Suncoast Martial Arts After School Program is structured and supervised, focusing on martial arts, character development, homework/study time, and engaging activities, held on-site at our St. Petersburg location. While we provide a safe and supportive environment, we are not a licensed daycare facility. The After School Program does not include off-site field trips or transportation.

On designated Camp Days (school holidays, teacher planning days, and other days when school is not in session), the After School Program may include off-site field trips and activities. I give permission for my child to participate in all scheduled Camp Day field trips and off-site activities, and I authorize Suncoast Martial Arts staff to transport my child on those days.

**IMPORTANT: By signing below, you are giving up certain legal rights, including the right to sue. Please read each paragraph carefully before agreeing.**

Release & Waiver: RELEASOR, in consideration of being permitted to participate in or observe a demonstration of Suncoast Martial Arts, to participate in or observe any classes or course of instruction in Suncoast Martial Arts, or to participate in or observe any demonstrations of or courses of instruction offered by Suncoast Martial Arts or any agents, students or employees thereof, and other good and valuable consideration the receipt and sufficiency thereof is hereby acknowledged, does for HIMSELF/HERSELF, HIS/HER heirs, next of kin, executors, administrators and assigns, hereby release, waive, discharge and covenant not to sue Suncoast Martial Arts, its employees, agents, students, instructors, assistant instructors, or anyone else in any way connected with Suncoast Martial Arts, or any demonstration, course of instruction or class offered thereby or conducted thereat, or their heirs, next of kin, administrators, executors and assigns (hereinafter the "RELEASEES") of and from any and every claim, demand, injury, cause of action, damage, action or right of action of whatsoever kind or nature, either in law or equity arising from or by reason of any and all bodily injury or personal injuries known or unknown, death and/or property damage resulting to the RELEASOR or from any action, inaction, statement or omission of the RELEASEES, whether alleged to be negligence or otherwise.

Indemnification: RELEASOR further agrees to indemnify the RELEASEES from any loss, liability, damage, claim or cost, including any and all attorneys' fees and costs of suit, which RELEASEES may incur for any reason, including but not limited to any demonstrations, classes, courses of instruction or as a result of the presence of RELEASOR in or upon the premises of the RELEASEE, or any other location where the RELEASEE conducts business, whether caused by the actions, omissions or negligence of the RELEASEES or otherwise.

Assumption of Risk: RELEASOR has been advised of and expressly acknowledges the existence of a substantial risk of injury in his (her) observation of or participation in any demonstration, course of instruction, or classes offered by the RELEASEES, or in which the RELEASEES participate, and that he/she knowingly and voluntarily assumes full and complete responsibility for any and all risk of bodily injury, death or property damage due to the actions, omissions, conduct, statements or negligence of RELEASEES or otherwise, while in or upon the above described premises or while participating in or observing any demonstration, course of instruction or class. RELEASOR also acknowledges that an attempt by he/she to counter or in any way nullify any movement by the person giving the demonstration, conducting the class or course of instruction or in any way participating therein, as well as the RELEASOR's voluntary observance of or participation therein, constitutes a request by the RELEASOR and his/her unrestricted consent that the persons giving the demonstration or participating therein display a higher degree of skill and use much greater force against the RELEASOR, and that therefore the risk and severity of injury to the person and property of the RELEASOR is greatly increased.

Severability: RELEASOR expressly agrees that this release, waiver, discharge, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of FLORIDA, and that if any portion of this Release is held invalid or otherwise not enforceable, it is agreed that the balance shall, notwithstanding any invalid portion, continue to be in full legal force and effect.

Medical Care Release: RELEASOR further releases the RELEASEES and anyone else acting on their behalf, from any claim whatsoever on account of any and all first aid, treatment, medical care, medical assistance, advice of a medical nature or services rendered to him (her) prior to, during, after or resulting from his (her) participating in or observance of any class, course of instruction or demonstration by the RELEASEES, and of any omission or failure by the RELEASEES to provide such care. RELEASOR hereby consents to such care if so determined to be necessary by the RELEASEES, but hereby consents and agrees that the RELEASEE is in no way hereby required to render said services to the RELEASOR.

Entire Agreement: This RELEASE contains the entire agreement between the parties hereto and the terms of this RELEASE are contractual and not a mere recital. This Release shall be interpreted and enforced pursuant to the law of the State of FLORIDA.

Acknowledgment: RELEASOR further states that he/she has carefully read the foregoing release, knows the contents thereof and signs this release as his (her) own free and voluntary act.

TERMS AND CONDITIONS

1) Tuition due by Friday of the week prior to the week of service; if unpaid by Friday, card on file may be charged; $35 fee for returned checks.

2) Registration Fee Acknowledgement (Required): one-time $75 registration fee per student secures the spot; includes a Suncoast Martial Arts t-shirt and shorts; fee is non-refundable.

3) Enrolled days/week are reserved exclusively for the child; tuition required in full regardless of attendance, schedule changes, or absence.

4) Authorization for Suncoast Martial Arts to charge debit/credit card on file for tuition, fees, or balances.

5) Structured daily schedule including homework/study time and martial arts instruction; students should participate and follow staff guidance; disruptive behavior may result in dismissal without refund.

6) Send a daily snack; microwave and refrigerator are available.

7) Image/likeness/sound-of-voice release and waiver permitting editing, copying, exhibiting, publishing, distribution, no inspection/approval, no royalties/compensation, and use in diverse educational settings within an unrestricted geographic area.
