Acknowledgement of Risk and Waiver of Liability
In consideration of being permitted to drive an electric vehicle on September 12, 2026 at the Dorey Park Farmers Market, located at 2999 Darbytown Road, Henrico, VA 23231, as a part of the River City EV Expo event (hereafter referred to as "the Event"), I do hereby release, waive and discharge the Dorey Park Farmers Market and its board of advisers, Henrico County, Henrico County Recreation & Parks, Drive Electric RVA, Electric Vehicle Association, Virginia Clean Cities, ION Solar, Dominion Energy, and the owner of the vehicle (hereafter referred to as "the Event Producers"), their representatives, officers, employees, agents, advisors, and members from any and all actions, damages, claims or demand which I, my heirs, personal representatives, executors, administrators or assigns may have against any and all of the aforementioned for any and all personal injuries, accidents, or illnesses (including death), known or unknown, which I have or may incur by participation in the Event and for all damages and loss to my property.
I realize that I am responsible for any injuries to persons or property which may be incurred in connection with driving or riding an electric vehicle during the Event. I also agree to indemnify and hold harmless the Event Producers, their representatives, officers, employees, agents, advisors, and members from any and all costs, damages, liabilities and losses that they may incur due to my driving for travel and participation in the Event. I understand that my driving for travel for participation in the Event is voluntary and that the Event carries with it certain dangers and risks, including but not limited to: overexertion, poor judgment, emotional strain, slipping, falling, tripping, equipment failure, vehicle failure, injury, death, etc. which could ultimately result in injury, permanent disability, or death.
I assume all responsibility related to complying with all applicable motor vehicle laws, including but not limited to: those concerning vehicle safety, vehicle operation, insurance, and the transportation and consumption of alcoholic beverages, etc. I further acknowledge that I have a medical insurance policy and that such insurance will be my primary source of payment should medical treatment be necessary as a result in my participation in the Event.
An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and guests with underlying medical conditions are especially vulnerable. By participating in the Event, you voluntarily assume all risks related to exposure to COVID-19.
I further expressly agree that the foregoing acknowledgment of risk and waiver of liability is intended to be as broad and inclusive as is permitted by the law of the Commonwealth of Virginia and that if any portion is held invalid, it is agreed that the balance, notwithstanding, continue in full legal force and effect.
I, the undersigned, am at least 18 years of age. I have read this Acknowledgement of Risk and Waiver of Liability and fully understand its terms. I acknowledge that I am signing this waiver freely and voluntarily will fill knowledge of its significance.
