APEX PEAK PERFORMANCE LLC
PARTICIPANT RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND MEDICAL AUTHORIZATION AGREEMENT
In consideration for being permitted to participate in classes, workshops, training sessions, pool workouts, breathwork, apnea training, mobility training, wellness activities, athletic conditioning, aquatic activities, and/or any related programs offered by APEX Peak Performance LLC (“APEX”), including activities led by Ricardo Urbina, Donna Norkeliunas, contractors, coaches, employees, representatives, volunteers, or affiliated instructors, I acknowledge and agree to the following:

 

1. AGREEMENT TO FOLLOW INSTRUCTIONS AND POLICIES
I agree to observe and comply with all posted rules, safety guidelines, verbal instructions, and directions provided by APEX Peak Performance LLC and its coaches, instructors, employees, representatives, contractors, or agents. I understand that failure to follow instructions may increase the risk of injury to myself or others.

I further acknowledge and agree to abide by APEX Peak Performance LLC scheduling and participation policies, including the 24-hour cancellation policy for classes, workshops, training sessions, and events. I understand that late cancellations or missed sessions may result in forfeited sessions, fees, or applicable charges based on current APEX policies.

2. ASSUMPTION OF RISK
I understand and acknowledge that participation in physical training, breathwork, aquatic exercise, apnea/freediving activities, pool workouts, mobility training, wellness programs, and related activities involves inherent risks, including but not limited to:

physical exertion
fatigue
slips, falls, or collisions
musculoskeletal injury
emotional stress
water-related risks
hypoxic or breath-hold related risks
serious injury, illness, disability, or death
I voluntarily assume full responsibility for all known and unknown risks associated with participation in APEX activities.

3. RELEASE AND WAIVER OF LIABILITY
I hereby release, waive, discharge, and hold harmless APEX Peak Performance LLC, Ricardo Urbina, Donna Norkeliunas, affiliated coaches, contractors, employees, volunteers, facilities, and partners from any and all claims, liabilities, demands, causes of action, damages, costs, or expenses arising out of or related to my participation in APEX activities, including those caused by negligence to the fullest extent permitted by law.

This release applies to any injury, loss, damage, illness, or death arising from participation in APEX programs or use of associated facilities and equipment.

4. INDEMNIFICATION
I agree to indemnify and hold harmless APEX Peak Performance LLC and its owners, instructors, employees, representatives, contractors, and affiliates from any claims, damages, costs, attorney’s fees, or liabilities arising from my participation or the participation of any minor for whom I am responsible.

5. MEDICAL ACKNOWLEDGMENT
I affirm that I am physically capable of participating in APEX activities and have disclosed any relevant medical conditions that may affect my participation.

I understand that APEX Peak Performance LLC does not provide medical advice and that I am responsible for consulting with a physician regarding participation if necessary.

6. MEDICAL AUTHORIZATION FOR MINORS
If signing on behalf of a minor participant, I authorize APEX Peak Performance LLC and its representatives to seek emergency medical treatment deemed necessary in the event of injury or illness during participation. I understand that I am financially responsible for any medical treatment provided.

7. DAMAGE TO PROPERTY
I agree to be financially responsible for any damage to facilities, equipment, or property caused by negligent, reckless, or intentional actions by myself or any participating minor for whom I am responsible.

8. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.

9. VOLUNTARY AGREEMENT
I acknowledge that I have carefully read and fully understand this Agreement. I understand that by signing this document, I am voluntarily waiving certain legal rights, including the right to bring legal action against APEX Peak Performance LLC and associated parties.

I acknowledge that I have had the opportunity to ask questions and seek legal counsel if desired.

10. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By signing this form, I have had the opportunity to ask questions and those were answered to my satisfaction. I understand all the terms, my rights, as well as my obligations herein. I voluntarily give my consent and I declare that I was not induced or coerced into signing this form.
