Reservations
This Agreement applies to the purchase of the specific goat identified in this Agreement. The Buyer acknowledges that the animal has been identified and made available for purchase by Hilltop Haven Farmstead, subject to the terms and conditions of this Agreement.
The purchase price for the animal is the amount stated in this Agreement. Unless otherwise agreed in writing, a Purchase Deposit of 50% of the total purchase price is required to reserve the animal. The remaining balance must be paid in full before the animal is released to the Buyer or the Buyer’s designated transporter.
A Purchase Deposit does not transfer ownership of the animal to the Buyer. Title to and ownership of the animal will transfer only after the purchase price and any other amounts due under this Agreement, including applicable boarding fees, have been paid in full and the animal has been released to the Buyer or the Buyer’s designated transporter.
Finalizing Your Purchase
If the Buyer cancels, refuses, or fails to complete the purchase for any reason other than a reason expressly stated in this Agreement, the Purchase Deposit will be forfeited as liquidated damages and will not be refundable. Hilltop Haven Farmstead may immediately offer the animal to another buyer.
If the animal becomes sick or injured while in Hilltop Haven Farmstead’s possession and, as a result, Hilltop Haven Farmstead determines that the animal will not be sold to the Buyer, the Buyer may elect to have the Purchase Deposit refunded or applied to another available goat, unless otherwise agreed in writing.
If an animal becomes temporarily sick or injured but remains available for purchase, Hilltop Haven Farmstead may, at its discretion, delay transfer until the animal is appropriate for release. The Buyer may then elect to proceed with the purchase or, if agreed to by Hilltop Haven Farmstead, apply the Purchase Deposit to another available goat.
Hilltop Haven Farmstead reserves the right to refuse or cancel a sale or placement at any time before transfer of the animal, including when Hilltop Haven Farmstead determines, in its sole discretion, that the proposed placement is not in the best interest of the animal or the farm. If Hilltop Haven Farmstead cancels a sale for reasons unrelated to the Buyer’s breach of this Agreement, the Buyer’s Purchase Deposit will be handled in accordance with the deposit provisions of this Agreement.
Additional Information
Completing this Agreement is part of the process of acquiring a Nigerian Dwarf goat from Hilltop Haven Farmstead. The Buyer acknowledges that the animal(s) being purchased is the specific animal(s) identified in this Agreement.
Hilltop Haven Farmstead reserves the right to refuse or cancel a sale or placement at any time before transfer of the animal, including when Hilltop Haven Farmstead determines, in its sole discretion, that the proposed placement is not in the best interest of the animal or the farm. If Hilltop Haven Farmstead cancels a sale for reasons unrelated to the Buyer’s breach of this Agreement, the Buyer’s deposit will be handled in accordance with the deposit provisions of this Agreement.
To the fullest extent permitted by law, Hilltop Haven Farmstead shall not be liable for indirect, incidental, special, consequential, or speculative damages arising from the purchase, ownership, breeding, health, performance, or future use of the animal. The Buyer’s remedies, if any, shall be limited to those expressly stated in this Agreement or otherwise required by applicable law.
Except for any rights that cannot legally be waived, the animal is sold “AS IS” and “WITH ALL FAULTS” upon transfer, without any express or implied warranty, including any implied warranty of merchantability or fitness for a particular purpose.
