Welcome to MK Banners and Signs! By placing an order, approving a design draft/sketch, or purchasing any products or services from us, you (“Customer”) agree to be bound by the following Terms and Conditions. Please read them carefully:
1. Design Sketches, Layouts & Approval
Design Review:
Prior to painting, a digital or drawn design sketch will be provided to show layout, lettering style, color palette, and general composition.
Final Approval: Written or electronic approval of the design sketch is required before prep or painting begins.
Handmade Variations:
Hand-painted signs are individual works of custom craftsmanship. Subtle variations in brushwork, texture, paint blending, and natural material grain (such as glass or paper) are inherent to hand-painted art and are not considered defects.
Customer Responsibility:
Once a layout sketch is approved, MK Banner and Signs is not responsible for errors in spelling, grammar, phone numbers, or dates that were present on the approved design. Any repainting or rework resulting from an approved layout containing errors will be billed at standard hourly rates plus material costs.
2. Colors & Paint Finishes
Color Matching:
We mix custom paints by hand. While we match colors as closely as possible to your desired reference, exact 100% digital-to-paint color matches (such as RGB or screen displays) are not guaranteed.
Finish & Curing:
Paint finishes (matte, satin, gloss, or distressed) and drying/curing times vary based on materials and weather conditions.
3. Payment Terms & Deposits
Non-Refundable Deposit:
A non-refundable deposit of at least 50% is required before design sketches, material preparation, or painting begins.
Final Balance:
The remaining balance is due prior to product pickup or delivery.
Late Payments:
Unpaid balances after the agreed due date may incur a late fee of 1.5% per month until paid in full.
4. Turnaround Times & Weather Delays
Crafting Schedule:
Estimated completion dates begin only after the design layout is approved and the deposit is received. Hand-painted work requires adequate drying and curing time between coats.
Weather & Environmental Delays:
For outdoor painting projects or signs requiring specific climate conditions to cure, completion dates may be adjusted due to rain, extreme temperatures, high humidity, or high winds.
5. Cancellations & Material Costs
Custom Artwork:
Because every sign is custom-designed and painted by hand, orders cannot be canceled or refunded once painting or material preparation has commenced.
Deposit Retention:
Deposits cover initial administrative costs, custom sketch creation, and raw materials purchased for your project and are non-refundable.
6. Inspection, Maintenance & Outdoor Durability
Inspection Period:
Customer must inspect the finished sign upon delivery or pickup and notify MK Banners and Signs in writing of any structural damage or concerns within 3 business days.
Weathering & Care:
Hand-painted signs—especially those placed outdoors—will naturally weather over time due to sun exposure (UV), rain, and environmental factors. Proper care and maintenance instructions will be provided upon request. MK Banners and Signs is not liable for normal paint wear, fading, or wood weathering over time due to harsh environmental exposure after installation.
7. Intellectual Property & Original Artwork
Customer Logos:
Customer warrants that they hold rights to all logos, trademarks, and text supplied to us for hand-painting. Customer agrees to indemnify MK Banners and Signs against any trademark or copyright claims.
Artist Ownership:
Original artistic hand-lettering concepts, sketches, and custom artwork created by MK Banners and Signs remain our intellectual property.
Portfolio Rights:
We reserve the right to photograph finished work and share images in our online portfolio, social media, and promotional materials unless explicitly requested otherwise in writing prior to starting the project.
8. Limitation of Liability
To the maximum extent permitted by applicable law, MK Banners and Signs shall not be liable for any indirect, incidental, or consequential damages. Our maximum liability for any claim shall not exceed the total amount paid by the Customer for the specific order.
9.Indemnification
I agree to indemnify and hold harmless The Darling Board Co. from any claims, including attorney fees, brought by myself or any third party arising from the consumption or handling of the products provided.
10.Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina.
