Coronado Tennis Center / Impact Activities — Junior Pickleball League
Waiver, Release of Liability, Assumption of Risk & Parental Consent
In consideration of my child/ward (the "Participant") being permitted to participate in the Junior Pickleball League and related activities (the "Activity") operated by Impact Activities and held at facilities owned by the City of Coronado, I, the undersigned parent or legal guardian, agree to the following on behalf of myself, the Participant, and our respective heirs, executors, and assigns:
1. Assumption of Risk. I understand that pickleball and related athletic activities involve inherent risks of injury, including but not limited to slips, falls, collisions with other players or equipment, contact with balls or paddles, muscle and joint injuries, heat-related illness, and, in rare cases, serious injury or death. I acknowledge these risks cannot be eliminated and voluntarily assume all such risks, whether known or unknown, on behalf of myself and the Participant.
2. Release and Waiver. To the fullest extent permitted by California law, I hereby release, waive, and discharge Impact Activities, the City of Coronado, and their respective officers, employees, coaches, instructors, independent contractors, volunteers, and agents (collectively, the "Released Parties") from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury to the Participant or their property that may occur in connection with the Activity, whether caused by the ordinary negligence of the Released Parties or otherwise. I understand this release does not apply to gross negligence or willful or reckless misconduct.
3. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from any claims, losses, liabilities, or expenses (including reasonable attorneys' fees) brought by or on behalf of the Participant, or by any third party, arising out of the Participant's involvement in the Activity, except to the extent caused by the Released Parties' gross negligence or willful misconduct.
4. Medical Authorization. I certify that the Participant is physically fit to participate. In the event of injury or illness, I authorize the Released Parties to secure first aid and, if I cannot be reached, to arrange emergency medical treatment at my expense. I am responsible for disclosing any relevant medical conditions, allergies, or medications below or to program staff.
5. Photo/Media Release. I grant the Released Parties permission to use photographs, video, or likeness of the Participant taken during the Activity for promotional, marketing, or social media purposes, without compensation. (If you do NOT consent, indicate below or notify program staff in writing.)
6. Governing Law & Severability. This agreement is governed by the laws of the State of California. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
7. Acknowledgment. I have read this Waiver and Release of Liability, fully understand its terms, understand that I am giving up substantial rights by signing it, and sign it freely and voluntarily on behalf of myself and the Participant.
