Assumption of Risk, Liability Waiver & Acknowledgement
Please read each statement carefully and initial each line.
I understand that participation in swim lessons and aquatic activities involves inherent risks, including but not limited to slips and falls, drowning, near drowning, illness, physical injury, permanent disability, and death.
I voluntarily choose to participate (or allow my child to participate) in lessons provided by 30 to 2 LLC and knowingly assume all risks associated with participation.
I understand that there is no lifeguard on duty during lessons. Water supervision is provided by the instructor as part of the instructional program.
I understand that there is no Automated External Defibrillator (AED) available on site.
I understand that 30 to 2 LLC rents pool time at The Inn at Middletown and does not own, operate, or maintain the facility. While 30 to 2 LLC performs a visual inspection and basic water test before each lesson, it has no control over the pool's, equipment, mechanical systems, water chemistry, cleanliness, maintenance, or overall condition. These responsibilities belong solely to the facility owner and operator.
I understand that other hotel guests may be using the pool and surrounding areas during my scheduled lesson.
I certify that I (or my child) am physically able to participate and have disclosed any medical conditions, allergies, medications, injuries, or other conditions that may affect safe participation.
I understand that 30 to 2 LLC, The Inn at Middletown, and their owners, officers, directors, employees, instructors, assistant instructors, trainees, volunteers, independent contractors, agents, representatives, affiliates, successors, and assigns are not responsible for the loss, theft, or damage of personal property.
Photo & Video Permission (Please Initial One)
YES-I give 30 to 2 LLC permission to photograph and/or record me or my child during lessons and to use those images or videos for educational, promotional, advertising, website, and social media purposes without compensation.
NO - I do not give permission for photographs or videos of me or my child to be used for promotional or marketing purposes.
To the fullest extent permitted by law, I release, waive, and hold harmless 30 to 2 LLC, Diamond in the Ralph LLC, The Inn at Middletown, and their owners, officers, directors, employees, instructors, assistant instructors, trainees, volunteers, independent contractors, agents, representatives, affiliates, successors, and assigns from claims, demands, damages, or liability arising from participation in swim lessons or use of the facility, except where such liability cannot legally be waived.
I have carefully read and understand this Assumption of Risk, Liability Waiver, and Acknowledgement. I have had the opportunity to ask questions, understand that I am giving up certain legal rights, and voluntarily agree to its terms.
