RISE & GLOW
PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND MEMBERSHIP AGREEMENT
1. PROGRAM DESCRIPTION
Rise & Glow provides early morning group fitness sessions at Oakbrook Neighborhood Park, Thousand Oaks. Sessions are conducted Tuesdays, Thursdays, and Fridays at 6:45am for 45 minutes, combining strength training, cardiovascular conditioning, and functional fitness.
2. HEALTH SCREENING & MEDICAL CLEARANCE
Client certifies that they have completed and submitted the Health Screening Form honestly and disclosed any health conditions, medications, or physical limitations that could be affected by exercise. Client understands that Rise & Glow is not a medical provider. Coaches are not medically trained to diagnose, treat, or monitor health conditions. Client is responsible for consulting their own doctor regarding their ability to participate safely in this fitness program. Client agrees to immediately notify Rise & Glow if any medical condition, injury, pregnancy, illness, medication, or physical limitation changes after submission of the Health Screening Form. Client agrees to exercise independent judgment regarding participation in each exercise and may stop any activity at any time if they experience pain, dizziness, shortness of breath, or other concerning symptoms.
3. ASSUMPTION OF RISK
Client knowingly and voluntarily assumes all known and unknown risks associated with participation in Rise & Glow. Client accepts the risks associated with outdoor exercise, public parks, exercise equipment, portable equipment, weather conditions, wildlife, insects, uneven surfaces, sidewalks, parking lots, and any conditions that may exist at the training location. Client certifies that they assume the risk of physical injury, whether minor or severe, resulting from participation in these activities, including those that may arise from the ordinary negligence of Rise & Glow.
4. RELEASE & WAIVER OF LIABILITY
Client agrees on behalf of themselves, their heirs, and anyone else claiming through them to release and waive Rise & Glow, its owners, managers, coaches, employees, contractors, volunteers, agents, affiliates, successors, and assigns from any and all claims, demands, or legal action arising from injury, illness, property loss, or death that may result from attending this program or using its facilities, equipment, and services—including claims arising from the ordinary negligence of those released parties, except where prohibited by law.
5. EMERGENCY MEDICAL AUTHORIZATION
Client authorizes Rise & Glow to obtain emergency medical assistance if deemed necessary by coaches or staff. Client understands that Rise & Glow has no duty to provide medical care and is responsible for all costs associated with emergency treatment or transportation. Client agrees to provide accurate emergency contact information and keep it current.
6. WEATHER & CANCELLATION POLICY
Rise & Glow reserves the right to cancel, relocate, or modify sessions because of weather, safety concerns, park closures, instructor illness, or other circumstances beyond its control. Participants will be notified of cancellations via email or text message. Cancelled sessions will not be refunded but may be rescheduled at the discretion of Rise & Glow.
7. PAYMENT TERMS
a. All sessions are purchased on a monthly subscription basis ($50/month for Month 1; $75/month for Month 2+).
b. Payment is non-refundable once the month begins.
c. Client may cancel at any time by providing written notice. Cancellation is effective the following month.
d. Missed sessions are considered used and are not refundable or transferable.
e. Membership automatically renews each month until cancelled in writing.
8. CONSENT TO PHYSICAL CONTACT
Client consents to appropriate physical contact from coaches (e.g., form correction, spotting) during workouts to ensure proper technique and safety.
9. PROMOTIONAL MATERIAL
A. Class Photography
Rise & Glow may photograph or record participants during classes for promotional and educational purposes. By signing below, Client opts in or out of this use:
☐ YES, I consent to being photographed/recorded during classes and agree that Rise & Glow may use these images for promotional, educational, and social media purposes.
☐ NO, I do not consent to being photographed/recorded during classes.
B. Participant-Submitted Content
If Client submits photos, videos, or other content to Rise & Glow, Client agrees that Rise & Glow has complete ownership and copyright of such materials and may use them for any promotional or educational purpose, including on the Internet. By signing below, Client opts in or out:

10. ENTIRE AGREEMENT
This document reflects the entire agreement between the parties and supersedes all prior written and oral representations. This agreement may not be amended except in writing signed by both Rise & Glow and Client.
11. SEVERABILITY
If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
12. GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
13. VENUE
Any legal action or proceeding arising out of this agreement shall be brought exclusively in the courts of Ventura County, California, unless otherwise required by law.
14. INDEMNIFICATION
Client agrees to indemnify and hold harmless Rise & Glow and all parties listed in Section 4 from any claims, damages, or costs (including attorneys' fees) brought by third parties arising out of Client's participation, conduct, or breach of this agreement.
15. ACKNOWLEDGMENT
By signing below, Client acknowledges having read and understood this waiver and agreement. Client certifies that they knowingly and voluntarily assume all responsibility for their participation and are not holding Rise & Glow or its coaches liable for any physical injury, illness, or property loss that results from participation in these activities. Client is satisfied with the terms and conditions contained in this agreement.
