NOTICE TO HOSTS, RENTERS, ORGANIZATIONS & PARTICIPANTS: This document is a legally binding contract. By signing this agreement, you (the "Host/Renter") assume full legal and financial liability for the premises, equipment rental, water runoff, and all event attendees, and you relinquish certain legal rights, including the right to sue Bubble Boss Events L.L.C., its owners, members, managers, employees, operators, and agents.
1. HOST / EVENT ENTITY RESPONSIBILITY & ASSUMPTION OF LIABILITY
The undersigned individual, home owner, business, HOA, school, daycare, or organization ("Host/Renter") agreeing to this contract assumes primary responsibility and liability for the event premises, setup location, guest management, and overall event safety.
The Host/Renter specifically agrees that:
· They are solely responsible for informing all guests, participants, and parents/guardians of minor attendees of the safety rules, operational constraints, and inherent risks associated with the event.
· They assume full financial and legal liability for any personal injury, illness, death, or property damage occurring to any guest, attendee, bystander, or third party during or as a result of the event.
· They warrant that the setup area is safe, level, free of hazards, and complies with all clearance requirements.
2. COMPREHENSIVE ASSUMPTION OF RISKS
All participants and the Host/Renter acknowledge that participating in a foam party and related arena activities ("The Activity") carries inherent risks that cannot be eliminated regardless of the care taken.
Specific risks assumed include, but are not limited to:
· Minor Injuries: Scratches, cuts, bruises, sprains, strains, and skin/eye irritation.
· Major Injuries: Joint or back injuries, concussions, eye injuries or loss of sight, heart attacks, broken bones, and allergic reactions (despite the use of dermatologist-tested, hypoallergenic foam solution).
· Catastrophic Injuries: Permanent paralysis, brain damage, or accidental drowning/death.
· Environmental & Premises Risks: Slips, trips, or falls on wet surfaces, artificial turf, concrete, or grass; limited visibility due to foam accumulation; contact with other participants; defects in premises; insects/animals; and weather effects including heat, storms, and humidity.
· HEALTH DISCLOSURE & ADVISORY: The Activity involves physical exertion, wet conditions, reduced visibility, and active movement. Participation is NOT RECOMMENDED for individuals who are pregnant, or who have pre-existing heart, respiratory, back, neck, joint, or athletic conditions. Anyone with these conditions choosing to participate assumes all heightened risks of injury.
3. MANDATORY SAFETY RULES & OPERATIONAL CODE
The Host/Renter agrees to strictly enforce—and cause all guests to strictly follow—the following mandatory rules:
· NO RUNNING OR HORSEPLAY: Running, pushing, shoving, wrestling, or rough play is strictly prohibited.
· NO DIVING OR FLIPS: Diving head-first into foam, performing flips, or dropping to the ground head-first is strictly forbidden.
· NO FIGHTING OR AGGRESSIVE BEHAVIOR: Throwing foam directly into eyes, mouths, or bodily orifices is prohibited. Aggressive conduct, fighting, visible intoxication, verbally threatening the operator or refusal to follow operator safety instructions will not be tolerated.
· NO POOL / OPEN WATER PROXIMITY: Under no circumstances will foam equipment operate within 15 feet of a swimming pool, spa, pond, or open body of water. Running directly from foam into a pool is strictly prohibited.
· NO WEATHER HAZARDS: Operations will immediately pause in the event of sustained high winds exceeding 15 mph, heavy rain, severe weather, or lightning within 10 miles.
· FOOTWEAR & OBJECTS: High heels, spiked shoes, sharp objects, jewelry, eyeglasses, or hard toys are forbidden in the foam play zone. Bare feet, normal athletic shoes, or water shoes only.
· ADULT SUPERVISION REQUIRED: A designated adult (18+) provided by the Host/Renter must maintain continuous line-of-sight supervision over the foam area whenever minors are present.
· ELECTRICAL CLEARANCE: Participants must not touch, alter, climb on, or tamper with cannons, blowers, power cords, water hoses, or electrical connections.
4. WAIVER, RELEASE & COVENANT NOT TO SUE
In consideration for being permitted to rent equipment or participate in Bubble Boss Events L.L.C. activities, the undersigned Host/Renter (for themselves, their entity, heirs, personal representatives, and assigns) hereby releases, waives, discharges, and covenants not to sue Bubble Boss Events L.L.C., its managers, members, employees, operators, and agents from any and all liability, claims, demands, or causes of action resulting in personal injury, accident, illness (including death), or property loss arising out of participation, equipment rental, or premises conditions, whether caused by ordinary negligence or otherwise.
5. HOST INDEMNIFICATION & PROPERTY DAMAGE RESPONSIBILITY
· Third-Party Claims: The Host/Renter explicitly agrees to defend, indemnify, and hold harmless Bubble Boss Events L.L.C. against any and all claims, actions, suits, procedures, costs, damages, liabilities, and expenses (including attorney fees) brought by any guest, participant, parent, guardian, or third party arising from or related to the event.
· Equipment Damage: The Host/Renter accepts full financial responsibility for any deliberate damage, neglect, theft, or destruction to Bubble Boss Events L.L.C. equipment (cannons, arena, sound gear, blowers, hoses) caused by guests, attendees, or failure to enforce safety rules.
6. OPERATOR AUTHORITY & SEVERABILITY
· Operator Authority: All participants agree to abide by the instructions of the Bubble Boss Events L.L.C. operator/host at all times. The operator reserves the absolute right to halt participation or shut down equipment at any time without refund if safety rules are violated or an unsafe condition arises.
· Governing Law, Electronic Signatures & Severability: This agreement shall be governed by and construed in accordance with the laws of the State of Nevada. Both parties agree that electronic signatures, digital acceptances via QR code/online submission, and electronic records carry the same legal weight, validity, and enforceability as handwritten signatures under the Nevada Uniform Electronic Transactions Act (NRS Chapter 719). If any portion of this agreement is held invalid or unenforceable, the remaining terms shall continue in full legal force and effect.

7. UTILITIES, PREMISES & SITE ACCESS REQUIREMENTS
· Utility Guarantees: The Host/Renter warrants that the event location provides:
o At least one dedicated 110V standard electrical outlet within 100 feet of the setup site (not shared with heavy electrical loads or appliances).
o At least one functional outdoor water spigot with standard hose threading and adequate capable of providing 10 to 15 gpm with a water pressure between 40-60 psi, within 100 feet of the setup site.
o Failure of the Host’s power or water supply resulting in delayed or canceled operation does not entitle the Host to a refund.
· Surfactant Runoff & Lawn Surface Responsibility: The Host/Renter acknowledges that foam operation utilizes water combined with a concentrated surfactant (foam solution) that will dissolve into liquid, flow across the surrounding ground, and thoroughly saturate the play zone and adjacent areas.
o Host Runoff Responsibility: The Host/Renter is solely responsible for managing surfactant water runoff, drainage pathways, and potential accumulation on the property or neighboring properties.
o Lawn & Property Disclaimer: Bubble Boss Events L.L.C. is not liable for grass saturation, soil conditions, mud, temporary standing surfactant liquid, damaged or discolored grass, plant impact, or dirt/mud tracked beyond the designated play area onto hard surfaces or indoor flooring.
· Site Access: The Host/Renter must provide an unobstructed, level path (minimum 36-inch clearance) to the setup area. Stairs, steep inclines, or locked gates not disclosed prior to arrival that prevent setup may result in cancellation without refund.
8. CANCELLATIONS, WEATHER & DEPOSITS
· Non-Refundable Booking Deposit: All booking deposits are non-refundable but are fully transferrable to a rescheduled date within 12 months if canceled at least 72 hours prior to the scheduled event start time.
· Severe Weather Policy: If Bubble Boss Events L.L.C. deems conditions unsafe prior to setup due to active lightning, torrential rain, or sustained high winds (>15 mph), the Host may reschedule without penalty within 12 months. Once equipment is unloaded and set up at the event site, full payment is earned and non-refundable, regardless of sudden weather shutdowns.
· The operator retains the right to halt operations immediately if attendees or hosts are visibly intoxicated, aggressive, or endangering staff/equipment, without issuing a refund.

9. PHOTO & MEDIA RELEASE (OPTIONAL)
I grant Bubble Boss Events L.L.C. permission to use promotional photos or short video clips taken during the event for marketing, website, and social media promotion. (To opt out, check here: [ ] Opt-Out of Media Release).
