This agreement is between TCS Properties Inc., doing business as Central Huntington Garage, and the Customer identified above. Central Huntington Garage is owned and operated by TCS Properties Inc. and serves the building commonly known as the Hines Building. This agreement establishes the terms for monthly parking privileges at Central Huntington Garage. This agreement does not create a lease, tenancy, bailment, or storage agreement. It grants Customer a limited monthly parking privilege, subject to payment, availability, posted garage rules, and the terms below.

TCS Properties Inc. grants Customer permission to park one approved vehicle at Central Huntington Garage on a monthly basis. Monthly parking is generally assigned to a specific space, and Customer must park only in the assigned space unless TCS Properties Inc. gives written permission to temporarily use another space or area. If no space has been assigned yet, Customer may temporarily park in spaces 188 through 230 until an assigned space is confirmed.

Customer must provide accurate contact and vehicle information, including make, model, color, license plate number, state of registration, email, and phone number, and must promptly notify TCS Properties Inc. of any changes. Parking applies only to the approved vehicle unless otherwise approved in writing. Only properly registered, insured, and operable vehicles may be parked in the garage.

Monthly parking is billed in advance and, for new monthly parking tenants, is due on Customer's monthly anniversary date unless otherwise stated in writing. TCS Properties Inc. may send reminders before and after the due date, apply a late fee after 5 days, suspend or revoke parking privileges and deactivate access after 7 days, and after 10 days, the vehicle may be subject to immobilization, booting, towing, relocation, or removal, subject to applicable law and proper procedures. Customer remains responsible for all unpaid charges, late fees, access device fees, towing, storage, removal, and related costs.

The monthly parking rate is the amount listed in this agreement, invoice, or payment request. Any promotional rate, including the current $35.00 monthly rate if applicable, may be changed, discontinued, or adjusted in the future upon notice from TCS Properties Inc.

All new monthly parking tenants are required to pay a one-time $10.00 Digital Garage Key activation fee before access is activated or any digital key, garage door opener, key, access card, code, or other access device is issued. This fee is an activation/access device fee, not a refundable security deposit. Access devices remain the property of TCS Properties Inc. and may not be copied, shared, sold, transferred, or misused.

All cancellations must be communicated directly to TCS Properties Inc. Cancellation is effective only after TCS Properties Inc. receives notice and all assigned access devices are returned, if applicable. Customer remains responsible for all charges through the effective cancellation date.

Current garage hours are Monday through Saturday, 7:00 AM to 10:00 PM, unless otherwise posted or stated by TCS Properties Inc. The garage is closed on Sundays unless specifically authorized. Access outside normal garage hours is available only to approved Customers with an authorized access device. Customer must keep all access points secure, may not allow unauthorized persons to enter, and understands that garage hours, access points, access rules, payment procedures, and security procedures may change.

Customer must follow all posted signs, payment instructions, traffic markings, reserved areas, fire lanes, safety rules, and staff or management instructions. The garage speed limit is 10 mph, headlights must be used while driving, vehicles on ramps have the right of way, and Customer may not block ramps, drive lanes, entrances, exits, stairwells, elevators, doors, loading areas, reserved areas, or other vehicles. The garage elevator limit is 4 passengers.

Customer may use the garage only for ordinary parking of the approved vehicle. Customer may not use the garage for storage, repairs, mechanical work, washing, detailing, business operations, sleeping, loitering, dumping, personal property storage, or hazardous materials, and may not assign, sell, transfer, share, or sublease parking privileges without written approval from TCS Properties Inc.

Customer parks at Customer's own risk. TCS Properties Inc., its owners, managers, employees, and affiliates are not responsible for theft, vandalism, vehicle damage, weather-related damage, falling objects, mechanical issues, damage caused by others, or personal property left in any vehicle, except where liability cannot be waived by law. Customer is responsible for locking the vehicle and securing valuables.

TCS Properties Inc. may tow, boot, relocate, or remove any vehicle that is unauthorized, unpaid, improperly parked, blocking access, abandoned, unsafe, inoperable, uninsured, unregistered, or violating garage rules. Customer is responsible for all towing, storage, removal, ticketing, and related costs. TCS Properties Inc. may act immediately when a vehicle creates a safety, access, or operational concern.

Monthly parking payments are non-refundable and are not prorated once the monthly parking period begins, unless otherwise agreed in writing by TCS Properties Inc. Failure to use the parking privilege does not entitle Customer to a refund, credit, or prorated adjustment.

TCS Properties Inc. may suspend or terminate monthly parking privileges for nonpayment, expired parking, unauthorized parking, misuse of the garage, unsafe conduct, violation of garage rules, or operational reasons. Termination does not waive any unpaid balance.

By signing this agreement, Customer confirms that Customer has read, understands, and agrees to the terms of this Central Huntington Garage Agreement. This contract may be signed electronically or in hard copy. Electronic signatures count as originals for all purposes.
