Photo & Video Submission Agreement
Thank you for sharing your fishing memories with the Orlando Princess Fishing Fleet!
By checking the box below and continuing to the upload page, you certify that you own or have permission to submit the photos and/or videos you are uploading and that you have the authority to grant the rights described below.
You grant Marine Mammal Tours, Inc., d/b/a Orlando Princess Fishing Fleet and Canaveral Princess, a perpetual, worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, edit, publish, distribute, display, and create derivative works from the submitted photos and videos, including the likeness of any persons depicted, for advertising, marketing, promotional, educational, and other lawful business purposes in any media now known or later developed, without further notice, approval, or compensation.
You understand and agree that submission of photos or videos does not guarantee that any content will be used, published, or posted, and Marine Mammal Tours, Inc. has sole discretion to determine whether, when, where, and how any submitted content is used.
You represent that the submitted content does not infringe upon the rights of any third party and that any identifiable individuals appearing in the content have consented to its submission and use as described herein.
To the fullest extent permitted by law, you release, waive, and hold harmless Marine Mammal Tours, Inc., its owners, officers, directors, employees, agents, affiliates, successors, and assigns from any and all claims, demands, liabilities, damages, costs, or expenses arising out of or relating to the use, non-use, publication, or non-publication of the submitted content in accordance with this Agreement. If it ever becomes necessary to enforce the terms of this Hold Harmless Agreement, RELEASEES shall be entitled to recover any and all attorneys’ fees and costs incurred.
