Ferguson Foodies Festival Vendor Terms & Conditions Vendor Agreement:
By submitting this application, I acknowledge that I have read, understand, and agree to the following Terms and Conditions for participation in the Ferguson Foodies Festival.
1. Vendor Compliance:
I agree to comply with all Ferguson Foodies Festival policies, event rules, and instructions provided by event organizers before and during the festival.
2. Products and Services:
I understand that this application applies only to the products, food, beverages, merchandise, services, and equipment listed in my application. Any additions or significant changes must be approved by the Festival Organizer prior to the event.
3. Legal Compliance:
I certify that all products, food, beverages, services, permits, licenses, and business operations comply with all applicable local, county, state, and federal laws and regulations. I understand that I am solely responsible for obtaining any permits, inspections, certifications, or licenses required for my business.
4. Booth Operation
Arrive, unload, set up, and be ready to operate by the designated setup time.
Keep my booth staffed and operational during the festival's scheduled hours.
Maintain a clean, safe, and professional booth space throughout the event.
Remove all trash, supplies, and equipment from my assigned space at the conclusion of the festival unless otherwise instructed.
5. Food Safety (Food Vendors Only):
Food vendors agree to follow all applicable food safety regulations, maintain proper temperatures for food and beverages, and comply with all requirements of the appropriate health department.
6. Liability and Release:
To the fullest extent permitted by law, I voluntarily release and discharge the Ferguson Foodies Festival, its organizers, volunteers, sponsors, the City of Ferguson, and their respective officers, employees, and agents from any claims, demands, damages, losses, or causes of action arising out of my participation in the event, including claims arising from ordinary negligence. This release does not apply to claims resulting from intentional misconduct or any liability that cannot legally be waived.
7. Indemnification:
I agree to defend, indemnify, and hold harmless the Ferguson Foodies Festival, its organizers, sponsors, volunteers, and the City of Ferguson from any claims, damages, liabilities, costs, or expenses arising from my business operations, products, employees, agents, or participation in the event, except to the extent caused by their intentional misconduct or gross negligence, where applicable by law.
8. Event Changes and Cancellation:
The Ferguson Foodies Festival reserves the right to modify event hours, booth assignments, or festival operations due to weather, safety concerns, emergencies, or circumstances beyond its control. Such changes do not guarantee a refund unless otherwise stated in the festival's refund policy.
9. Right to Refuse or Remove Vendors:
The Ferguson Foodies Festival reserves the right to deny any application or remove any vendor before or during the event whose products, services, conduct, or business practices are inconsistent with the festival's mission, create safety concerns, violate event policies, or negatively affect the experience of attendees.
10. Photography and Promotion:
I understand that photographs and video may be taken during the event. I grant the Ferguson Foodies Festival permission to use photographs or video that include my booth, business name, logo, employees, products, or likeness for promotional, marketing, social media, and future event purposes without compensation.
11. Vendor Responsibility:
I understand that I am responsible for my own property, inventory, equipment, cash handling, and insurance. The Ferguson Foodies Festival and the City of Ferguson are not responsible for lost, stolen, or damaged property.
