another suspected cardiac condition, the YSO must notify the athlete’s parent or guardian of the time and date of the injury, the symptoms observed, and any treatment provided.

      • On a yearly basis, before any athlete may participate, the YSO must give the athlete (and the athlete's parent or guardian) a concussion/head injury information sheet and a sudden cardiac arrest information sheet, and must obtain signatures acknowledging receipt before the athlete is permitted to practice or compete that year.

      • Each year the YSO must offer concussion, head injury, and sudden cardiac arrest prevention education to each coach, administrator, and game official of the organization.

      • Beginning January 1, 2027, the YSO must ensure that its coaches are certified and recertified at least every two years to perform cardiopulmonary resuscitation and operate an AED. The YSO must also have a written cardiac emergency response plan and provide parents/guardians with an annual electronic communication containing the emergency response plan (or a link to it), the location(s) of any AEDs, and the staff designated to be notified in the event of a sudden cardiac event.

      • Beginning January 1, 2028, the YSO must ensure that a functioning AED is physically present, on-site, and available to its athletes during all official practices, matches, tournaments, and events. The YSO must announce the exact location of the AED over the public address system—or via highly visible written postings if a PA system is unavailable—before the start of every official match.

      • The YSO is responsible for maintaining and testing its portable AED units in strict accordance with the manufacturer's guidelines and federal Food and Drug Administration (FDA) regulations.

YSO SOLE RESPONSIBILITY FOR ACT COMPLIANCE

LGS Recreation and the City of Saratoga provide facility space for recreation but do not manage or oversee the YSO's internal athletic operations or safety compliance. Neither LGS Recreation nor the City of Saratoga will monitor, audit, or enforce the YSO's internal safety certifications, medical readiness during field operations, or any other aspect of Act compliance.

The YSO is solely responsible for complying with all requirements of the Act. The YSO bears all costs and logistical responsibilities associated with training staff, drafting emergency plans, monitoring athlete health conditions, notification and announcement requirements, purchasing or maintaining portable AED equipment, equipment availability and any other Act requirements. LGS Recreation, and the City of Saratoga, assume no responsibility for providing, maintaining, or operating AED equipment, or for otherwise meeting any of the requirements of the Act. The presence of permanent structures, AED equipment, or any LGS Recreation or City of Saratoga, staff at a facility that is the subject of this agreement does not shift compliance obligations from the YSO.

      DOCUMENTATION REQUIREMENTS

The YSO agrees to maintain documentation demonstrating compliance with applicable youth sports safety laws beginning January 1, 2027 except as noted below, including, as applicable:

•Signed annual concussion/sudden cardiac arrest information sheets

      •Current CPR/AED certification records

      •Written Emergency Response Plan

      •Coach roster

•Any additional documentation required by applicable law

•AED inspection and maintenance records beginning January 1, 2028

Upon request, the Organization shall provide this documentation to LGS Recreation to verify compliance. The YSO shall retain all such documentation for the then-current season plus the two (2) immediately preceding seasons.

      INCIDENT NOTIFICATION

The YSO agrees to notify LGS Recreation as soon as reasonably practicable, but no later than twenty-four (24) hours after becoming aware of any serious medical emergency (including, but not limited to concussion, head injury, sudden cardiac arrest, and AED deployment,) or fatality occurring during its permitted use of City of Saratoga facilities. This notice need only identify the date, time, and general nature of the incident and whether an AED was used and shall not include the affected individual's protected health information.

      INDEMNIFICATION AND ACKNOWLEDGMENT

      1. Compliance Certification: The YSO certifies that it will be in full compliance and will comply with all applicable provisions of the Act, on or before all statutory deadlines under the Act, and thereafter.

      2. Indemnification: To the fullest extent permitted by law, the YSO agrees to defend, indemnify, and hold harmless LGS Recreation, the City of Saratoga, and their respective officers, officials, employees, volunteers, and agents from any and all claims, demands, actions, liabilities, losses, damages, or injuries (including legal fees and court costs) arising out of, or resulting from, the YSO's failure to comply with the Act, including but not limited to associated with training staff, drafting emergency plans, notification and announcement requirements, purchasing or maintaining portable AED equipment, equipment availability and any other Act requirements.

      3. Right of Revocation: The YSO acknowledges that any failure to maintain compliance with the Act constitutes a material breach of the facility use agreement and, except for a failure that creates an imminent risk to health or safety (which may result in immediate suspension of use pending cure), may result, after written notice and a reasonable opportunity to cure of not less than ten (10) business days, in revocation of all field permits, reservation privileges, and future rental allocations.

      4. AED Access: If a permanent AED is installed at the facility that is the subject of this Agreement, the YSO acknowledges that it is solely responsible for locating the device, verifying its operational status, and obtaining facility access keys or codes for that device prior to field use. Neither LGS Recreation nor the City of Saratoga guarantees the functionality of facility-owned AED units or facility AED access.

      5. YSO Responsibility: Nothing contained in this Agreement shall be construed to transfer the YSO’s legal obligations or responsibilities to LGS Recreation, the City of Saratoga, or any other owner or operator of a facility that is the subject of this Agreement.
