  • Kruse Elite Basketball Academy Disclaimer and Liability Release


    Kruse Elite Basketball Academy (KEBA) is not responsible for any injury (or loss of property) to any person suffered while participating in Basketball or any other activity for any reason, including ordinary negligence on the part of KEBA Organization, their agents, representatives or employees.  

    Further, I understand that above stated activities involve severe cardiovascular stress and physical contact. I understand that these activities involve certain risks, including but not limited to, death, serious neck and spinal injuries resulting in complete or partial paralysis, brain damage and serious injury to all bones, joints, muscles and internal organs. I also understand that these activities involve a high risk of knee and ankle injuries. I am voluntarily participating in these activities with knowledge of the dangers involved and hereby agree to accept any and all inherent risks of property damage, personal injury or death.  

    I authorize KEBA to publish photos of my child on advertising and website applications. Further, I authorize KEBA to video all games and training sessions to be made available to social media and website. 

    I represent that I have adequate insurance to cover any injury or illness I may suffer or cause while participating in basketball or any other activity while playing for KEBA, or while in transit or at any outside location. If adequate insurance is not in place, I agree to bear the costs of such injury or illness myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.  

    I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of Kansas and agree that if any portion is held invalid, the remainder of the waiver will continue in full legal force and effect. In the event that I file a lawsuit, I agree to do so in the state where KEBA is located, and I further agree that the substantive law of that state shall apply. I have read this waiver and fully understand its contents. I acknowledge that by signing this waiver, I am giving up substantial legal rights, including the right to sue the Organization.

    Abuse Prevention and Reporting Policy Statement
    Kruse Elite Basketball Academy is committed to providing a safe, supportive, and respectful environment for all athletes, coaches, staff, volunteers, and families. We maintain a strict zero-tolerance policy for any form of abuse, including but not limited to physical, emotional, sexual, or verbal abuse, as well as neglect or harassment.
     
    Definition of Abuse Abuse is defined as any behavior that causes or has the potential to cause harm to a participant’s physical or emotional well-being. This includes, but is not limited to:

    Physical abuse (intentional injury or excessive physical discipline)
    Sexual abuse or misconduct (inappropriate touching, exploitation, or harassment)
    Emotional abuse (threats, humiliation, or degrading treatment)
    Neglect (failing to provide adequate care or supervision)
    Prevention Measures

    All staff and volunteers must complete background checks and abuse prevention training prior to engaging with athletes
    Practices, travel, locker room, and communication protocols are structured to minimize risk and ensure transparency.
    Reporting and Response

    Any suspected abuse, misconduct, or policy violation must be reported immediately to the Club Director, Safeguarding Officer, or appropriate authority.
    Reports may be made anonymously and without fear of retaliation.
    Kruse Elite Basketball Academy will cooperate fully with law enforcement or child protective agencies during investigations.
    Violations of this policy may result in suspension, termination, or legal action.
    Mandatory Reporting All coaches and staff are considered mandated reporters under applicable state laws and are required to report any suspected child abuse or neglect to the proper authorities.
