  • Duty of Disclosure

  • Under section 21 of the Insurance Contracts Act 1984 (Cth), the Owners Corporation must disclose to its insurer every matter it knows, or could reasonably be expected to know, that is relevant to the insurer’s decision to insure the property and on what terms. Failure to disclose may allow the insurer to reduce its liability in a claim, impose different policy terms, or cancel the policy.
