Please read these Terms & Conditions in full before registering.
By registering for the Nataraj Kutir, LLC (“Nataraj Kutir”) retreat at Casa Sangam, Italy (the “Retreat”), the person registering (“Participant”, “Participants”, “they”) confirms that they have read, understood and agreed to these Nataraj Kutir Retreat Terms & Conditions (“Terms”). These Terms form part of the agreement between the Participant and Nataraj Kutir in relation to the Participant’s participation in the Retreat.
If the Participant does not agree to these Terms, they should not register for or participate in the Retreat.
1. Retreat Dates and Duration
The Retreat begins on 21 May 2027 and ends on 27 May 2027 and comprises 6 nights.
Unless separately confirmed in writing by Nataraj Kutir, the Retreat fee applies only to the official Retreat dates.
Accommodation before 21 May 2027 or after 27 May 2027 is not included. Participants arriving earlier or remaining later are responsible for all additional accommodation, meals, transportation, insurance and other expenses.
2. Registration and Acceptance
Registration is subject to availability and is not complete until:
- the registration form has been submitted;
- the required deposit has been paid; and
- Nataraj Kutir has accepted the registration.
Payment of the deposit constitutes acceptance of these Terms. A place is not secured merely by expressing an intention to attend, submitting an enquiry, or partially completing a registration.
Nataraj Kutir reserves the right to refuse a registration where the Retreat has reached capacity; requested accommodation is unavailable; the Participant does not meet applicable venue requirements; the Participant is reasonably believed to be unable or unwilling to comply with these Terms or venue rules; or acceptance would create a reasonable concern regarding safety, wellbeing or the Retreat experience. All such determinations are made by Nataraj Kutir in its sole and absolute discretion.
If Nataraj Kutir refuses a registration after payment has been made, the amount paid will be refunded, unless the refusal results from materially inaccurate or misleading information supplied by the Participant.
3. Retreat Fee
Unless expressly stated otherwise, the Retreat fee contributes towards:
- 6 nights of accommodation at Casa Sangam;
- 3 meals per day during the Retreat, with the exception of 21 May (dinner only) and 27 May (breakfast and lunch only);
- necessary Retreat administration and operational costs; and
- the applicable Dakshina (teacher offering) included within the Participant’s selected pricing tier.
Airport and other transit to and from Casa Sangam are not included in the Retreat fee. Participants are responsible for arranging and paying for their own travel to and from the venue.
The Retreat fee does not constitute payment for any particular spiritual, therapeutic, personal, emotional or other outcome.
4. Pricing
Nataraj Kutir offers these retreats on an approximately at-cost basis in order to reduce financial barriers for sincere seekers. Registration is offered on a sliding scale based on the level of voluntary additional teacher offering (Dakshina) the Participant wishes to provide.

At the Standard and Benefactor Tiers, room upgrades are available on a first come, first served basis for an additional fee.
Nataraj Kutir does not represent that a higher pricing tier provides preferential spiritual, teaching or personal treatment.
5. Registration Windows and Key Dates
- Early Bird Registration Window: 15 August - 31 October 2026
- Standard Registration Window: 1 November 2026 - 31 January 2027
- Final payment balance due: 1 March 2027
- Retreat begins: 21 May 2027
- Retreat ends: 27 May 2027
Early Bird pricing applies only to registrations completed during the Early Bird Registration Window and is subject to availability. Regular pricing applies during the Standard Registration Window. Registrations after 31 January 2027 are subject to availability and to the pricing displayed or otherwise confirmed by Nataraj Kutir at the time of registration. Nataraj Kutir may close registration early if the Retreat reaches capacity.
6. Deposit and Payment
A $400 deposit is required at registration to secure a place. The deposit is non-refundable, non-transferable and not exchangeable for credit toward another Retreat or other event held by Nataraj Kutir.
The remaining balance must be paid in full no later than 1 March 2027. Registrations made after 1 March 2027 must be paid in full at the time of registration.
A Participant who has not paid the required balance by the applicable deadline does not have a guaranteed place. Nataraj Kutir may release an unpaid place to another Participant after providing reasonable notice. The Participant remains responsible for ensuring that payment is successfully completed by the deadline.
7. Transaction and Payment Processing Fees
Where a refund is due under these Terms, Nataraj Kutir may deduct payment processing charges, credit-card transaction fees and other transaction fees actually incurred and not otherwise recoverable.
8. Accommodation
The Retreat prices are based on accommodation in a quadruple or triple room with a shared bathroom, subject to availability. Accommodation is provided at Casa Sangam and is subject to the facilities, configuration and rules of the venue. Room photographs, descriptions or examples do not guarantee a particular room, bed, view, building or configuration.
9. Room Upgrades

Room upgrades are available on a first come, first served basis. An upgrade request does not guarantee availability. An upgrade is confirmed only when Nataraj Kutir has accepted the request and, where applicable, the additional fee has been paid.
10. Room Assignments and Room-Sharing
Participants should state accommodation preferences and requested roommate arrangements on the registration form. Nataraj Kutir will make reasonable efforts to accommodate preferences but does not guarantee a particular room, roommate, bed or building unless specifically confirmed in writing.
Shared rooms will generally be allocated according to gender, subject to venue policies and any individual arrangements agreed in advance. Participants wishing to share with a specific friend should both identify the same sharing preference on their registration forms.
Single rooms are limited and allocated on a first come, first served basis. Participants concerned about room-sharing, sleeping arrangements or noise should consider booking a single room where available. Nataraj Kutir will make reasonable efforts to resolve significant accommodation issues but cannot guarantee that an alternative room or roommate will be available.
11. Policy for Couples
Casa Sangam is a spiritual centre and couples are not permitted to share a bedroom in the Casa Sangam Farmhouse. Alternative accommodation may be available in the Retino Stone House and Retino Wood House, where couples may be permitted to share a room, subject to availability and the applicable accommodation arrangement.
Couples wishing to share a room must clearly state this preference on their registration forms. A request to share as a couple is not guaranteed unless the relevant accommodation has been confirmed by Nataraj Kutir.
12. Commuter Tickets
A Commuter option is also available for those wishing to attend the event but stay elsewhere. The price for this option is $950. Commuter tickets are non-residential. Anyone purchasing a commuter ticket for an in-person retreat or event must arrange their own accommodation and transportation to attend the retreat during the day.
Nataraj Kutir cannot refund deposits or balances or be held responsible if an attendee fails to secure appropriate accommodation nearby and suitable transportation to and from an event. Therefore, Participants are strongly advised to arrange accommodation and research transportation options before purchasing a commuter ticket.
Anyone who books a commuter ticket (non-residential) is not permitted to stay overnight on the venue grounds, whether in a vehicle or camping. Additionally, staying overnight onsite at the venue in any communal space or bedroom is not allowed.
13. Scholarships
A limited number of partial scholarships may be available to Participants registering at the Basic Tier. Scholarships are subject to availability, available scholarship funds, the number of applications received and Nataraj Kutir’s assessment of the circumstances presented.
A scholarship is not guaranteed and applies only to the amount expressly confirmed by Nataraj Kutir. It does not automatically include room upgrades, travel costs, insurance, additional accommodation or personal expenses. Nataraj Kutir may request information reasonably necessary to assess a scholarship request.
14. Cancellation by the Participant
Cancellation must be communicated to Nataraj Kutir in writing. The following policy applies:

All refunds are subject to deduction of applicable transaction and credit-card processing fees.
The cancellation policy applies regardless of the reason for cancellation, including illness, injury, family emergency, work commitments, visa problems, inability to travel, airline disruption or other personal circumstances, except where otherwise expressly required by applicable law.
15. Transfer of a Booking
A Retreat booking may not be transferred to another person without Nataraj Kutir’s prior written approval. Any proposed substitute Participant must satisfy all registration requirements, complete the required registration information, agree to these Terms and be accepted by Nataraj Kutir.
Nataraj Kutir is not required to approve a transfer. An approved transfer does not entitle the original Participant to a refund unless expressly agreed. Reasonable administrative or payment processing costs associated with an approved transfer may be charged.
16. Travel, Visas and Transportation
Participants are solely responsible for arranging and paying for travel to and from Italy and to and from Casa Sangam. The Retreat fee does not include international or domestic flights, airport transfers, trains, buses, taxis or other transportation, visas, passport costs, travel documentation, accommodation outside the official Retreat dates, personal travel expenses, or expenses arising from delayed, cancelled or missed transportation.
Any travel information supplied by Nataraj Kutir is provided as a convenience only and does not guarantee the availability, suitability, reliability, price or performance of any third-party travel provider. Participants should independently verify all travel arrangements.
17. Travel Insurance
Comprehensive international travel insurance is strongly recommended for the entire period of travel and Retreat participation. Participants are specifically encouraged to obtain Cancel For Any Reason (CFAR) coverage where available and appropriate.
Where possible, insurance should cover cancellation and interruption, medical expenses, emergency evacuation and repatriation, lost or delayed baggage, travel delays, missed connections, additional accommodation arising from disruption and other non-refundable travel expenses. Nataraj Kutir does not provide travel insurance and is not responsible for losses that could have been insured against.
18. Force Majeure
Nataraj Kutir is not responsible for failure, delay, interruption or cancellation of the Retreat to the extent caused by circumstances beyond its reasonable control (“Force Majeure”).
- extreme or dangerous weather and natural disasters;
- earthquakes, floods or fires;
- epidemics, pandemics or serious disease outbreaks;
- war, threat of war, terrorism or civil unrest;
- strikes or industrial action;
- airline, airport or other transportation disruption;
- government restrictions or orders, border closures, or visa and immigration restrictions;
- power or infrastructure failures;
- closure or unavailability of the venue;
- acts or omissions of third-party service providers; and
- other circumstances that could not reasonably have been prevented or overcome by Nataraj Kutir.
Where a Force Majeure event occurs, Nataraj Kutir may alter, postpone, relocate, shorten, suspend or cancel the Retreat where reasonably necessary and will communicate material changes as soon as reasonably practicable.
Nataraj Kutir is not responsible for Participants’ flights, travel arrangements, additional accommodation, insurance costs, lost income or other consequential or incidental expenses arising from a Force Majeure event.
19. Cancellation by Nataraj Kutir
Nataraj Kutir reserves the right to cancel the Retreat for reasons other than Force Majeure, including operational reasons or circumstances that make the Retreat impractical or unviable to conduct, including insufficient attendee registration.
If Nataraj Kutir cancels the Retreat for a reason other than Force Majeure, 100% of all payments received from Participants, including deposits, will be refunded.
The refund will be the Participant’s sole and exclusive financial remedy for the cancellation. Nataraj Kutir is not responsible for flights, visas, travel insurance, independently booked accommodation, airport transfers, other transportation, lost income, personal expenses or other direct, indirect or consequential costs incurred in connection with attending the Retreat. Nataraj Kutir can accept no further liability for Retreat cancellations beyond the Retreat refund.
20. Changes to the Retreat Programme
Nataraj Kutir reserves the right to make reasonable changes to the Retreat programme where necessary for operational, logistical, safety, venue, weather or other practical reasons. Changes may include the timetable, activities, teachers or facilitators, session locations, accommodation arrangements, meal arrangements or other programme details.
Nataraj Kutir will make reasonable efforts to preserve the overall nature and purpose of the Retreat. A change to the programme does not give rise to a right to a refund or any adjustment to pricing.
21. Venue Rules
Participants must comply with all reasonable rules, policies and instructions of Casa Sangam and any other facility used as part of the Retreat, including requirements relating to alcohol, food, smoking, recreational drugs, noise, accommodation, communal areas, animals, fire safety, environmental protection and health and safety.
Where venue rules are stricter than these Terms, the venue rules apply while the Participant is on the venue premises. A serious or repeated breach may result in the Participant being required to leave the Retreat.
22. Code of Conduct
The Retreat is intended to provide a peaceful, respectful and safe environment for spiritual practice and communal living. Participants are expected to treat others and the environment with respect, care and integrity; respect personal boundaries and privacy; follow reasonable instructions; and avoid conduct that materially disrupts the Retreat.
Prohibited conduct includes harassment, intimidation, threatening behaviour, violence or threats of violence, theft, intentional property damage, discriminatory or abusive behaviour, sexual harassment or unwanted sexual conduct, unlawful activity, recreational drug use, excessive or inappropriate alcohol use, and unauthorised solicitation or commercial activity.
23. No Solicitation or Commercial Activity
Participants may not use the Retreat to solicit clients, promote paid services, advertise products, conduct direct sales, distribute promotional material, recruit Participants into commercial ventures or otherwise use the Retreat primarily for personal commercial promotion.
Natural conversations about Participants’ work or services are not prohibited. If Nataraj Kutir reasonably considers conduct to constitute inappropriate or uninvited solicitation, the Participant may be instructed to stop. Failure to comply may result in removal from the Retreat.
24. Participant Social Media and Content Sharing
Participants should not photograph, film, record or otherwise capture images, video or audio of other Participants, teachers, facilitators or staff, or of Retreat sessions, activities or content, without first obtaining the express consent of each individual depicted or recorded. Participants acknowledge that other Participants may have requested that their image, voice or likeness not be captured or shared, and that Nataraj Kutir is not responsible for identifying or communicating individual privacy preferences to other Participants.
To the extent permitted by applicable law, the Participant agrees to indemnify, defend and hold harmless Nataraj Kutir, its owners, members, managers, officers, employees, teachers, facilitators, volunteers, agents and contractors from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from or relating to the Participant’s capture, use, posting, publication or distribution of photographs, video, audio or other content depicting other Participants, teachers, facilitators, staff or any other individual, including any claims for invasion of privacy, misappropriation of likeness, defamation or violation of any individual’s rights.
Images and recordings are captured by participants are for their own personal use and enjoyment and are not to be disseminated in any manner (whether by sharing to devices or posting on the internet in any form). Participants may share content depicting only themselves and general, non-identifying descriptions of their own Retreat experience. A breach of this section may result in the Participant being required to remove the offending content immediately and may constitute grounds for removal from the Retreat without refund.
25. Refusal of Participation or Removal
Nataraj Kutir may, in its sole and absolute discretion, refuse admission to, suspend or remove a Participant where, Nataraj Kutir determines that the Participant presents a risk to themselves or another person; significantly disrupts the Retreat; is unable to comply with Retreat or venue rules; engages in abusive, threatening, discriminatory, inappropriate or unlawful conduct; breaches these Terms; or materially interferes with another Participant’s ability to participate. Nataraj Kutir’s determination on any such matter shall be final and binding.
Where reasonably practicable, the Participant may first be given an opportunity to correct the relevant behaviour. Where immediate action is necessary for safety or wellbeing, the Participant may be required to leave without prior warning.
Except where required by applicable law or expressly determined otherwise by Nataraj Kutir, removal arising from the Participant’s conduct does not entitle the Participant to a refund. The Participant is responsible for their own transportation, accommodation and other costs arising from removal.
26. Health, Medical and Psychological Wellbeing
Participation in the Retreat is entirely voluntary. Participants are solely responsible for determining whether the Retreat is suitable for their physical, medical and psychological circumstances. By registering for the Retreat, each Participant represents and warrants that they are in good physical and mental health and have no condition that would prevent their safe participation or create an unreasonable risk to themselves or others. Nataraj Kutir does not warrant that the Retreat is appropriate for any particular Participant or purpose.
The Retreat may involve meditation, silence, introspection, emotional exploration, physical activity, communal living, changes in routine and other experiences that may be personally challenging. Participants with a pre-existing medical or psychological condition, or concerns about safe participation, are encouraged to consult an appropriately qualified medical or mental-health professional before attending.
Nataraj Kutir and its teachers, facilitators and volunteers are not acting as the Participant’s doctors, therapists, psychologists or other healthcare professionals and do not provide medical, psychiatric, psychological or therapeutic services. The Retreat is not a substitute for medical treatment, psychotherapy, psychiatric care or other professional healthcare. Nothing experienced or discussed during the Retreat should be understood as medical advice, diagnosis or treatment.
27. Medication and Medical Information
Participants are responsible for bringing and safely managing any medication they require and should carry sufficient medication and essential medical supplies for the entire period of travel and Retreat.
Participants agree to inform Nataraj Kutir in advance of any material medical condition, allergy, dietary requirement or other circumstance that the organisers reasonably need to know in order to support safe participation. Failure to accurately and timely disclose such information may result in the Participant’s removal from the Retreat without refund. Nataraj Kutir does not guarantee that all medical, dietary or accessibility requirements can be accommodated. Participants are responsible for all medical expenses incurred during or in connection with the Retreat.
Participants acknowledge that Nataraj Kutir is not responsible for prescribing, dispensing or managing any medication. Participants agree not to discontinue, alter, or reduce prescribed medication on the basis of anything experienced or discussed during the Retreat without obtaining appropriate professional medical advice.
28. Emergency Medical Assistance
If an emergency occurs and a Participant is unable to provide instructions, the Participant authorises Nataraj Kutir staff or appropriate emergency personnel to seek or facilitate reasonable emergency medical assistance, including contacting emergency services, arranging transportation to a medical facility or providing relevant information to emergency personnel where reasonably necessary.
The Participant remains responsible for all resulting medical, transportation, hospital, evacuation and related expenses.
29. Physical Activities and Assumption of Risk
Some Retreat activities may involve physical movement or other activities that carry inherent risks, including yoga, swimming, movement, walking, hiking, outdoor activities, meditation practices and communal activities. Participation is voluntary and Participants are responsible for respecting their own physical limitations.
By participating, the Participant acknowledges and voluntarily assumes inherent risks including physical injury, illness, allergic reactions, falls, weather-related incidents, fatigue, interactions with animals or wildlife, drowning, equipment or facility failure, and acts or omissions of third parties, emotional or psychological distress, and the unpredictable nature of spiritual or contemplative practices. Participants should not undertake an activity they reasonably believe is beyond their physical capacity or presents an unacceptable risk to their health.
30. Personal Property
Participants are responsible for their own belongings. Nataraj Kutir is not responsible for loss, theft, damage or disappearance of personal property, except to the extent liability cannot lawfully be excluded. Participants should take reasonable precautions to secure valuables, documents, medication and electronic equipment.
31. Third-Party Services
Accommodation, transportation, medical services and other services may be provided by third parties. Nataraj Kutir does not control the acts or omissions of independent third-party providers and is not responsible for their acts, omissions, delays, cancellations, failures or negligence except to the extent required by applicable law.
Participants should raise concerns regarding third-party services with the relevant provider and notify Nataraj Kutir where assistance is reasonably required.
32. Photography, Video and Recording
Nataraj Kutir may photograph, film or record portions of the Retreat for documentation, educational or promotional purposes. The filming, recording or photography of such events may be viewed on our website and possibly shared on social media platforms. In such circumstances all reasonable steps will be taken to preserve participants’ anonymity, but this cannot be guaranteed.
In booking to attend such an event Participants are deemed to consent automatically to their image, whether still, video and/or recorded, being broadcast online.
If the Participant does not wish to be photographed, filmed or recorded for promotional purposes, Participant should notify Nataraj Kutir in writing before the Retreat begins and, where practical, identify themself to the relevant organiser or photographer during the Retreat. Nataraj Kutir will make reasonable efforts to respect such requests but cannot guarantee that a Participant will never appear incidentally in group footage or photographs.
33. Privacy and Personal Information
Participants may be required to provide personal information necessary for registration, accommodation allocation, dietary arrangements, emergency planning, communication and administration of the Retreat. Nataraj Kutir will use such information for legitimate Retreat-related purposes and take reasonable steps to protect it.
Where necessary, information may be shared with the venue, accommodation providers, payment processors, emergency services or other service providers to the extent reasonably required to administer the Retreat or protect health and safety.
34. Accessibility and Special Requirements
Nataraj Kutir aims to make the Retreat as inclusive and accessible as reasonably possible. Participants should communicate accessibility requirements, mobility needs, dietary requirements or other relevant needs at the time of registration or as soon as they become known.
Advance notice is important because the venue may have physical, logistical or accommodation limitations. Nataraj Kutir will make reasonable efforts to accommodate notified requirements but does not guarantee that every request can be met.
35. Children and Age Requirements
The Retreat is intended for adults. Participants under 18 may not attend unless Nataraj Kutir and Casa Sangam have expressly approved their attendance in advance and applicable parent or guardian requirements have been satisfied, including the signing of a waiver and release of liability form. No Participant should arrive with a child or other accompanying person unless that person’s attendance has been expressly approved in advance.
36. Pets and Animals
Participants may not bring pets or other animals to the Retreat unless Casa Sangam and Nataraj Kutir have expressly approved this in advance. Service animals will be considered in accordance with applicable law and venue requirements. Participants intending to attend with a service animal should notify Nataraj Kutir at the time of registration.
37. Family, Friends and Unregistered Guests
Only registered Participants may attend Retreat sessions or use Retreat accommodation allocated to the Retreat group. Friends, family members or other guests may not accompany a Participant or stay at the Retreat venue unless expressly authorised by Nataraj Kutir and the venue. A Participant may not transfer their accommodation or allow an unregistered person to occupy their bed or room.
38. Limitation of Liability
To the maximum extent permitted by applicable law, Nataraj Kutir, its owners, members, managers, officers, employees, teachers, facilitators, volunteers, agents and contractors will not be liable for indirect, incidental, special, consequential, punitive, or economic losses arising from participation in the Retreat, including but not limited to loss of income, loss of opportunity, additional travel or accommodation expenses, or any claims arising from the acts or omissions of third parties or any other damages however arising.
Nataraj Kutir is not responsible for injury, illness, loss or damage arising from risks inherent in Retreat participation, Participant’s own acts or omissions, Participant’s failure to follow instructions, acts or omissions of third parties, or circumstances outside Nataraj Kutir’s reasonable control, except to the extent liability cannot lawfully be excluded.
Nothing in these Terms excludes or limits liability for death or personal injury caused by gross negligence or willful misconduct where such exclusion is unlawful; fraud or fraudulent misrepresentation; or any other liability that cannot legally be excluded or limited. Nothing in these Terms affects mandatory rights or protections available under applicable law.
To the extent permitted by applicable law, the aggregate liability of Nataraj Kutir for any and all claims arising from or relating to the Retreat or these Terms will not exceed the total amount actually paid by the Participant for the Retreat.
38A. Release and Waiver
As a condition of participation in the Retreat, each Participant is required to execute the Nataraj Kutir Participant Acknowledgement, Assumption of Risk & Liability Waiver (the “Waiver”). The Waiver contains a release of claims, covenant not to sue, assumption of risk and other provisions that supplement and are in addition to the limitations of liability set forth in these Terms. The release, waiver and assumption of risk provisions of the Waiver are incorporated into these Terms by reference and will govern any conflict with these Terms regarding such matters.
39. Participant Indemnity
To the extent permitted by applicable law, thea Participant agrees to indemnify, defend and hold harmless Nataraj Kutir, its owners, members, managers, officers, employees, teachers, facilitators, volunteers, agents and contractors from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from or relating to (a) the Participant’s acts or omissions during the Retreat; (b) the Participant’s breach of these Terms or the terms of the Waiver; (c) the Participant’s violation of any applicable law; (d) any misrepresentation made by or on behalf of the Participant in connection with these Terms, the Waiver, or the Participant’s registration; or (e) any injury or damage caused by the Participant to another Participant, third party or property, breach of venue rules, false or misleading information provided by the Participant, or actions that cause a third party to make a claim against Nataraj Kutir.
This provision does not apply to the extent that the relevant loss was caused by Nataraj Kutir’s own gross negligence, willful misconduct, fraud, or other liability that cannot legally be excluded.
40. No Guarantee of Personal or Spiritual Outcome
The Retreat is offered as an opportunity for spiritual practice, contemplation, teaching and communal experience. Nataraj Kutir expressly disclaims any guarantee, representation or warranty regarding any particular spiritual experience, emotional outcome, personal transformation, health outcome, psychological outcome, relationship outcome or other result. Participants are solely responsible for their own choices, participation, interpretation and application of the Retreat experience. No statement by Nataraj Kutir or any teacher, facilitator or volunteer constitutes a guarantee of any outcome.
41. Complaints and Concerns During the Retreat
Participants are encouraged to raise significant concerns with a member of the Nataraj Kutir organising team as soon as reasonably possible. Where a concern relates to accommodation, meals, venue facilities or another service provided by a third party, Nataraj Kutir will make reasonable efforts to assist in communicating the concern to the relevant provider. Prompt notification gives the organisers the best opportunity to address an issue during the Retreat.
42. Changes to These Terms
Nataraj Kutir may make reasonable amendments to these Terms where necessary to reflect changes in law, venue requirements, operational requirements or other material circumstances. Where an amendment materially affects Participants’ contractual rights or financial obligations, Nataraj Kutir will communicate the change as soon as reasonably practicable.
The Terms in force at the time of registration will generally apply, subject to subsequent changes required by applicable law or reasonably necessary for health, safety or venue compliance.
43. Entire Agreement
These Terms, together with the Nataraj Kutir Participant Acknowledgement, Assumption of Risk & Liability Waiver (the “Waiver”) and any written terms expressly incorporated into the Retreat booking, constitute the agreement between the Participant and Nataraj Kutir concerning participation in the Retreat. They supersede prior verbal or written statements concerning the same subject matter to the extent of any inconsistency.
If Nataraj Kutir makes a specific written agreement with a Participant that expressly varies these Terms, that written agreement will prevail only to the extent of the specific variation. No amendment or modification of these Terms shall be binding unless in writing and signed by an authorized representative of Nataraj Kutir.
44. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be modified or removed only to the extent necessary. The remaining provisions will continue in full force and effect to the extent permitted by law.
45. No Waiver
If Nataraj Kutir does not immediately enforce a provision of these Terms, this does not constitute a waiver of its right to enforce that provision later. Any waiver must be expressly made in writing.
46. Governing Law and Jurisdiction
These Terms and any dispute or claim arising from or relating to these Terms, the Retreat or the Participant’s participation in the Retreat (including non-contractual disputes or claims) will be governed by and construed in accordance with the laws of the State of North Carolina, United States of America, without regard to its conflict of laws principles. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply.
The Participant expressly waives any right to invoke or seek the application of the laws of Italy, any other country, or any jurisdiction other than the State of North Carolina and the laws of the United States in connection with any dispute or claim arising from or relating to these Terms or the Retreat. The Participant acknowledges that, notwithstanding the location of the Retreat venue in Italy, this agreement is made between the Participant and a North Carolina limited liability company and is intended to be governed exclusively by North Carolina law.
Any litigation arising from or relating to these Terms or the Retreat will be brought exclusively in the state or federal courts located in the State of North Carolina, and the Participant irrevocably submits to the exclusive jurisdiction of such courts and waives any objection based on inconvenient forum, lack of personal jurisdiction or any similar ground. The Participant agrees that service of process may be made by any means permitted under North Carolina law or by certified mail to the address provided at registration.
Nothing in this section limits the enforceability of the arbitration provision set forth below. Where arbitration applies, the arbitration will be seated in the State of North Carolina, conducted in accordance with North Carolina law, and any court proceedings ancillary to arbitration (including proceedings to compel arbitration, confirm an award or seek interim relief) will be brought exclusively in North Carolina courts.
Except where prohibited by applicable law, any dispute arising from or relating to these Terms or the Retreat will be resolved through binding arbitration administered by a mutually agreed-upon arbitration service in accordance with its then-current rules. The arbitration will be conducted in the English language and the arbitrator’s decision will be final and binding. Each party will bear its own costs and attorneys’ fees unless the arbitrator determines otherwise. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
To the extent permitted by applicable law, any claim or cause of action arising from or relating to the Retreat or these Terms must be filed within one (1) year after the claim or cause of action arose. Failure to file within this period will result in the claim being waived.
To the extent permitted by applicable law, the Participant waives any right to participate in a class action, collective action, or representative proceeding against Nataraj Kutir. Any dispute will be resolved on an individual basis only.
47. Binding Effect
These Terms shall be binding upon the Participant and their heirs, executors, administrators, personal representatives and assigns. The Participant agrees that in the event of the Participant’s death or incapacity, no claim shall be brought against Nataraj Kutir, its owners, members, managers, officers, employees, teachers, facilitators, volunteers, agents or contractors by the Participant’s estate, heirs or personal representatives except as expressly permitted under these Terms and the Waiver.
48. Acknowledgement and Acceptance
The Participant confirms they have read, understood and agreed to the Nataraj Kutir Sangha Retreat Terms & Conditions. For online registration, acceptance of these Terms may be recorded electronically through the registration and payment process. By completing registration and paying the required deposit, the Participant confirms that:
- they have read these Terms;
- they understand the cancellation and refund policy;
- they understand that the $400 deposit is non-refundable and non-transferable;
- they understand that travel to and from Casa Sangam is not included;
- they understand the accommodation, room-allocation and commuter ticket policies;
- they understand that travel insurance is strongly recommended, including CFAR coverage where available;
- they understand that the Retreat may involve physical, emotional and contemplative practices;
- they accept responsibility for determining whether the Retreat is appropriate for them;
- they agree to comply with Casa Sangam’s rules and the instructions of Nataraj Kutir;
- they accept these Terms as a condition of participation; and
- they understand that participation may be refused or terminated where these Terms or applicable venue requirements are breached.
