A minor child under the age of eighteen (18) years old (the “Minor”), and as such parent(s)/guardian(s) do hereby voluntarily agree to the following on behalf of myself/ourselves, the Minor, our heirs, assigns, personal representatives and estates:
Assumption of Risk. I/We have actual knowledge and conscious appreciation of the danger involved in athletic, and volleyball related activities, including but not limited to bodily injuries that may result with engaging in such activities while participating in volleyball events.
Consent to Participation. I/We voluntarily consent to the participation of the Minor in the North Volleyball
Medical Certification. I/We certify that the Minor to be in good health and able to participate in all activities, including those related to participating in contact volleyball without restriction.
Medical Treatment. I/We authorize the employees, representatives or agents of The North Volleyball to obtain or consent to any necessary treatment or medical care to the Minor in the event of a medical emergency or trauma occurring to the Minor during the practices or games.
Release. In consideration of Minor being allowed to participate in the volleyball events, I/We, and on behalf of Minor, do hereby completely forever release and covenant not to pursue legal action against the North Sports Club, or their employees, sub-contractors, agents, affiliates, members, officers, directors, and respective successors and assigns (collectively known as “Releasees”), from any and all present and future claims, causes of action, damages, costs, expenses, and attorneys’ fees for property damage, bodily and personal injury, illnesses, paralysis, and/or death arising out of Minor’s participation in the practices and games, (“Claims”).
Indemnification. I/We hereby acknowledge and agree to fully indemnify and hold forever harmless the Releasees against loss from any and all: (i) Claims; (ii) any and all present and future claims, causes of action, damages, costs, expenses, and attorneys’ fees which may hereinafter or at any time be made or brought against Releasees by any person or entity as a result of property damage, bodily and personal injury, illness, paralysis, and/or death to the Minor arising out of the Minor’s participation in the practices and games; and (iii) any and all present and future claims, causes of action, damages, costs, expenses, and attorneys’ fees which may hereinafter or at any time be made or brought against Releases by any person or entity who claims to have been damaged as a result of Minor’s negligence in connection with the Minor’s participation in the volleyball events.
Media Release. I/We hereby authorize and grant The North Volleyball, and their successors and assigns, the irrevocable right and permission to photograph, record, copy, reproduce, broadcast, transmit, and/or exploit throughout the world, by any present or future method or means, the Minor’s participation in the volleyball events. In connection with the foregoing, The North Volleyball may use and license to others the right to use, reproduce, distribute, exhibit and televise the Minor’s name, likeness, voice, physical picture, silhouette and other reproductions of the Minor’s physical likeness and voice (as they may appear in any electronic format, still camera photograph, and or video film), alone, or with others, in whole or in part.
Governing Law. I/We hereby agree that this Waiver and Release shall be governed by the laws of the Province of Ontario, without reference to its choice of rules.
Authorization. I/We hereby acknowledge that this Waiver and Release, authorization, and permission for the Minor to participate in the volleyball events, are freely and voluntarily given by the undersigned(s).
We have read this Waiver and Release, fully understand its terms and conditions, and acknowledge that I/We are giving up substantial rights by signing it.
