Zilla On Demand Terms and Conditions
Welcome to Zilla On Demand (“Zilla,” “we,” “our,” or “us”), a product and service operated by NBZ Tech Corp.
These Terms and Conditions (“Terms”) govern your access to and use of the Zilla On Demand website, mobile application, and related services (collectively, the “Services”). By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.
1. Eligibility
You must be at least the age of majority in your province or territory of residence, or otherwise have the permission of a parent or legal guardian, to use our Services.
By using the Services, you represent and warrant that you have the legal authority to enter into these Terms.
2. User Accounts
To access certain features of the Services, you may be required to create an account.
You agree to:
Provide accurate, complete, and current information.
Keep your account information up to date.
Maintain the confidentiality of your login credentials.
Notify us immediately of any unauthorized use of your account.
You are responsible for all activity that occurs under your account.
3. Booking Services
Zilla On Demand provides a technology platform that connects customers with independent pet care professionals for in-home pet care services.
Submitting a booking request does not guarantee an appointment. All appointments are subject to provider availability and confirmation.
4. Payments
A valid payment method may be required to book services and must remain on file while using certain features of the Services.
All payments are securely processed through trusted third-party payment service providers. NBZ Tech Corp. and Zilla On Demand do not collect, store, or process your complete payment card information.
Depending on the service booked, your payment method may be subject to a pre-authorization, deposit, or full payment before an appointment is confirmed.
By booking a service, you authorize our trusted third-party payment service provider to process all applicable charges associated with your booking.
5. Pricing
Service prices are displayed before booking.
Prices may change at any time. Changes will not affect appointments that have already been confirmed unless otherwise stated.
Applicable taxes and fees will be disclosed before payment is completed.
6. Cancellation, Rescheduling, and No-Show Policy
Customers may cancel an appointment without penalty by providing at least 24 hours’ notice before the scheduled appointment time.
Appointments cancelled with less than 24 hours’ notice may be subject to a cancellation fee.
If a customer fails to attend a scheduled appointment, is unavailable at the scheduled service location, or otherwise prevents the appointment from being completed without prior notice, a no-show fee may be charged.
Customers may request to reschedule an appointment. Rescheduled appointments must be moved to a date that is within five (5) days before or five (5) days after the original appointment date, subject to availability.
Requests to reschedule outside of this permitted time frame may be treated as a cancellation and may result in a cancellation fee or no-show fee.
Zilla On Demand reserves the right to waive cancellation or no-show fees in exceptional circumstances at its sole discretion.
7. Customer Responsibilities
You agree to:
Provide accurate and complete information about yourself and your pet.
Inform the pet care professional of any known medical conditions, behavioural concerns, or safety risks.
Ensure your pet can be safely handled during the appointment.
Provide a safe environment for the pet care professional.
Ensure that someone authorized is present for the appointment if required.
Failure to provide accurate information or maintain a safe environment may result in the appointment being cancelled without a refund.
8. Independent Service Providers
Zilla On Demand is a technology platform operated by NBZ Tech Corp. that connects customers with independent pet care professionals.
Unless expressly stated otherwise, pet care professionals using the Zilla On Demand platform are independent contractors and are not employees, agents, or representatives of NBZ Tech Corp.
Each independent pet care professional is solely responsible for the services they provide, including the quality of their work, their conduct, compliance with applicable laws, any required licences or certifications, and maintaining any insurance required by law.
NBZ Tech Corp. does not supervise or control the manner in which independent pet care professionals perform their services and does not guarantee the quality, outcome, or suitability of any services provided.
9. Service Availability
Services may not be available in all locations.
We reserve the right to modify, suspend, discontinue, or limit any feature or service at any time without prior notice.
10. Acceptable Use
You agree not to:
Use the Services for any unlawful purpose.
Provide false or misleading information.
Attempt to interfere with the operation or security of the Services.
Upload malicious software or harmful code.
Harass, threaten, abuse, or discriminate against pet care professionals, employees, or other users.
Access another user’s account without authorization.
Violation of these Terms may result in suspension or permanent termination of your account.
11. Intellectual Property
All trademarks, logos, graphics, software, text, photographs, videos, designs, and other content associated with Zilla On Demand are owned by or licensed to NBZ Tech Corp.
You may not copy, reproduce, modify, distribute, sell, or otherwise use any content without our prior written consent.
12. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, NBZ Tech Corp. disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the fullest extent permitted by applicable law, NBZ Tech Corp., its directors, officers, employees, affiliates, licensors, and technology partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Services.
Because pet care professionals using the Zilla On Demand platform are independent contractors, NBZ Tech Corp. is not responsible for the acts, omissions, negligence, conduct, property damage, injuries, losses, disputes, delays, or other claims arising directly from services provided by an independent pet care professional.
Customers acknowledge that they are engaging the services of an independent pet care professional through the Zilla On Demand platform and understand that the professional providing the service is responsible for the performance of that service.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
14. Indemnification
You agree to indemnify and hold harmless NBZ Tech Corp., its affiliates, directors, officers, employees, contractors, licensors, and agents from any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising from:
Your use of the Services.
Your breach of these Terms.
Your violation of applicable laws.
Your infringement of another person’s rights.
15. Privacy
Your use of the Services is also governed by the Zilla On Demand Privacy Policy.
16. Changes to These Terms
We may revise these Terms from time to time.
Updated versions will be posted on our website and mobile application with a revised “Last Updated” date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.
Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
