ASSUMPTION OF RISK, RELEASE OF LIABILITY, HOLD HARMLESS & INDEMNIFICATION
By signing below, I, the Renter, acknowledge that I am accepting possession and control of the margarita machine and all related equipment, accessories, cords, containers, and other items provided by Por Cafe FW during the rental period.
EQUIPMENT RESPONSIBILITY
I accept full responsibility for the proper possession, use, operation, supervision, security, and care of the rented equipment from the time it is delivered or received until it is returned to or recovered by Por Cafe FW.
I agree to operate the equipment only in accordance with instructions provided by Por Cafe FW and to prevent children, unauthorized persons, or any person who is unable to safely operate the equipment from doing so.
I accept financial responsibility for any loss, theft, disappearance, misuse, destruction, or damage to the equipment beyond ordinary wear and tear occurring during the rental period, regardless of who causes such loss or damage.
ASSUMPTION OF RISK
I understand and voluntarily assume all risks associated with the possession, setup, operation, use, and presence of the rented equipment, including, but not limited to, risks of spills, slips and falls, electrical hazards, improper setup or operation, property damage, personal injury, and injuries caused by guests or other third parties.
I am responsible for ensuring that the equipment is operated and maintained in a reasonably safe manner throughout the rental period.
RELEASE AND WAIVER OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I HEREBY RELEASE, WAIVE, AND DISCHARGE POR CAFE FW, ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, ACTIONS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO THE RENTAL, POSSESSION, USE, MISUSE, OPERATION, TRANSPORTATION, OR PRESENCE OF THE RENTED EQUIPMENT, INCLUDING CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, EVEN IF SUCH CLAIM IS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF POR CAFE FW OR ITS OWNERS, EMPLOYEES, AGENTS, OR REPRESENTATIVES, TO THE EXTENT SUCH RELEASE IS PERMITTED BY LAW.
HOLD HARMLESS AND INDEMNIFICATION
I AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS POR CAFE FW, ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, LAWSUITS, DAMAGES, LOSSES, LIABILITIES, JUDGMENTS, COSTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEY’S FEES, ARISING FROM OR RELATED TO THE RENTAL, POSSESSION, USE, MISUSE, OR OPERATION OF THE EQUIPMENT, THE RENTER’S EVENT OR ACTIVITIES, OR THE ACTIONS OR OMISSIONS OF THE RENTER, THE RENTER’S GUESTS, INVITEES, EMPLOYEES, CONTRACTORS, OR OTHER PERSONS GIVEN ACCESS TO THE EQUIPMENT.
ALCOHOLIC BEVERAGES
I understand that Por Cafe FW is providing rental equipment and is not responsible for controlling, supervising, monitoring, furnishing, or serving alcoholic beverages at my event unless expressly agreed otherwise in a separate written agreement.
If alcoholic beverages are placed in, dispensed from, or otherwise used in connection with the rented equipment, I accept sole responsibility for the purchase, possession, preparation, service, distribution, and consumption of those alcoholic beverages and for compliance with all applicable federal, state, and local laws.
I am solely responsible for determining the age and legal eligibility of persons consuming alcoholic beverages and for preventing unlawful service or consumption of alcohol.
I further accept responsibility for the conduct of my guests and invitees relating to alcohol consumption, including taking reasonable measures to prevent alcohol from being provided to persons when prohibited by law and to prevent persons who have consumed alcohol from engaging in unsafe or unlawful conduct.
POR CAFE FW DOES NOT ASSUME RESPONSIBILITY OR LIABILITY FOR THE CONSUMPTION OF ALCOHOL, INTOXICATION OF ANY PERSON, SERVICE OF ALCOHOL TO ANY PERSON, OR ANY INJURY, DEATH, PROPERTY DAMAGE, VEHICLE ACCIDENT, CRIMINAL ACT, OR OTHER LOSS ARISING FROM OR RELATED TO THE POSSESSION, SERVICE, OR CONSUMPTION OF ALCOHOL AT OR IN CONNECTION WITH THE RENTER’S EVENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
ACKNOWLEDGMENT
By signing below, I acknowledge that I have carefully read and understand this agreement. I understand that it contains a release and waiver of legal rights, assumption of risk, and an agreement to indemnify and hold Por Cafe FW harmless.
