This Liability Waiver, Assumption of Risk, and Release Agreement (“Agreement”) is entered into by and between A Greater Good Foundation (“Organization”) and the participant identified below (“Participant,” and if a minor, together with their parent or legal guardian) in connection with participation in the program, workshop, activity, or event identified above (the “Program”).

1. Acknowledgment of Risk

I understand that participation in the Program may include physical activities, group exercises, travel, experiential challenges, discussions of a personal or emotional nature, and other activities designed to promote personal growth, self-awareness, leadership, and goal achievement. I understand that these activities carry inherent risks, including but not limited to:

• Physical injury, including strains, sprains, falls, or more serious injury
• Emotional or psychological discomfort arising from self-reflection, group discussion, or feedback exercises
• Risks associated with travel to and from Program locations
• Risks arising from interaction with other participants, facilitators, staff, or volunteers
• Risks that are unknown, unanticipated, or not readily foreseeable at this time

I voluntarily and knowingly assume all such risks, known and unknown, and understand that this assumption of risk is a material part of the consideration for my (or my child’s) participation in the Program.

2. Release and Waiver of Liability

In consideration for being permitted to participate in the Program, I, on behalf of myself, my heirs, executors, administrators, and assigns, do hereby release, waive, discharge, and covenant not to sue A Greater Good Foundation, its officers, directors, employees, agents, volunteers, facilitators, contractors, and affiliated organizations (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me (or my child) while participating in the Program, or while on the premises where the Program is conducted, except to the extent caused by the gross negligence or intentional misconduct of the Released Parties, where and to the extent such a limitation is prohibited by applicable law.

3. Indemnification

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys’ fees, that they may incur due to my (or my child’s) participation in the Program, whether caused by my (or my child’s) negligence or otherwise.

4. Medical Treatment Authorization

In the event of illness or injury during the Program, I authorize A Greater Good Foundation staff to secure and consent to any necessary emergency medical treatment on my (or my child’s) behalf, and I agree to be financially responsible for any costs associated with such treatment. I have listed below any medical conditions, allergies, or medications that Program staff should be aware of.

5. Rules of Conduct

I agree to follow all rules, guidelines, and instructions provided by Program staff and understand that A Greater Good Foundation reserves the right to remove any participant from the Program for conduct that is unsafe, disruptive, or inconsistent with Program guidelines.

6. Severability and Governing Law

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by the laws of the State of Indiana, without regard to its conflict of law principles.

7. Acknowledgment

I have read this Agreement in its entirety, understand its terms, understand that I have given up substantial legal rights by signing it, and sign it freely and voluntarily without any inducement.

 

Parent / Legal Guardian Consent (required if Participant is under 18)

I am the parent or legal guardian of the minor Participant named above. I have read and understood this Agreement, and I consent to my child’s participation in the Program on the terms described herein. I agree, on behalf of myself and my child, to be bound by all terms of this Agreement.

The Power of Being Yourself Camp

A Greater Good Foundation (“Organization”) may take photographs, video, and audio recordings of participants during the program, workshop, activity, or event identified above (the “Program”). This form grants Organization permission to use these images and recordings as described below.

1. Grant of Permission

I grant A Greater Good Foundation and its authorized representatives permission to photograph, video record, and/or audio record me (or my child, if Participant is a minor) during the Program, and to use, reproduce, publish, edit, and distribute those photographs, recordings, and any related name, likeness, voice, or quotations (collectively, the “Media”) for the following purposes:

Educational and program materials, including curricula, presentations, and reports
Marketing and promotional materials, including brochures, flyers, and advertisements
The Organization’s website and social media channels
Newsletters, annual reports, and donor or funder communications
Press releases and media coverage of the Organization’s programs

2. No Compensation

I understand that my (or my child’s) participation in the Media is voluntary and that I will not receive any payment, royalty, or other compensation for the use of the Media.

3. Ownership

I understand that any photographs, video, or audio recordings taken by A Greater Good Foundation or its representatives are the property of A Greater Good Foundation, which may use them for the purposes described above without further notice to or approval from me.

4. Waiver of Inspection and Approval

I waive any right to inspect or approve the finished Media, including any related written or recorded copy, before it is used, and I release A Greater Good Foundation from any liability related to the use of the Media, including any claims of defamation, invasion of privacy, or infringement of moral rights, to the extent permitted by applicable law.

5. Duration

This release remains in effect indefinitely unless I revoke it in writing to A Greater Good Foundation, with the understanding that revocation will not affect any use of the Media that occurred prior to the revocation.
