TRIPLE DEUX MEDIA
AVP JUNIOR NATIONALS 2026 COVERAGE TERMS OF AGREEMENT
Effective Date: 07/20/26
By checking the required agreement box and submitting an order or payment for Triple Deux Media coverage associated with AVP Junior Nationals 2026, the purchaser acknowledges that they have read, understood, and agreed to these Terms of Agreement.
For purposes of this agreement, “Triple Deux,” “Triple Deux Media,” “we,” “us,” or “our” means Triple Deux, Inc., operating as Triple Deux Media, together with its authorized employees, contractors, photographers, videographers, editors, producers, production personnel, representatives, and service providers.
“Customer” or “Purchaser” means the adult completing or paying for the order.
“Athlete” means each athlete identified in the applicable order.
“Event” means AVP Junior Nationals 2026 and related tournament activities.
“Order Confirmation” means the completed checkout record, receipt, confirmation email, invoice, or other written confirmation issued by Triple Deux identifying the purchased package, price, athlete or athletes, coverage option, and included deliverables.
“Confirmed Match” means a match or coverage window specifically confirmed by Triple Deux through an official written communication channel.
1. Adult Purchaser, Authority, and Minor Consent
The Purchaser must be at least 18 years old.
If an Athlete is under 18 years old, the Purchaser certifies that they are the Athlete’s parent or legal guardian or possess valid authorization from the Athlete’s parent or legal guardian to arrange the coverage and grant the permissions contained in this agreement.
If an order covers two Athletes, the Purchaser certifies that each adult Athlete has consented or that the parent or legal guardian of each minor Athlete has provided prior consent. The Purchaser agrees to retain evidence of any consent obtained from another Athlete’s parent or legal guardian and provide it to Triple Deux upon reasonable request.
One Athlete’s parent does not automatically have authority to consent for another Athlete. A coach, club representative, teammate’s parent, family friend, tournament representative, or other person may not consent for a minor unless that person is the minor’s legal guardian or has valid authority from the minor’s parent or legal guardian.
Triple Deux may refuse, delay, pause, or cancel coverage when Triple Deux reasonably believes that the Purchaser lacks authority to provide consent for an Athlete.
2. Media Release and Permission
The Purchaser authorizes Triple Deux to photograph, film, video record, capture ordinary ambient Event audio, edit, reproduce, process, store, archive, and deliver media featuring the Athlete in connection with the purchased service.
This permission includes the Athlete’s name, image, likeness, voice, athletic performance, uniform, partner or team affiliation, club affiliation, social-media information, and other information voluntarily submitted with the order.
The Purchaser grants Triple Deux a non-exclusive, worldwide, royalty-free license and permission to use selected media featuring the Athlete for Triple Deux portfolios, websites, social-media channels, advertisements, promotional campaigns, sample galleries, Event recaps, Athlete features, newsletters, presentations, sponsor presentations, case studies, sales materials, editorial storytelling, and related Triple Deux marketing and promotional purposes.
No publication, feature, tag, repost, promotional placement, or distribution is guaranteed. No additional compensation is owed for an authorized use of the media.
Triple Deux will not knowingly create, publish, or use media featuring a minor Athlete in an unsafe, exploitative, materially deceptive, or inappropriate context.
Triple Deux may request age-appropriate cooperation or assent from a minor before conducting a directed interview, portrait session, or similar production activity.
A directed interview, testimonial, private discussion, or other recorded conversation will be identified as being recorded before recording begins. Triple Deux will not intentionally record a confidential or private conversation without appropriate consent.
3. Package Selection and Deliverables
Deliverables are limited to the package, coverage option, team option, upgrade, add-on, or other service selected and paid for at checkout.
Package names, prices, quantities, availability, promotional offers, included services, and coverage options may change before or during the Event.
The package description shown at checkout and reflected in the Customer’s Order Confirmation controls the purchase.
Changes made to package offerings, pricing, availability, or deliverable quantities after a Customer completes an order do not change that Customer’s confirmed purchase unless Triple Deux and the Customer agree otherwise in writing.
If general website language, advertising, social-media content, flyers, mockups, promotional materials, verbal discussions, or other general marketing language conflict with the Order Confirmation, the Order Confirmation controls.
Additional Athletes, additional matches, additional deliverables, practice sessions, full-match recordings, raw files, extended edits, expedited delivery, recruiting-oriented services, upgrades, or other services outside the confirmed order require a separate purchase or written confirmation from Triple Deux.
An order may not be transferred to another Athlete, team, or family without written approval from Triple Deux.
4. Individual and Team Coverage
Unless the Order Confirmation expressly states otherwise, an individual coverage package applies to one named Athlete during one Confirmed Match.
A team or partner coverage package applies only to the named Athletes identified in the order while those Athletes are competing together during the same Confirmed Match.
A team or partner package does not automatically include:
- Coverage of either Athlete during a different match;
- Coverage of either Athlete with a different partner;
- Coverage of additional teammates;
- Coverage of an entire club or roster;
- Separate tournament-wide coverage for both Athletes; or
- Any deliverable not identified in the Order Confirmation.
Opponents, coaches, officials, spectators, family members, and other people may appear incidentally in the media. Incidental appearance does not make that person a separately covered Customer or entitle that person to individual deliverables.
5. One Confirmed Match
Unless expressly stated otherwise in the Order Confirmation, coverage is limited to one Confirmed Match.
A purchase does not automatically include coverage of:
- Every pool-play match;
- Every bracket match;
- Every tournament day;
- Elimination rounds;
- Semifinals;
- Finals;
- Warm-ups;
- Practices;
- Award ceremonies;
- Medal presentations; or
- The Athlete’s complete Event experience.
A Customer may request a preferred match, day, court, competition round, or time. A submitted preference is only a request.
A match is not confirmed until Triple Deux provides written confirmation through an official Triple Deux communication channel.
Tournament schedules, start times, court assignments, match durations, and bracket progression remain subject to change.
6. Scheduling and Customer Responsibilities
The Customer is responsible for providing complete and accurate information, including:
- Athlete’s full name;
- Athlete’s division or age group;
- Partner’s name;
- Club affiliation, where applicable;
- Uniform colors and identifying details;
- Match date;
- Match time;
- Court assignment;
- Bracket or competition information;
- Parent, guardian, adult-Athlete, or Purchaser contact information; and
- Delivery email address.
The Customer must promptly notify Triple Deux of known changes involving:
- Match time;
- Court assignment;
- Competition date;
- Division;
- Partner;
- Delays;
- Bracket progression;
- Forfeits;
- Withdrawals;
- Injuries;
- Disqualification; or
- Athlete availability.
Submitting a schedule, screenshot, bracket, or preferred match does not confirm coverage.
Triple Deux is not responsible for missed or reduced coverage caused by:
- Incorrect, incomplete, or outdated information;
- Failure to submit requested information;
- Failure to communicate a schedule or court change;
- Late schedule updates;
- Athlete absence or late arrival;
- Failure to respond to scheduling communications;
- Failure to follow a communicated check-in procedure;
- Messages sent through unofficial or unmonitored channels; or
- The Customer assuming Triple Deux will attend an unconfirmed match.
7. Match Changes and Onsite Decisions
If a Confirmed Match is delayed, moved, suspended, reassigned, or otherwise affected, Triple Deux may reasonably move the coverage assignment to:
- The rescheduled version of the Confirmed Match;
- Another match involving the same Athlete or team;
- A later reasonably available match;
- An available coverage window; or
- Another opportunity agreed to by the Customer and Triple Deux.
Triple Deux will communicate material changes when reasonably practical. Tournament conditions may require immediate onsite decisions.
Triple Deux does not control tournament schedules, bracket progression, court assignments, weather decisions, Event operations, venue operations, or tournament rulings.
8. Coverage Priority
Coverage priority is generally determined by:
- The date and time the order is completed;
- The date and time full payment is received;
- The date complete Athlete and schedule information is received;
- The production requirements of the package;
- Match and court availability;
- Crew availability; and
- Any priority option expressly confirmed by Triple Deux.
An inquiry, incomplete form, unpaid invoice, social-media message, or verbal conversation does not reserve coverage.
Triple Deux may offer priority upgrades or special scheduling arrangements when production capacity allows.
A priority option increases scheduling priority only. It does not guarantee:
- A specific match;
- A specific court;
- A particular competition round;
- An exact start time;
- A championship appearance;
- A specific photographer or videographer;
- A particular play, point, or moment; or
- Coverage when Event or venue conditions make the assignment impossible.
9. Additional Match Coverage
Additional match coverage is not included unless it is expressly identified in the Order Confirmation.
Coverage of another match normally requires a separate purchase and written confirmation.
Triple Deux may voluntarily attend another available match when Triple Deux determines that additional usable material is reasonably needed to complete the confirmed deliverables and production capacity permits.
Voluntary additional capture:
- Is not guaranteed;
- Does not convert the purchase into tournament-wide coverage;
- Does not increase the confirmed deliverable quantities;
- Does not entitle the Customer to every file captured;
- Does not create an obligation to cover another match; and
- Does not establish a promise for future orders.
10. Coverage Expectations and Limitations
Triple Deux will make reasonable professional efforts to capture the named Athlete or Athletes during the Confirmed Match.
Triple Deux does not guarantee the capture or delivery of any particular:
- Serve;
- Dig;
- Block;
- Attack;
- Rally;
- Point;
- Celebration;
- Reaction;
- Interaction;
- Portrait;
- Warm-up;
- Award;
- Medal moment;
- Coach interaction;
- Family interaction; or
- Other specific moment.
The amount and variety of usable media depend on circumstances including:
- Match length;
- Game flow;
- Number of rallies;
- Athlete involvement;
- Playing position;
- Court layout;
- Lighting;
- Weather;
- Physical obstructions;
- Spectator placement;
- Venue access;
- Credential restrictions;
- Safety restrictions; and
- Tournament operations.
A match that ends early because of injury, forfeit, disqualification, weather interruption, Event ruling, or similar circumstance may produce less variety than a full-length match.
The absence of a specific desired point, play, photograph, clip, or moment does not by itself mean that Triple Deux failed to provide the purchased service.
11. Final Media Selection and Creative Control
Unless the Order Confirmation expressly includes Customer selections, Triple Deux selects the final:
- Photographs;
- Video moments;
- Clips;
- Sequences;
- Graphics;
- Music;
- Audio; and
- Edits.
The Customer is not purchasing every photograph or video file captured during coverage.
Triple Deux may exclude media because of:
- Missed focus;
- Motion blur;
- Repetition;
- Poor exposure;
- Obstruction;
- Poor composition;
- Technical limitations;
- Unflattering or inappropriate presentation;
- Safety or privacy concerns;
- Insufficient creative value; or
- Triple Deux’s reasonable professional editorial judgment.
Package quantities refer to final delivered media, not the total number of files captured.
Triple Deux retains creative and editorial control over image selection, clip selection, cropping, color treatment, exposure, sound, music, pacing, sequencing, graphics, captions, transitions, highlight structure, and overall presentation.
A disagreement with Triple Deux’s reasonable creative choices does not automatically constitute a fulfillment error.
If a proof-selection process is included, the Customer must submit selections by the deadline communicated with the proof gallery. If selections are not received by the stated deadline, Triple Deux may select the final deliverables on the Customer’s behalf.
12. Reasonable Substitutions
Triple Deux may make minor substitutions when necessary because of:
- Tournament schedule changes;
- Weather;
- Venue restrictions;
- Athlete availability;
- Technical limitations;
- Production constraints; or
- Circumstances outside Triple Deux’s reasonable control.
A minor substitution may not materially reduce the overall value or primary purpose of the confirmed package.
A materially different substitution requires the Customer’s written approval.
If the Customer does not approve a materially different substitution, Triple Deux will provide an appropriate proportional refund or credit for the affected undelivered portion.
Triple Deux may not use this section to replace a confirmed service with a materially lower-value service without Customer approval.
13. Digital Delivery
Triple Deux will deliver final media through a digital gallery, folder, file-sharing service, media-delivery platform, or other system selected by Triple Deux.
Any delivery timeframe shown at checkout, in the Order Confirmation, or in a later fulfillment communication is an estimate and not a guaranteed completion date.
Delivery timing may vary because of:
- Event order volume;
- Package type;
- Editing workload;
- Production complexity;
- Technical problems;
- File-transfer issues;
- Staff illness or emergency;
- Customer response time; or
- Circumstances outside Triple Deux’s reasonable control.
Photo and video components may be delivered separately or in stages.
Same-day, next-day, or expedited delivery is not included unless expressly purchased and confirmed.
If final delivery is expected to occur more than 14 calendar days after the most recently communicated estimated delivery date, Triple Deux will provide the Customer with a status update and revised estimated delivery date.
The Customer is responsible for downloading, saving, and backing up delivered files promptly.
Triple Deux may maintain archives but does not guarantee permanent storage, indefinite gallery access, future re-delivery, or long-term availability of third-party delivery links.
14. Corrections and Revisions
A creative revision is included only if expressly stated in the Order Confirmation.
Unless otherwise stated, the purchase does not include:
- Alternate versions;
- Music changes;
- Replacement selections;
- Extended edits;
- Complete re-edits;
- New creative direction;
- Additional deliverables; or
- Re-editing based solely on personal preference.
Triple Deux will correct a clear fulfillment error reported within seven calendar days after delivery, including:
- A corrupted delivered file;
- Delivery of another Athlete’s media;
- A missing confirmed deliverable; or
- An Athlete name entered incorrectly by Triple Deux.
Customer-requested music may be considered when practical, but final audio selection remains subject to licensing restrictions, platform availability, copyright filtering, editing fit, and Triple Deux’s discretion.
15. Raw Files, Unedited Media, and Full-Match Recordings
Raw photographs, unedited video, memory-card files, camera originals, project files, unused photographs, unused video, full rallies, and full-match recordings are not included unless expressly stated in the Order Confirmation.
A package containing gameplay clips or an edited highlight does not automatically include continuous recording of the entire match.
Requests for raw media, extended footage, full-match footage, additional photographs, additional clips, alternate edits, or project files require separate written approval and may require an additional fee.
Triple Deux is not obligated to retain unused or raw media indefinitely after fulfillment.
16. Copyright and Ownership
All photographs, video, edits, raw media, project files, graphics, captions, creative concepts, sequences, unused media, archived media, and related assets created by Triple Deux remain the intellectual property of Triple Deux.
Purchasing a service does not transfer copyright ownership to the Customer, Athlete, parent, guardian, partner, club, school, sponsor, brand, business, media outlet, or any other third party.
Copyright ownership transfers only through a separate written agreement signed by an authorized representative of Triple Deux.
17. Customer Personal-Use License
After full payment, the Customer receives a limited, non-exclusive, non-transferable license to use final delivered media for:
- Personal use;
- Family use;
- Athlete social-media accounts;
- Athlete portfolios;
- Recruiting profiles;
- Scholarship applications;
- School or college recruiting communications;
- Personal keepsakes; and
- Non-commercial Athlete self-promotion.
The Customer may reasonably resize or crop delivered media for ordinary personal social-media use, provided that the media is not materially misrepresented or placed into an unlawful, misleading, exploitative, or inappropriate context.
Without written permission from Triple Deux, the Customer may not:
- Sell the media;
- Sublicense the media;
- Claim copyright ownership;
- Transfer usage rights to a business or organization;
- Use the media in paid advertising;
- Provide the media to a sponsor or brand for promotional use;
- Use the media to sell a product or service;
- Commercially resell an altered version;
- Remove a watermark from a proof or preview; or
- Permit commercial third-party publication.
Clubs, schools, sponsors, brands, businesses, Event operators, media outlets, and other organizations must obtain written permission from Triple Deux before using the media for promotional, sponsorship, advertising, NIL, commercial, or organizational purposes.
18. No Guaranteed Distribution, Exposure, or Recruiting Results
Triple Deux does not guarantee that an Athlete, family, team, club, or Customer will be featured by:
- AVP;
- An Event organizer;
- Triple Deux;
- A club;
- A school;
- A sponsor;
- A recruiting platform;
- A media outlet; or
- Any other third party.
Triple Deux does not guarantee:
- Social-media views;
- Likes;
- Shares;
- Comments;
- Followers;
- Reach;
- Viral performance;
- College-coach attention;
- Recruiter attention;
- Scholarship offers;
- Team placement;
- Sponsorship;
- NIL opportunities;
- Brand partnerships;
- Media coverage;
- College placement; or
- Athletic advancement.
The Customer is purchasing media production and delivery, not guaranteed publicity, placement, exposure, or recruiting results.
19. AVP, Event, and Third-Party Status
The Customer’s agreement is with Triple Deux.
Unless a particular relationship is separately confirmed and authorized in writing, purchasing Triple Deux coverage does not mean or guarantee that:
- Triple Deux is endorsed by AVP;
- Triple Deux is an official AVP partner;
- AVP is responsible for Triple Deux’s services;
- AVP will publish or promote the media;
- The Athlete will receive special access;
- Triple Deux controls the Event schedule;
- Triple Deux controls court assignments; or
- Triple Deux may override Event or venue rules.
Triple Deux’s ability to provide coverage remains subject to credentials, venue policies, tournament rules, safety restrictions, court-access limitations, and instructions from authorized Event personnel.
Triple Deux will not knowingly describe its relationship with AVP or the Event in a manner that materially misrepresents sponsorship, endorsement, authorization, or affiliation.
20. Club Affiliation and Customer-Supplied Materials
Where applicable, Triple Deux may include an Athlete’s club name or affiliation in delivered materials.
Use of a club name, logo, trademark, uniform, team name, music, graphic, photograph, or other third-party material may be limited by:
- Available permission;
- Event rules;
- Trademark or copyright restrictions;
- Quality of submitted assets;
- Production requirements; or
- Triple Deux’s editorial judgment.
Triple Deux does not guarantee that every club logo, name, affiliation, or Customer-supplied asset will appear in the final media.
The Customer represents that any logo, graphic, photograph, music, text, or other material submitted to Triple Deux may lawfully be used for the requested purpose.
21. Safety and Conduct
Triple Deux is committed to maintaining a safe, professional, and respectful media environment for Athletes, families, clubs, Event personnel, and spectators.
Customers, Athletes, parents, guardians, coaches, and associated persons agree to cooperate with reasonable:
- Production instructions;
- Scheduling procedures;
- Venue rules;
- Event rules;
- Safety restrictions; and
- Staff direction.
Triple Deux may refuse, pause, relocate, limit, or cancel coverage because of:
- Unsafe conduct;
- Threats;
- Harassment;
- Abusive behavior;
- Inappropriate behavior;
- Interference with Event operations;
- Interference with production;
- Conduct creating a safety concern involving a minor; or
- Repeated failure to follow reasonable instructions.
If Triple Deux ends coverage because of serious misconduct attributable to the Customer, Athlete, or an associated person, the Customer is not automatically entitled to a refund.
22. Payment, Pricing, and Reservation Status
Payment must be completed through an approved Triple Deux checkout or payment method before an order is secured.
An order is not fully confirmed until Triple Deux has received:
- Full payment;
- Required Customer information;
- Required Athlete information;
- Required consent; and
- Required scheduling information.
Prices may vary based on availability, order timing, onsite offers, promotions, team options, upgrades, or other package-specific factors.
Changes to pricing for later Customers do not change an existing Customer’s confirmed purchase.
Advertised prices include all mandatory fees imposed by Triple Deux.
Government-imposed taxes may be added where legally required.
Optional upgrades, add-ons, and separately selected services may be charged in addition to the advertised base price.
The Order Confirmation establishes the confirmed price, package, Athletes, coverage, and included deliverables.
23. Cancellations, Refunds, and Missed Coverage
All sales are final except as expressly stated in this section or required by law.
The order remains non-refundable when missed or reduced coverage results from the Customer or Athlete:
- Changing their mind;
- Choosing not to participate;
- Withdrawing from the Event;
- Missing the Confirmed Match;
- Arriving late;
- Becoming unavailable;
- Providing incorrect information;
- Failing to provide requested information;
- Failing to communicate a schedule or court change;
- Missing a scheduled production window;
- Changing partners without notice;
- Failing to follow reasonable scheduling instructions; or
- Engaging in conduct that causes coverage to end.
Injury, illness, elimination, forfeit, disqualification, partner withdrawal, or Athlete absence does not automatically create a right to a refund.
When production capacity allows, Triple Deux may offer another available match, a substitute session, a transferred reservation, or a service credit.
If circumstances outside either party’s reasonable control prevent all meaningful coverage from occurring, Triple Deux will offer a reasonable option, which may include:
- Coverage at another available match;
- A transferred reservation;
- A substitute session;
- A comparable service;
- A service credit; or
- A refund for the unperformed portion.
A materially different substitute requires Customer approval.
If Triple Deux fails to capture meaningful coverage or fails to deliver a confirmed deliverable solely because of Triple Deux’s production failure, Triple Deux will provide one of the following:
- Replacement coverage;
- A comparable substitute approved by the Customer;
- A proportional refund for the affected undelivered portion; or
- A full refund of the affected package if no meaningful portion can be fulfilled.
Triple Deux may not retain the entire payment when Triple Deux’s own production failure results in no meaningful coverage and no meaningful deliverables.
24. Force Majeure
Triple Deux will not be considered in breach for delay, interruption, reduced coverage, or inability to perform caused by circumstances beyond its reasonable control, including:
- Severe weather;
- Natural disaster;
- Fire;
- Venue closure;
- Event cancellation or suspension;
- Government action;
- Public-health emergency;
- Transportation disruption;
- Power or communications infrastructure outage;
- Safety threat;
- Credential revocation not caused by Triple Deux misconduct; or
- Other comparable external events.
Triple Deux will make reasonable efforts to communicate with affected Customers and provide an appropriate resolution under Section 23.
Ordinary staffing failures, avoidable scheduling mistakes, or preventable production failures by Triple Deux are not automatically treated as force majeure.
25. Official Communications
Scheduling information, match updates, package questions, delivery questions, complaints, and fulfillment requests must be sent through an official Triple Deux communication channel.
Official channels may include:
- An email address identified by Triple Deux;
- A phone or text number identified by Triple Deux;
- An official order or intake form;
- The order-confirmation system; or
- Another channel expressly designated by Triple Deux.
Triple Deux is not responsible for information or instructions provided through:
- Social-media comments;
- Unmonitored direct messages;
- Personal staff accounts;
- Verbal sideline conversations;
- Messages sent to the wrong address or number;
- Messages sent to a photographer while actively covering a match; or
- Incomplete or unclear communications.
Customers should retain their Order Confirmation, payment receipt, and written match confirmation.
26. Accuracy of Submitted Information
The Customer is responsible for submitting accurate and complete information.
Triple Deux is not responsible for missed coverage, delayed delivery, incorrect labeling, Athlete-identification errors, or fulfillment problems caused by inaccurate, incomplete, outdated, or late-submitted information.
The Customer must review the Order Confirmation and promptly report an error involving:
- Athlete name;
- Package selection;
- Number of Athletes;
- Partner name;
- Division;
- Contact information;
- Match information; or
- Deliverables.
27. Privacy and Athlete Information
Triple Deux order and Athlete-intake forms are intended to be completed by adults age 18 or older.
Minor Athletes should not personally submit payment information, guardian consent, or private contact information.
Information for an Athlete under 13 must be submitted by a parent or legal guardian.
Triple Deux may collect and use information reasonably necessary to:
- Process payment;
- Confirm consent;
- Identify the Athlete;
- Schedule coverage;
- Communicate with the Customer;
- Create and label deliverables;
- Deliver media;
- Maintain transaction and consent records;
- Meet legal, tax, or accounting obligations; and
- Resolve disputes.
Triple Deux may share necessary information with service providers used for payment processing, forms, file storage, gallery delivery, email or text communications, editing, customer support, or order fulfillment.
Triple Deux will not knowingly sell a minor Athlete’s personal contact information to advertisers.
A parent, legal guardian, or adult Athlete may request correction of inaccurate information or deletion of information no longer reasonably necessary, subject to Triple Deux’s right to retain payment, tax, contract, consent, copyright, business, and dispute records as permitted or required by law.
28. Third-Party Platforms
Triple Deux may use third-party services for:
- Payment;
- Forms;
- Scheduling;
- Communications;
- Galleries;
- Media hosting;
- File delivery;
- Cloud storage; and
- Other operational purposes.
Use of those services may be subject to the third party’s terms, privacy policies, account requirements, storage limits, compression, and technical restrictions.
Triple Deux is not responsible for third-party outages, platform changes, account restrictions, copyright filters, music removal, compression, expired links, download failures, or other technical conditions outside Triple Deux’s reasonable control.
This section does not excuse Triple Deux from making reasonable efforts to deliver confirmed media through another practical method when the selected platform fails.
29. Disclaimer
Triple Deux provides photography, video production, editing, media delivery, Athlete content, Event coverage, and storytelling services.
Triple Deux does not act as a:
- Recruiting agency;
- College-placement service;
- Scholarship service;
- Sports agent;
- NIL agency;
- Sponsorship agency;
- Talent agency; or
- Athletic-representation service through the purchase of an Event coverage package.
Triple Deux does not provide legal, recruiting, scholarship, sponsorship, or admissions advice through the purchased service.
30. Limitation of Liability
To the fullest extent permitted by law, Triple Deux’s total financial liability for an ordinary claim arising from or related to the purchased service, scheduling, coverage, editing, delivery, publication, non-publication, or this agreement will not exceed the amount paid for the affected package.
To the fullest extent permitted by law, Triple Deux will not be liable for indirect, incidental, consequential, special, punitive, emotional-distress, reputational, lost-opportunity, lost-scholarship, lost-recruiting, lost-sponsorship, or lost-business damages.
Nothing in this agreement excludes or limits liability for:
- Fraud;
- Willful misconduct;
- Gross negligence;
- Willful injury;
- Violation of law; or
- Any responsibility that cannot lawfully be excluded or limited.
Nothing in this agreement waives any nonwaivable right provided by applicable consumer-protection law.
31. Governing Law and Good-Faith Resolution
California law governs this agreement without regard to conflict-of-law principles.
Before beginning formal litigation, the Customer and Triple Deux agree to make a reasonable good-faith effort to resolve the dispute through written communication.
The written communication should identify:
- The issue;
- Relevant order information;
- Supporting documentation; and
- The requested resolution.
This informal-resolution process does not prevent either party from:
- Filing an eligible small-claims case;
- Seeking emergency or injunctive relief;
- Preserving a legal deadline; or
- Exercising a right that cannot lawfully be restricted.
Any legal proceeding must be brought in a court with lawful jurisdiction and venue.
32. Entire Agreement and Order of Control
These Terms of Agreement, the applicable Order Confirmation, and any later written amendment expressly agreed to by Triple Deux and the Customer constitute the entire agreement concerning the purchased service.
If there is a conflict:
- A later written amendment expressly agreed to by the Customer and Triple Deux controls;
- The Order Confirmation controls the specific package, price, Athletes, coverage, and deliverables;
- These Terms control general rights, responsibilities, and limitations; and
- General advertising and promotional language does not expand the confirmed order.
No employee, contractor, photographer, videographer, or representative may change this agreement through an informal verbal conversation unless the change is later confirmed in writing by an authorized Triple Deux representative.
33. Severability and No Waiver
If a court finds a provision unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.
A failure by Triple Deux or the Customer to enforce a provision on one occasion does not waive the right to enforce that provision later.
Section headings are used for organization and do not independently expand or limit the meaning of this agreement.
34. Electronic Acceptance
The Customer agrees to conduct this transaction electronically.
By checking the required agreement box and submitting the order, the Customer intends to provide an electronic signature and agrees that electronic acceptance has the same effect as a handwritten signature to the extent permitted by law.
Triple Deux may retain records showing:
- Agreement version;
- Date and time of acceptance;
- Purchaser name;
- Purchaser email;
- Order number;
- Athlete information;
- Consent status; and
- Other information reasonably necessary to document the transaction.
The Customer should be provided a reasonable opportunity to review, save, or print this agreement before submitting the order.
35. Agreement Acknowledgment
By accepting this agreement, the Purchaser confirms that:
- The Purchaser is at least 18 years old;
- The Purchaser has authority to place the order and provide the required consent;
- The Purchaser has obtained any consent required for every Athlete included in the order;
- The Order Confirmation controls the package, price, Athletes, coverage, and deliverables purchased;
- Package offerings may change for later Customers without changing the confirmed order;
- Unless otherwise stated, an individual package covers one named Athlete during one Confirmed Match;
- A team or partner package applies only to the named Athletes competing together during the same Confirmed Match;
- Submitting a preferred match does not confirm coverage;
- The Customer is responsible for accurate information and timely schedule and court updates;
- Additional matches and additional Athletes require a separate purchase unless confirmed otherwise in writing;
- Triple Deux selects the final media unless Customer selection is expressly included;
- Raw media, unused files, full-match recordings, project files, and revisions are not included unless stated in the Order Confirmation;
- Specific plays, points, moments, publication, exposure, recruiting results, and social-media performance are not guaranteed;
- Triple Deux retains copyright ownership of the media;
- The Customer receives only the limited personal-use license described in this agreement;
- Promotional use by Triple Deux is authorized as described in Section 2;
- The Customer understands the cancellation, refund, substitution, delivery, privacy, copyright, and limitation-of-liability provisions;
- The Customer has had an opportunity to review and retain this agreement; and
- The Customer has read, understood, and agreed to these Terms of Agreement.
