LIABILITY WAIVER
I understand that by taking part in Westside Pickleball, a program of Seattle Metro Pickleball Association (SMPA), I am agreeing that:
The nature of the Westside Pickleball activities and the equipment used in conjunction with those activities may expose me to hazards or risks that may include minor injuries, broken or sprained limbs, overexertion, or heat exhaustion, along with other, more serious injuries including hospitalization and death.
In consideration of my participation in the above SMPA sponsored activity, I hereby accept all risk to my health or property and release the Westside Pickleball League, SMPA, its board of directors, officers, agents, volunteers, and independent contractors, from any and all liability to me, my personal representatives, estate, heirs next of kin and assigns that may result from or occur in any way related to my participation in this activity.
I further agree to hold the Westside Pickleball, SMPA, its directors, officers, agents, volunteers, and independent contractors harmless from any and all claims related to or in any way arising out of my participation in the above activity and agree to indemnify them against all loss including judgments, litigation expenses, attorney fees and out of pocket expenses.
I have carefully read this agreement and understand it to be a release of all claims and causes of action for injury or death or damage to my property which may occur as a result of participating the above activity, and I further understand that this agreement obligates me to indemnify and hold harmless all persons released hereby against and/or in connection with any claim arising out of, pertaining or related to my participation in this Westside Pickleball activity.
