Participant understands that dance and other fitness and training programs (hereinafter referred to as "Dance") involve physical exertion, are strenuous, involve dynamic and sometimes sudden movement and interaction with other persons, particularly at advanced levels, and that strain or injuries may occur when participating in such activities. Dance could also expose you to the novel Coronavirus (COVID-19) by person-to-person contact through respiratory droplets, which is enhanced by physical activity, and heavy breathing.
Participant accepts and assumes the risks associated with engaging in Dance and related events at Hama's Dance Center (herein after the "Studio") including, but not limited to, strain, overexertion, injury or death. Participant hereby freely and expressly assumes all risk of property damage, injury, and death associated with his / her / their activities at the Studio.
Participant understands that it is his/her responsibility to consult with a physician prior to and regarding participation in Dance. Participant represents and warrants that he/she/they has no physical or mental condition that would prevent full participation in Dance and agrees to inform the instructor immediately of any physical or mental condition that could render their participation risky.
By signing below, I hereby waive, release, indemnify, and forever hold harmless the Studio, and any of its owners, staff, guest teachers and professional affiliates, participants, sponsors, officials, employees, agents, officers, volunteers, directors, and other individuals affiliated with the Studio (collectively, the "Released Parties") from all liabilities and claims for any injuries, illnesses, losses, death, damages, or costs (including reasonable attorneys' and experts' fees) to myself, my relatives and guests, which arise during or after my participation in classes and events at the Studio. Hama's Dance Center, its owner, staff, guest teachers and performers, and agents shall not be liable for any injuries or damages to any participant, or the property of any participant, or be subject to any claim, demand or injury, or damages whatsoever, including without limitations, those damages or injuries resulting from negligence on the part of the Studio or its owner, staff or other participants.
If signing on behalf of a minor Participant, Parent/Guardian accepts full responsibility for any medical expenses incurred due to the minor's participation in Dance and agrees to release, hold harmless, and indemnify (including costs and attorney's fees) Hama's Dance Center for any claims brought by or on behalf of the minor.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
