Reservations
A reservation provides the Buyer with an option to select from available offspring in accordance with the terms of this Agreement. A reservation does not guarantee that a kid will be born, survive, meet the Buyer’s preferences, or ultimately be available for purchase. No specific animal is sold or guaranteed until the Buyer has selected an available animal and the parties have completed the applicable purchase agreement.
Hilltop Haven Farmstead retains the unrestricted right to retain any kid, at any time, for breeding, show, herd improvement, evaluation, or any other farm purpose, regardless of the existence or priority of any reservation.
Doeling prices start at $400. Buckling prices start at $300, with wethers (neutered males) offered at a discount. The purchase price is not locked in until a specific animal has been born, evaluated, made available for sale, selected by the Buyer, and the applicable purchase agreement has been completed, unless Hilltop Haven Farmstead expressly agrees otherwise in writing.
If a reservation is rolled over to a future breeding season, it will be subject to the prices, terms, and availability applicable to that future breeding season.
Finalizing Your Purchase
Once a specific animal becomes available to the Buyer, the Buyer will be notified using the contact information provided by the Buyer. The balance of the purchase price must be paid in full within 10 calendar days of Hilltop Haven Farmstead’s notice, unless otherwise agreed in writing.
If the Buyer cancels, refuses, or fails to complete the purchase for any reason other than a reason expressly stated in this Agreement, the applicable deposit will be forfeited as liquidated damages and will not be refundable. Hilltop Haven Farmstead may immediately offer the animal to another buyer.
A deposit may be refunded, applied to another available goat, or rolled over to the next breeding season, at the Buyer’s election, if a reserved kid does not become available for purchase or if an animal becomes sick or injured while in Hilltop Haven Farmstead’s possession and, as a result, Hilltop Haven Farmstead determines that the animal will not be sold to the Buyer.
If an animal becomes temporarily sick or injured but remains available for purchase, Hilltop Haven Farmstead may, at its discretion, delay transfer until the animal is appropriate for release. The Buyer may then elect to proceed with the purchase, apply the deposit to another available goat, or roll the deposit over to the next breeding season.
Additional Information
Completing this Agreement is a step in the process of acquiring a Nigerian Dwarf goat from Hilltop Haven Farmstead. Placing a deposit for a kid from a planned breeding does not guarantee that the Buyer will receive a kid from that breeding or from any future breeding.
Hilltop Haven Farmstead reserves the right to refuse or cancel a sale or placement at any time before transfer of the animal, including when Hilltop Haven Farmstead determines, in its sole discretion, that the proposed placement is not in the best interest of the animal or the farm. If Hilltop Haven Farmstead cancels a sale for reasons unrelated to the Buyer’s breach of this Agreement, the Buyer’s deposit will be handled in accordance with the deposit provisions of this Agreement.
To the fullest extent permitted by law, Hilltop Haven Farmstead shall not be liable for indirect, incidental, special, consequential, or speculative damages arising from the purchase, ownership, breeding, health, performance, or future use of the animal. The Buyer’s remedies, if any, shall be limited to those expressly stated in this Agreement or otherwise required by applicable law.
Except for any rights that cannot legally be waived, the animal is sold “AS IS” and “WITH ALL FAULTS” upon transfer, without any express or implied warranty, including any implied warranty of merchantability or fitness for a particular purpose.
