Event: Swim into the Sun Boat Party
Organizer: Noodle Goose Games Inc. (“Noodle Goose”)

Vessel: Kajama Tall Ship, Toronto Harbour
Thank you for joining us for Swim into the Sun! Because this event takes place aboard a moving vessel, we ask all guests to review the following agreement before attending.
By attending the Event, I acknowledge and agree to the following:
1. Participation and Assumption of Risk
I understand that the Event takes place aboard a moving vessel and may involve ordinary risks associated with being on or around a boat, including vessel movement, changes in weather, wet or slippery surfaces, stairs and changes in elevation, crowd movement, and other conditions that may reasonably occur during a harbour cruise.
I voluntarily choose to participate in the Event and agree to take reasonable care of my own safety and to follow reasonable instructions from the vessel crew, Event staff, and other authorized personnel.
I understand that I am responsible for my own personal belongings and personal conduct while attending the Event.
2. Release and Limitation of Liability
To the extent permitted by applicable law, I release and hold harmless Noodle Goose Games Inc., its directors, officers, employees, contractors, volunteers, event partners, and representatives from claims arising from my voluntary participation in the Event.
This release does not apply to liability arising from gross negligence, wilful misconduct, or any other liability that cannot legally be excluded or limited.
Nothing in this agreement is intended to remove or limit any rights or protections that cannot legally be waived.
3. Safety and Conduct
I agree to follow reasonable safety instructions provided by the vessel crew and Event staff.
I understand that I may be asked to leave the Event if my conduct creates a safety risk to myself or others, or if I substantially interfere with the safe operation of the Event or vessel, subject to applicable law.
4. Photography, Video and Audio
I understand that photography, video, and audio recording will take place during the Event.
I grant Noodle Goose Games Inc. permission to photograph, film, or otherwise record me during the Event and to use my image, likeness, voice, and/or statements in connection with documenting, promoting, or publicizing Noodle Goose, Swim into the Sun, and future Noodle Goose events or projects.
This may include use on social media, websites, promotional materials, press coverage, and other communications channels.
I understand that I will not receive compensation for these uses.
5. Photo Review & Removal Requests
Noodle Goose intends to share photographs and other media from the Event after the Event.
Where reasonably possible, Noodle Goose will provide Event attendees with access to an Event photo album so that attendees may review the images.
For a period of 14 days after the album is made available, an attendee may contact Noodle Goose to request that a photograph in which they are identifiable be removed from the album or from Noodle Goose's future promotional use.
Noodle Goose will make reasonable efforts to honour removal requests received during this period.
Removal requests may be subject to reasonable exceptions where an image has already been published by Noodle Goose, distributed to media, incorporated into promotional materials, or is not reasonably practical to remove.
After the 14-day review period, Noodle Goose may continue to use Event photography in accordance with this agreement.
6. Personal Information
I understand that information collected through this form may be used for Event administration, safety, communication, and record-keeping purposes.
Noodle Goose will handle personal information in accordance with applicable privacy laws and its privacy practices.
7. Acknowledgement
By signing below, I confirm that:
- I have read and understood this agreement.
- I have had the opportunity to ask questions before signing.
- I am voluntarily attending the Event.
- I understand that the Event takes place aboard a moving vessel.
- I understand the ordinary risks associated with participating in the Event.
- I agree to follow reasonable safety instructions and Event rules.
- I understand and agree to the media provisions above.
- I understand that this agreement does not limit any rights or protections that cannot legally be waived.
