  • Age Requirement: You must be 18 years or older to purchase a puppy from us. Breed Research and Commitment: By proceeding with this purchase, you acknowledge that you have conducted thorough research on the Great Dane breed. You affirm your commitment to provide the necessary resources for proper health care, socialization, and training of the puppy. Reservation of Rights: Ohana Great Danes of Michigan reserves the right to refuse the sale of a puppy to any individual at any time and for any reason. This reservation includes, but is not limited to, instances where we choose to retain a puppy for our breeding program, we identify a home that we deem more suitable for a specific puppy, or we find discrepancies or concerns within your application.

  • Deposit and Payment Terms

  • 1. Initial Deposit An initial deposit of $400.00 (four hundred dollars) is required to be added to our official wait list. This deposit shall be credited toward the final purchase price of the puppy. The initial deposit is non-refundable except in cases where Ohana Great Danes of Michigan deems that it cannot provide a puppy suitable for the purchaser.

    2. Second Deposit: A second deposit of $400.00 (four hundred dollars) is due at the time of picking up the puppy. We start to go down our wait list around 3 weeks of age. This deposit will also be credited toward the final purchase price of the puppy.

    3. Payment in Full: The total purchase price must be paid in full prior to the transfer or delivery of the puppy. Transfer of the puppy will not occur until the puppy is at least 10 weeks old. The final payment must be received, and all financial obligations met by the purchaser before the ownership of the puppy is transferred.

    4. Additional Fees: The purchaser is responsible for any additional fees that may arise during the purchase or transfer process, including but not limited to, transportation, health certification, and any other incidental expenses.

    5. Refunds and Transfer of Deposits: Deposits are non-refundable but may be transferred to another litter should the purchaser decide to select a puppy from a different litter in the future.
    If Ohana Great Danes of Michigan, at its sole discretion, decides not to complete the transaction for any reason, all deposits will be refunded promptly to the purchaser.

    6. Ownership and Registration: All puppies are considered the property of Ohana Great Danes of Michigan until the sales agreement is fully executed and payment is completed in full.
    Puppies are provided with Limited AKC registration unless purchased as a breeding dog, in which case specific terms and conditions regarding breeding rights will apply.
    General Provisions:

    This agreement is binding upon signature of applicant and is governed by the laws of the state in which it is executed.
    Any disputes arising from this agreement shall be resolved through mediation or, failing that, through binding arbitration in the jurisdiction where Ohana Great Danes of Michigan is located.

  • Parvo Virus Precaution Agreement


  • The Buyer acknowledges the risk of Parvo virus transmission in puppies, which is prevalent across the United States. The Buyer agrees to adhere to strict precautions during the transportation of the puppy from Ohana Great Danes of Michigan ("Breeder") to their home to prevent the contraction and spread of this virus.

    Ground Contact Prevention:

    The Buyer shall not place the puppy on the ground in areas where standing water is present or in locations frequented by other dogs. Such areas are recognized as high-risk zones for the transmission of Parvo virus.
    Safety Measures:

    During transportation, the Buyer agrees to exercise utmost caution in handling the puppy, using clean and sanitized carriers or holding the puppy, to prevent contact with contaminated surfaces or other animals.
    Acknowledgment of Risk:

    By signing this agreement, the Buyer acknowledges the susceptibility of young puppies to Parvo and other contagious diseases and commits to adhering to these precautionary measures to protect the health of the puppy.
    Medical Costs Responsibility:

    The Buyer will be responsible for all medical costs associated with the treatment of the puppy if it contracts Parvo or any other disease due to non-compliance with the agreed-upon precautions.
    Breach of Agreement and Penalties:

    If it is known that the Buyer is not following the agreed precautions, Ohana Great Danes of Michigan reserves the right to reclaim possession of the dog.
    Additionally, a penalty fee equal to 1.5 times the original purchase price of the dog will be imposed. This fee is due within 7 business days of the Breeder's notification of the breach.
    If the penalty fee is not paid within the specified 7 business days, an interest of 15% per day will be added to the outstanding balance until the full amount is paid.
    Legal Binding and Dispute Resolution:

    This agreement is legally binding upon signature by the Applicant/Buyer. Any breach of this agreement will be subject to legal enforcement and penalties as described herein.
    Any disputes arising from this agreement shall be resolved through mediation or, failing that, through binding arbitration in the jurisdiction where Ohana Great Danes of Michigan is located.

  • Genetic Health Guarantee

  • This Health Guarantee Agreement is between Ohana Great Danes of Michigan ("Breeder") and the undersigned purchaser ("Buyer"). This document outlines the health guarantees provided by the Breeder regarding the purchased Great Dane.

    1. Guarantee Duration:

    The Breeder extends this Genetic Health Guarantee to the Buyer, covering significant life-threatening genetic defects for a period of 24 months following the date of birth.
    2. Covered Conditions:

    This guarantee covers genetic defects that are diagnosed within two years from the date of birth of the puppy. If the puppy is diagnosed with a proven congenital defect, the Breeder agrees to replace the puppy with another of equal or lesser value, subject to availability. The Breeder does not guarantee the color, sex, or size of the replacement puppy.
    3. Exclusions from Guarantee:

    The Genetic Health Guarantee does not cover any of the following conditions, which may occur due to environmental, nutritional, or other non-genetic factors:

    Parasites, Giardia, or Coccidia
    Bloat, Allergies or allergy-related eye conditions such as Cherry Eye, Entropion, or Scrolled Cartilage, Mange, Vaccinosis, Orthopedic conditions such as OCD (Osteochondritis Dissecans), Wobblers Syndrome
    Addison’s Disease, Pica Skin problems, including Demodex, HOD (Hypertrophic Osteodystrophy), or Panosteitis
    These conditions are considered common across the breed and other large breed, long-boned dogs and are not deemed inheritable or transmitted directly from the parents.
    4. Claims Process:

    Veterinary Confirmation: In the event of a suspected life-threatening genetic defect, the Buyer must provide the Breeder with a comprehensive veterinary report, including X-rays and a full, up-to-date medical history of the puppy.
    Second Opinion Rights: The Breeder reserves the right to seek a second opinion on the puppy’s condition from a veterinarian of the Breeder's choice, at the Breeder’s expense.
    5. Remedies for Genetic Defects:

    Should the second opinion confirm the initial diagnosis, the Buyer is entitled to a replacement puppy of equal value from the next available litter. No monetary refunds will be provided.
    6. Legal and Binding Agreement:

    This agreement is legally binding upon signature by the Buyer and any breach of this agreement will be subject to legal enforcement and penalties as described herein.
    Any disputes arising from this agreement shall be resolved through mediation or, if necessary, binding arbitration in the jurisdiction where Ohana Great Danes of Michigan is located.

  • Return and Rehoming Agreement

  • 1. Obligation to Return:

    The Buyer agrees that in the event they are unable to keep the purchased dog or unable to provide proper care and medical attention, the dog must be returned directly to Ohana Great Danes of Michigan ("Breeder"). The dog shall not be rehomed, sold, or given to any other individual or organization without the express written consent of the Breeder.
    2. No Refund Policy:

    If the dog is returned to the Breeder for any reason, the Buyer acknowledges that no refunds will be issued for any payments made towards the purchase price of the dog, including but not limited to the initial deposit and final payment.
    3. Unauthorized Rehoming Penalty:

    In the event that it is discovered the dog has been given to another party without the prior authorization of Ohana Great Danes of Michigan ("Breeder"), the Buyer will incur a penalty fee equal to 1.5 times the original purchase price of the dog. This fee is due within 7 business days of notification by the Breeder.
    If the penalty fee is not paid within the specified 7 business days, an interest charge of 15% per day will be added to the outstanding balance until the full amount is paid.
    4. Legal Costs:

    If legal action is necessary to enforce any part of this agreement, including the recovery of the dog or the collection of fees, the Buyer will be responsible for all related legal costs incurred by the Breeder.
    5. Agreement Binding:

    This agreement is legally binding upon signature by Applicant/Buyer and any breach of this agreement will be subject to legal enforcement and penalties as described herein.
    Any disputes arising from this agreement shall be resolved through mediation or, failing that, through binding arbitration in the jurisdiction where Ohana Great Danes of Michigan is located.

  • Additional Clauses forPuppy Purchase

  • Health Check Requirement:

    The Buyer is required to have the puppy examined by a licensed veterinarian within 72 hours of receipt. Failure to complete this examination within the specified timeframe may result in the voiding of the health guarantee provided by Ohana Great Danes of Michigan.
    Vaccination and Medical Records:

    The Breeder will provide the Buyer with a complete set of vaccination and medical records at the time of purchase. The Buyer agrees to continue the puppy’s vaccinations according to the schedule recommended by their veterinarian and to maintain up-to-date medical records.
     

    Liability Disclaimer:

    The Buyer agrees that Ohana Great Danes of Michigan is not liable for any damage or injury caused by the puppy once ownership has been transferred to the Buyer. This includes but is not limited to damages or injuries to persons, animals, or property.
    Privacy and Use of Images:

    The Buyer grants the Breeder the right to use images and information related to the puppy for promotional, educational, or any other similar purposes. However, personal data of the Buyer will not be disclosed without explicit consent.
    Jurisdiction and Legal Venue:

    This agreement and any dispute arising from the relationship between the parties to this agreement shall be governed by the laws of the state in which Ohana Great Danes of Michigan is located. Disputes will be adjudicated exclusively in the federal or state courts located in that jurisdiction.
    Signature Confirmation:

    By signing below, the Buyer acknowledges understanding and agreement to all terms as outlined in these additional clauses and the overall purchase agreement.
