SHERCO UNITED STATESDEMONSTRATION RIDE WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT This is a legal document. Please read carefully before signing. RIDER CERTIFICATION I certify that: I am at least 18 years of age. I possess a current, valid driver's license or other Government issued ID. I have experience operating motorcycles of similar size and performance. I am physically and mentally capable of safely operating the motorcycle. I am not under the influence of alcohol, drugs, medication, or any substance that could impair my ability to ride safely. I understand that this demonstration ride is voluntary. ASSUMPTION OF RISK understand that operating a motorcycle is an inherently dangerous activity involving risks that include, but are not limited to: Serious bodily injury Permanent disability Death Property damage Collision with vehicles, objects, wildlife, or pedestrians. Mechanical failure. Negligence of myself or others. I knowingly and voluntarily assume all risks associated with participating in this demonstration ride. RELEASE OF LIABILITY: In consideration for being permitted to participate in this demonstration ride, I hereby release, waive, discharge, and covenant not to sue: Jordan Motorsports Distributing LLC d/b/a Sherco United States; The participating Sherco dealer; Their respective owners, officers, directors, members, employees, contractors, volunteers, representatives, successors, assigns, sponsors, and agents; (collectively referred to as the "Released Parties") from any and all liability, claims, demands, actions, causes of action, damages, losses, expenses, attorney fees, or judgments arising out of or related to my participation in this demonstration ride, including claims arising from ordinary negligence of the Released Parties, to the fullest extent permitted by applicable law. This release does not apply to gross negligence or willful misconduct where prohibited by law. PROPERTY DAMAGE: I agree to operate the motorcycle responsibly and in accordance with all laws and instructions provided. I understand that I may be financially responsible for damage caused to the motorcycle resulting from: reckless riding; negligent operation; intentional misuse; unlawful operation; or violation of dealership ride rules. The dealership and or Sherco US may pursue reimbursement to the extent permitted by law. RULES OF THE DEMONSTRATION RIDE: I agree that I will: Wear a DOT-approved helmet. Wear eye protection. Wear long pants. Wear riding boots. Follow all instructions from dealership and or Sherco US personnel. Follow the designated ride route. Obey all laws. Not carry passengers. Not allow another individual to operate the motorcycle. Return immediately if instructed by dealership or Sherco US personnel. Failure to comply may result in immediate termination of the ride. MEDICAL AUTHORIZATION: If I become injured or incapacitated, I authorize emergency medical treatment. I understand that all medical expenses are solely my responsibility. PHOTO AND VIDEO RELEASE: I grant Sherco United States, Jordan Motorsports Distributing LLC, and the participating dealership permission to photograph or record me during the event and to use my likeness for advertising, promotional, marketing, social media, and editorial purposes without compensation. INDEMNIFICATION: I agree to defend, indemnify, and hold harmless the Released Parties from any claims, liabilities, damages, costs, attorney fees, or expenses arising from: my operation of the motorcycle; my negligence; my violation of law; injury to others caused by my actions; or damage to property caused by my actions. ACKNOWLEDGEMENT: I acknowledge that: I have read this entire agreement. I fully understand its contents. I understand I am giving up substantial legal rights. I sign this agreement voluntarily and without coercion. No verbal statements or promises have altered this agreement.
