Release of Liability
Acknowledgment of Risk
I understand that participation in the National Cowgirl Museum & Hall of Fame Expansion Grand Opening Parade ("Parade") involves inherent risks that cannot be eliminated regardless of the care taken by the National Cowgirl Museum & Hall of Fame ("The Cowgirl"), its officers, directors, employees, volunteers, sponsors, agents, partners, and affiliated organizations.
These risks include, but are not limited to, bodily injury, illness, death, damage to or loss of personal property, damage to vehicles, trailers, tack, equipment, and injury to or loss of animals, including horses, arising from participation in or attendance at the Parade before, during, or after the event.
I acknowledge that horses are unpredictable by nature and that participation in equine activities involves inherent risks, including those resulting from the behavior of horses, other animals, spectators, weather conditions, road conditions, traffic, equipment failure, and the actions or omissions of other participants.
Assumption of Risk
I voluntarily choose to participate in the Parade and knowingly assume all risks associated with my participation, including any risks related to:
- Riding, handling, transporting, or exhibiting horses or other animals;
- Operating or riding in any vehicle, wagon, carriage, trailer, or other conveyance;
- Walking, marching, or otherwise participating in the Parade;
- Loading, unloading, staging, and departing from Parade activities;
- Damage to my personal property, including horses, tack, trailers, vehicles, equipment, and other belongings.
Release and Waiver of Liability
In consideration of being permitted to participate in the Parade, I, on behalf of myself, my heirs, personal representatives, executors, administrators, successors, and assigns, hereby release, waive, discharge, and covenant not to sue the National Cowgirl Museum & Hall of Fame, its officers, directors, employees, volunteers, sponsors, event organizers, partners, contractors, agents, representatives, and affiliated organizations from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses of any kind arising out of or related to my participation in the Parade, including claims for personal injury, illness, death, property damage, or loss, whether caused by negligence or otherwise, to the fullest extent permitted by Texas law.
Indemnification
I agree to indemnify, defend, and hold harmless the National Cowgirl Museum & Hall of Fame and its officers, directors, employees, volunteers, sponsors, agents, contractors, and affiliated organizations (“Indemnified Parties”) from and against any claims, liabilities, damages, costs, expenses, or attorney’s fees arising out of my participation in the Parade or resulting from my actions, those of my guests, animals, vehicles, or equipment, even if caused by the concurrent negligence of any Indemnified Parties.
Compliance
I agree to comply with all Parade rules, instructions, and directives issued by Parade officials, event staff, volunteers, law enforcement personnel, and emergency responders. I understand that failure to comply may result in my immediate removal from the Parade without refund or compensation.
Medical Authorization
Should I become injured or require emergency medical treatment, I authorize emergency medical personnel to provide treatment deemed necessary. I understand that I am solely responsible for any medical expenses incurred.
Photo and Media Release
I grant permission to the National Cowgirl Museum & Hall of Fame to photograph, video record, or otherwise capture my likeness, my animals, vehicles, and property during the Parade for use in promotional, educational, archival, or other lawful purposes without compensation.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.
Severability
If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment
I HAVE CAREFULLY READ THIS RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT. I FULLY UNDERSTAND ITS TERMS AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.
