1. Acknowledgment of RiskI understand that volunteering at a motocross track and related events (including, but not limited to, race day operations, course marshaling, flagging, gate/registration duty, track maintenance, setup, and teardown) involves inherent and significant risks, including exposure to moving vehicles, high speeds, dust, noise, uneven terrain, weather conditions, equipment, machinery, and the actions of riders, spectators, and other volunteers. These risks may result in serious bodily injury, property damage, or death.I acknowledge that these risks cannot be eliminated regardless of the care taken by Kauai Amateur Motocross Association (“KAMA”) to avoid injury, and I voluntarily choose to accept and assume all such risks.2. Release and Waiver of LiabilityIn consideration for being permitted to volunteer with KAMA, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue KAMA, its officers, directors, employees, members, agents, sponsors, landowners, and other volunteers (collectively, the “Releasees”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in volunteer activities, whether caused by the negligence of the Releasees or otherwise, to the fullest extent permitted by law.3. Assumption of RiskI understand the nature of motocross-related volunteer activities and am voluntarily participating with knowledge of the danger involved. I hereby agree to assume all risks of injury, illness, or death that may result from these activities and release the Releasees from any and all liability.4. IndemnificationI agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including attorney's fees, that they may incur due to my presence or participation in volunteer activities, whether caused by my own negligence or the negligence of others.5. Medical TreatmentI authorize KAMA representatives to secure emergency medical treatment on my behalf if I am unable to communicate my own wishes, and I agree to be financially responsible for any costs associated with such treatment.6. Photo/Media ReleaseI grant KAMA permission to use photographs, video, or other recordings that may include my likeness, taken during volunteer activities, for promotional, educational, or fundraising purposes, without compensation.7. Voluntary AgreementI certify that I am at least 18 years of age, that I have read this document in its entirety, that I fully understand its terms, and that I am signing this agreement freely and voluntarily without any inducement.8. Governing LawThis agreement shall be governed by the laws of the State of Hawaii. If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
