  •  Rider Waiver

    1. Parties covered by this waiver
    In this waiver:

    “Organisers” means:

    All Good Productions ;
    She’ll Be Right ;
    The Uninvited ; and
    any other entity identified as an event owner or promoter before the Event.

    2. Voluntary participation and acknowledgement of risk
    I understand that participating in a competitive snowboarding event is physically demanding and inherently hazardous.

    The Event may involve training, course inspection, practice, warm-ups, competition, demonstrations, riding or walking within alpine terrain, use of lifts and surface tows, and movement around event infrastructure.

    I understand that the risks include, without limitation:

    falls, crashes and loss of control;
    collisions with other riders, people, vehicles, equipment or structures;
    rails, boxes, jumps, walls, drop-offs and other constructed or natural terrain features;
    hard, icy, uneven, changing or inadequately covered snow surfaces;
    rocks, vegetation, holes and hidden or exposed obstacles;
    changing weather, wind, temperature, snowfall, visibility and light conditions;
    avalanche, ice fall and other alpine hazards;
    equipment malfunction or failure;
    course, lift, vehicle, machinery, electrical, cabling and production hazards;
    fatigue, dehydration, cold exposure and altitude-related effects;
    delayed access to medical treatment or evacuation; and
    the acts, omissions or errors of other participants or people involved in the Event.
    These risks may result in property damage, financial loss, serious injury, permanent disability or death. I understand that risks may arise even when reasonable precautions are taken and that no snowboarding course or alpine event can be made completely risk-free. I have had the opportunity to consider these risks and voluntarily choose to participate.

    3. Fitness, experience and medical disclosure
    I confirm that:

    I have the skill, experience and physical ability reasonably required to participate;
    I am medically and physically fit to participate safely;
    I am not aware of any condition, injury, medication or other circumstance that would make my participation unsafe;
    the medical and emergency information supplied in my registration is complete and accurate; and
    I will promptly tell the Event’s medical or safety team if my health, medication, injury status or ability to participate changes.
    I understand that I am responsible for deciding whether I am capable of attempting a feature, run or manoeuvre. I may withdraw from an activity if I do not believe I can participate safely.

    4. Rules, instructions and equipment
    I agree to:

    • attend any required rider briefings;
    • comply with Event rules, venue rules, signage and reasonable safety instructions;
    • follow directions given by Event officials, course staff, ski patrol and medical personnel;
    • wear a properly fitted helmet ;
    • not participate while affected by alcohol, recreational drugs or any substance that may impair my ability;
    • behave responsibly and avoid unnecessarily endangering myself or anyone else; and
    • immediately report any accident, injury, unsafe condition or damaged feature.
    • The Organisers may delay, modify, suspend or cancel an activity, or refuse or end my participation, where they reasonably consider this necessary for safety, operational or conduct reasons.

    5. Emergency medical treatment

    If I am injured or become unwell and I cannot provide instructions, I authorise the Organisers, venue personnel, ski patrol and medical providers to arrange and provide first aid, medical assessment, ambulance transport, evacuation and other treatment reasonably considered necessary.

    I authorise relevant medical information to be shared with medical, safety and emergency personnel where reasonably necessary for my care or Event safety.

    I understand that the Organisers cannot guarantee the availability, timing or outcome of medical treatment. I accept responsibility for medical, ambulance, evacuation, repatriation and related expenses to the extent those expenses are not covered by ACC, insurance or another provider.

    6. Assumption of risk and release

    I voluntarily accept the inherent and reasonably foreseeable risks associated with participating in the Event.

    To the fullest extent permitted by New Zealand law, I release and waive claims against the Released Parties for loss, damage, cost or liability arising from my participation in the Event, including property damage, economic loss and personal injury not covered by ACC.

    This release applies to loss caused or contributed to by an inherent risk of the activity or an act or omission of a Released Party, including ordinary negligence, but only to the extent such liability may legally be excluded or limited.

    Nothing in this waiver:

    excludes or limits a right or liability that cannot lawfully be excluded or limited;
    excludes or transfers any duty under the Health and Safety at Work Act 2015;
    limits any rights I may have under the Consumer Guarantees Act 1993 or other applicable legislation where those rights cannot legally be excluded; or
    excludes liability for fraud, deliberate wrongdoing or reckless misconduct.

    7. Responsibility for participant-caused loss

    I accept responsibility for loss, injury or damage caused by my negligent, reckless, deliberately wrongful or unlawful conduct, or by my material breach of this waiver or the Event rules.

    To the extent permitted by law, I will indemnify the Released Parties against reasonable third-party claims, losses and expenses arising from that conduct. This indemnity does not apply to the extent that the loss was caused by the negligence, breach or unlawful conduct of a Released Party.
