INTAKE, INFORMED CONSENT, LIABILITY WAIVER, RELEASE,

ASSUMPTION OF RISK, ARBITRATION, AND ELECTRONIC SIGNATURE AGREEMENT

This Intake, Informed Consent, Liability Waiver, Release, Assumption of Risk, Arbitration, and Electronic Signature Agreement ("Agreement") is entered into between ("Participant") and Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/ TimeBridge HypnoReiki/ TimeBridge Collective Studio, including its owners, officers, directors, instructors, contractors, employees, volunteers, agents, successors, and affiliates.

2. DESCRIPTION OF ACTIVITIES
Participant understands that Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/ TimeBridge HypnoReiki/ TimeBridge Collective Studio provides wellness, movement, mindfulness, and educational services, which may include, without limitation:

- yoga classes,
- stretching,
- guided meditation,
- breathwork,
- sound baths,
- sound therapy,
- vibrational sound experiences,
- mindfulness instruction,
- movement instruction,
- energy movement,
- workshops,
- use of yoga props and equipment,
- in-person services,
- livestream classes,
- recorded content,
- red light therapy (lights and mat),
- amethyst mat,
- retreats,
- wellness events,
- and related activities (collectively, the "Activities").
Participant understands that the Activities are not medical care, psychotherapy, physical therapy, chiropractic care, or licensed healthcare treatment.
Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/ TimeBridge HypnoReiki/ TimeBridge Collective Studio does not diagnose, treat, cure, or prevent any disease, mental health condition, or medical condition.
3. HEALTH ACKNOWLEDGMENTS AND INFORMED CONSENT
Participant acknowledges and understands that participation in the Activities may involve physical exertion, emotional responses, sensory stimulation, and inherent risks.
Participant represents that Participant is physically and mentally capable of participating safely.
Participant understands that certain Activities may not be appropriate for individuals with certain conditions, including but not limited to:
- epilepsy or seizure disorders,
- sound sensitivity,
- tinnitus,
- vertigo,
- migraines,
- PTSD or trauma-related conditions,
- anxiety or panic disorders,
- cardiovascular conditions,
- respiratory conditions,
- pregnancy,
- recent surgery,
- musculoskeletal injuries,
- mental health conditions,
- hearing disorders,

- or other medical concerns.
Participant agrees to consult with a physician or other qualified healthcare provider before participating if Participant has any medical or psychological concerns.
Participant agrees to immediately stop participation and notify the instructor if Participant experiences pain, dizziness, emotional distress, shortness of breath, faintness, discomfort, or any other concerning symptoms.
Participant voluntarily chooses to participate with full knowledge of the potential risks.
4. ASSUMPTION OF RISK
Participant knowingly and voluntarily assumes all risks associated with participation in the Activities, whether known or unknown, foreseeable or unforeseeable, including but not limited to:
- physical injury,
- muscle strains,
- falls,
- aggravation of preexisting conditions,
- emotional distress,
- anxiety responses,
- sensory overstimulation,
- hearing discomfort,
- illness,
- allergic reactions,
- property damage,
- disability,
- and death.
Participant acknowledges that injuries may result from:
- Participant's own actions,
- actions of others,
- use of equipment,
- premises conditions,
- instruction or adjustment by instructors,
- or the inherent nature of the Activities.

5. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by California law, Participant hereby releases, waives, discharges, and covenants not to sue Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/Indu Invocations/TimeBridge HypnoReiki/TimeBridge Collective Studio from and for any and all claims, demands, causes of action, damages, liabilities, losses, costs, or expenses arising out of or relating to participation in the Activities,

including claims arising from the ordinary negligence of Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/TimeBridge HypnoReiki/ TimeBridge Collective Studio.
This release applies to:
- personal injury,
- emotional distress,
- property damage,
- economic loss,
- wrongful death,
- and any other claims of any nature.
Participant understands that this Agreement is intended to be broad and inclusive as permitted under California law.
This Agreement does NOT release claims for gross negligence, reckless conduct, or intentional misconduct to the extent such claims cannot legally be waived under California law.
6. MEDICAL AUTHORIZATION
You certify that you are physically able to participate. In the event of illness or injury, you authorize Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/TimeBridge HypnoReiki/ TimeBridge Collective Studio or volunteers to obtain emergency medical treatment on your behalf if necessary, and you agree to be responsible for any associated costs.

7. CALIFORNIA CIVIL CODE SECTION 1542 WAIVER
Participant expressly waives the protections of California Civil Code Section 1542, which states:
"A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."
Participant understands and agrees that this waiver is an essential and material term of this Agreement.
8. AGREEMENT TO ARBITRATE
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to this Agreement, the Activities, Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/ TimeBridge HypnoReiki/TimeBridge Collective Studio services, Participant's attendance at Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed

Yoga/ Indu Invocations/TimeBridge HypnoReiki/TimeBridge Collective Studio, or any alleged injury or damage shall be resolved exclusively through binding arbitration in the State of California under the Federal Arbitration Act and California arbitration law.
The arbitration shall be administered by JAMS or another mutually agreed arbitration provider.
Participant and Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/TimeBridge HypnoReiki/TimeBridge Collective Studio waive the right to:
- file a lawsuit in court,
- have claims decided by a jury,
- or participate in a class action or representative proceeding.
All claims must be brought solely in the parties' individual capacities.
The arbitrator shall have authority to determine enforceability of this Agreement except where prohibited by law.
Venue for arbitration shall be the county in California where the Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/TimeBridge HypnoReiki/ TimeBridge Collective Studio is principally located unless otherwise agreed.
The prevailing party may recover reasonable attorneys' fees and costs if authorized by law or contract.
If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain enforceable to the fullest extent permitted by law.

9. PHOTO AND MEDIA RELEASE
Participant grants Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/ TimeBridge HypnoReiki/TimeBridge Collective Studio permission to photograph, video record, or otherwise capture Participant's likeness during Activities and to use such materials for lawful promotional, educational, social media, website, and marketing purposes without compensation.
Participants may revoke this consent in writing prospectively.

10. RECORDING PROHIBITION NOTICE
By participating in this session, you acknowledge no audio recording, video recording, photography, livestreaming, screen recording, or other form of capture of any music, meditation, sound healing, energy work, session, workshop, or related content is permitted without the express prior written consent of the facilitator(s). Any unauthorized recording, reproduction, distribution, publication, or use of such content is strictly prohibited and may constitute a violation of applicable copyright and intellectual property laws.

We may, at our sole discretion, offer professionally produced recordings and/or sound bites of select music, meditations, or sessions for personal use and/or purchase. Availability varies by event, and all recordings remain the exclusive intellectual property of the facilitator(s). Unauthorized copying, sharing, or distribution is prohibited.

11. RULES AND PARTICIPANT RESPONSIBILITIES
Participant agrees to:
- follow instructor directions,
- use equipment safely,
- disclose relevant limitations when appropriate,
- refrain from participating while impaired,
- maintain respectful conduct,
- and comply with Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/ TimeBridge HypnoReiki/ TimeBridge Collective Studio policies.
Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/ Indu Invocations/TimeBridge HypnoReiki/ TimeBridge Collective Studio reserves the right to deny or terminate participation for safety or policy reasons.
12. ELECTRONIC SIGNATURE CONSENT
Participant agrees that:
- this Agreement may be executed electronically,
- electronic signatures shall have the same force and effect as original signatures,
- checking boxes, clicking "I Agree," digital signatures, typed names, online booking confirmations, and electronic acknowledgments constitute valid signatures,
- and electronic records may be retained and relied upon by Spirit Songs Sound Alchemy/ Sunkissed and Moonkissed Yoga/Indu Invocations/TimeBridge HypnoReiki/TimeBridge Collective Studio.
Participants consent to conducting transactions electronically pursuant to the California Uniform Electronic Transactions Act (California Civil Code §1633.1 et seq.) and the federal E-SIGN Act.
Participant agrees that electronic copies of this Agreement shall be admissible to the same extent as original paper records.
13. SEVERABILITY
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. GOVERNING LAW
This Agreement shall be governed by and construed under the laws of the State of California.
15. ACKNOWLEDGMENT OF UNDERSTANDING
Participant acknowledges that Participant:
- has carefully read this Agreement,
- understands its contents,
- understands that Participant is waiving substantial legal rights,
- understands the arbitration provision and class action waiver,
- understands this is a legally binding agreement,
- and signs voluntarily and knowingly.
Participant further acknowledges that no oral representations, statements, or inducements contrary to this Agreement have been made.
