Empire Winds Inc. Rental Contract

I hereby agree in the event of default on any rental payment due, Empire Winds Inc. may take possession of their rental instrument where ever the same may be found without notice to me, the renter, and without liability to me, the renter, and without prejudice to any legal remedies of Empire Winds Inc., and further, in the event Empire Winds Inc. turns the matter of collection of the amount owed hereunder and/or repossession of the instrument over to an attorney or collection agency, that Empire Winds Inc. shall be entitled to its reasonable attorney fees, court costs, and thirty-five percent collection fee. Empire Winds Inc owns and retains title to the instrument. If you declare bankruptcy, the instrument must be returned to Empire Winds Inc immediately. Also, in such case, I authorize Empire Winds Inc to charge any past due fees and late charges to my credit card or checkings account. I will be responsible for returning the instrument to Empire Winds Inc. I have read both pages of this agreement and agree to all terms and conditions.

No instrument will be delivered without complete information including responsible party’s signature and paid rental fee. RENTAL FEE NOT REFUNDABLE

Terms & Conditions
How the Rental Plan Works:
1. You may rent as long as you wish. The instrument may be returned at any time, outstanding charges paid and the rental agreement will be terminated. Title of ownership remains with Empire Winds Inc. during the rental period.
2. You are responsible for an instrument until it is returned to our place of business. Do not leave the instrument at the school for return without notifying Empire Winds Inc. or its designated agent, without receiving proper authorization.
3. Rental fees will be charged up to the date of the instrument being returned.
4. Rent is pre-paid in 4 month periods, and is non-refundable and non-proratable. Any rental payment 30 days past due will be subject to a $5 late fee per month. Any rental account that is 30 or more days past due may be subject to instrument pickup and/or collections process. All checks returned as non-sufficient funds will be charged a $30.00 fee.
5. No Rental or Theft/Fire fees will be prorated or refunded.
6. At no charge Empire Winds Inc. supplies a free initial supply of accessories including, but not limited to, reeds, oil, cork grease, cleaning swab, and neck strap with your rental.
7. Damage to instruments not exceeding normal wear and tear will be repaired by Empire Winds Inc. at no charge to you. Any damage resulting from obvious mistreatment will be your responsibility. Any missing parts or pieces that were included with the instrument, including, but not limited to, mouthpiece, ligature, neck strap, drumsticks, practice pads, mallets and/or bell or snare stands will be your responsibility.
Purchase Option: Credit can be used to purchase any new instrument at the full retail value of the instrument being purchased. A thirty percent discount will be applied to the remaining balance after credit. Credit used in this way cannot be combined with other discounts and sales. Empire Winds Inc. reserves the right to increase or decrease the amount of credit based on the instrument being purchased.
Exchange Option: Customer may choose to exchange to a different/lesser expensive instrument. Up to 12 months payments will be applied assuming account is current.
Theft + Fire Coverage (T/F) For this coverage charge, Empire Winds Inc. will assume liability of protecting the rental customer against loss from theft/fire of the rented instrument under the following conditions: 1. Loss through theft, total destruction by fire or accident, Provided the account is current, the instrument will be replaced with an instrument of equal quality, age and condition, as determined by Empire Winds Inc. Theft must be reported to the proper law enforcement authorities within 24 hours after discovery of loss and a copy of the police report presented to Empire Winds Inc. within 14 days. All charges incurred up to the date of loss are still due and payable. 2. Empire Winds Inc. is not responsible for instruments left at schools for return without first obtaining proper return authorization and or instructions from Empire Winds Inc. 3. Any claims for replacement shall not alter or diminish the terms of the rental plan indicated on the front. 4. If the renter defaults on any payment for more than 30 days, T/F coverage will lapse and can be reinstated only by permission of Empire Winds Inc. No part of this coverage is refunded. 5. Replacement of rented instruments under this coverage must be made by Empire Winds Inc. or its authorized designated agent.
