LIABILITY WAIVER, RELEASE & ASSUMPTION OF RISK - Pawty Yoga LLC
The Activity. Pawty Yoga ("we") provides a yoga or light movement experience involving live dogs (puppies and/or adult dogs) and light physical activity, often held at third-party venues. This Waiver applies to me and to any minor child I list below. I am at least 18 years old and, for each minor I list, I am that child's parent or legal guardian with authority to sign on their behalf.
Released Parties. "Released Parties" means Pawty Yoga LLC, its owners, officers, instructors, handlers, staff, volunteers, contractors and partners, and also the venue or facility owner or operator, any rescue or shelter organization hosting the event, any dog owners or handlers provided by the host, and their respective officers, employees and agents.
Assumption of Risk. I understand this activity has inherent risks, including but not limited to: scratches, nips, or bites from dogs; slips, trips, and falls (including on polished, hardwood, or wet floors); allergic reactions or asthma; exposure to animal dander, saliva, urine, waste or germs, including zoonotic and other communicable illnesses; interactions with other participants; and the ordinary risks of physical exercise and being on the floor with animals. I understand that dogs can behave unpredictably even when temperament-checked. I knowingly and voluntarily assume all such risks, whether known or unknown, for myself and for any minor child I list. I represent that I and my listed minors are in suitable physical condition to participate and have no known medical, physical or psychological condition that would make participation unreasonably dangerous, and I will notify staff of any relevant condition, allergy or concern before the session.
Release of Liability. ON BEHALF OF MYSELF, MY LISTED MINORS, AND OUR HEIRS, ASSIGNS, AND ESTATES, I RELEASE, WAIVE, AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION FOR ANY INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING OUT OF PARTICIPATION IN THIS EVENT, EVEN IF CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED PARTIES. This release does not apply to claims arising from gross negligence or willful misconduct to the extent such claims cannot be waived under Texas law.
Indemnification. I agree to indemnify, defend and hold the Released Parties harmless from any claim, loss, damage or expense (including reasonable attorney's fees) arising out of or related to my or my minor child's participation, my conduct, or any injury or damage I or my minor child cause to another person, animal or property.
Conduct. I will follow all staff instructions, handle the dogs gently and only as directed, never lift a dog while standing, and remain responsible for supervising any minors I list. Pawty Yoga or the host may remove any participant at any time, without refund, if they pose a risk to the animals, other guests or staff.
Photo & Video. Photography permissions are set at the event level. If the person or organization hosting this event has a no-photography provision or photo opt-out in their signed quote or contract with Pawty Yoga, that provision controls and supersedes this section, and no marketing photography or video will be taken or used from that event. The host venue may also limit or prohibit photography. Where photography is permitted at the event, I grant Pawty Yoga a perpetual, royalty-free license to use photos and video of me and my listed minors taken at the event for marketing and promotional purposes, in any media, with no compensation owed to me. Guests who prefer not to be featured may let staff know and we will try to accommodate, but I understand that Pawty Yoga cannot guarantee exclusion, particularly from group or background shots, and that appearing in event media is not a basis for any claim.
General. In an emergency, I authorize staff to seek medical care, including calling 911, at my expense. This agreement is governed by Texas law, with disputes resolved exclusively in the state or federal courts located in Harris County, Texas. If any provision is unenforceable, the rest remains in effect.
Acknowledgment. By submitting this form I confirm that I have carefully read this entire Waiver, understand that I am giving up substantial legal rights including the right to sue for ordinary negligence, am signing voluntarily, and have had the opportunity to ask questions. My typed name and initials, and my submission of this form, constitute my electronic signature and agreement.
