WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

 

In consideration for receiving permission for me/my child to participate in the
Guilford Park High School Reindeer Run Crusher 5K event through the adjacent Savage Stone property, (the “Event”), I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Savage Stone, LLC, Chase Land, LLC, and their members, officers, employees, affiliates and related entities (hereinafter “Releasees”) from any and all liability, claims, demands, or injury , including death, that may be sustained by me or my child, or to any property belonging to me or my child, while participating in such Event, regardless of whether such loss is caused by the negligence of the Releasees, or otherwise, and regardless of whether such liability arises in tort, contract, strict liability or otherwise, to the fullest extent allowed by law.

I further agree to indemnify and hold harmless the Releasees from any loss,
liability, damage, or costs including court costs and attorney’s fees that Releasees may incur due to me/my child’s participation in such Event whether caused by the negligence of Releasees or otherwise to the fullest extent allowed by law.

It is my intent that this Waiver and Hold Harmless Agreement shall bind the members of my family and my heirs, assigns and personal representatives.

Participant Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement

Please read this agreement carefully. By registering for and participating in the 2026 Reindeer Run Crusher 5K, you acknowledge that you have read, understood, and agree to the following terms. If the participant is under the age of 18, a parent or legal guardian must agree to these terms on the participant's behalf.

Assumption of Risk
I understand that participating in a road/trail race and related activities involves inherent risks, including but not limited to falls, contact with other participants, vehicles, spectators, equipment, uneven terrain, weather conditions, wildlife, medical emergencies, and other hazards that may result in serious bodily injury, permanent disability, death, or property damage.

I knowingly and voluntarily assume all risks, known and unknown, associated with my participation in the 2026 Reindeer Run Crusher 5K.

Release and Waiver of Liability
To the fullest extent permitted by applicable law, I, on behalf of myself, my heirs, executors, administrators, personal representatives, successors, and assigns, hereby release, waive, discharge, and covenant not to sue the following parties (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, liabilities, costs, expenses, or attorney's fees arising out of or related to my participation in the event, including any claims arising from personal injury, illness, death, property damage, theft, or other loss:

• Guilford Park High School Boosters Organization;
• The Guilford Park High School Boosters Executive Board;
• All officers, directors, committee members, volunteers, coaches, employees, agents, and representatives of the Guilford Park High School Boosters Organization;
• Howard County Public School System (HCPSS);
• The Howard County Board of Education;
• Guilford Park High School;
• The administration, faculty, staff, employees, volunteers, and representatives of Guilford Park High School;
• Savage Stone, Inc.;
• Any event sponsors, partners, vendors, contractors, public agencies, municipalities, property owners, law enforcement agencies, emergency responders, volunteers, race officials, timers, and any other individuals or entities involved in organizing, hosting, sponsoring, supporting, or conducting the event.

This release applies whether the claim arises from negligence or otherwise, except where prohibited by law or where liability cannot legally be waived, such as for gross negligence, reckless conduct, or intentional misconduct.

Indemnification
I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, actions, damages, liabilities, judgments, costs, or expenses (including reasonable attorneys' fees) arising out of or related to my participation in the event, including any claims brought by me or by third parties resulting from my actions or conduct during the event, except to the extent prohibited by applicable law.

Medical Treatment
I authorize event personnel to obtain emergency medical treatment on my behalf if necessary. I understand that I am solely responsible for any medical expenses incurred as a result of my participation in the event.

Personal Responsibility
I certify that I am physically able to participate in this event and have not been advised otherwise by a qualified medical professional. I agree to comply with all race rules, instructions from race officials, volunteers, law enforcement, and event staff, and all applicable laws. I understand that failure to comply may result in my removal from the event without refund.

Photography and Media Release
I grant permission to the event organizers and their designees to photograph, videotape, record, or otherwise capture my likeness, voice, or image during the event and to use such materials for promotional, educational, fundraising, or other lawful purposes without compensation.

Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.

Acknowledgment
By completing my registration, I acknowledge that:

• I have carefully read this Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement.
• I fully understand its contents.
• I understand that I am giving up substantial legal rights, including the right to sue the Released Parties, to the fullest extent permitted by law.
• I am signing this agreement freely and voluntarily, without inducement or coercion.
• If registering a minor participant, I certify that I am the participant's parent or legal guardian and have the legal authority to execute this agreement on the minor's behalf.
