TERMS & SERVICES AGREEMENT
Participants hike at their own risk. We are not responsible for any damage incurred by walking throughout Bernadette Morales Preserve. By participating, you agree to our Terms & Services found below:
*I acknowledge that participating in Flemington DIY's Bat Walks may entail known and unanticipated risks, which may result in physical injury or property damage. These risks may occur as a result of my own actions, inactions or negligence, as well as actions, inactions or negligence of others, weather conditions, condition of equipment, condition of the facilities and grounds. As part of my participation in the Bat Walk(s), I release, discharge, and hold harmless Flemington DIY, volunteers, or any person acting in any capacity on their behalf from all demands, causes of action, suits, contracts, agreements, obligations covenants, defenses, costs, liabilities and judgments, whatsoever, known or unknown, in contract or in tort, in law or in equity, which I may have against Flemington DIY, arising from my participation. I hereby waive all claims and demands against Flemington DIY for any loss, damage, injury or claim of any kind arising from, related to or caused by my participation and agree to indemnify, defend, and hold harmless Flemington DIY from all loss, liability, damages, costs and expenses (including actual attorney’s fees) arising from or related to same. By taking part in this event you grant Flemington DIY full rights to use the resulting images for publicity or marketing purposes. This might include (but is not limited to), the right to use them in print and online marketing materials, social media, and press releases.
