Prairie Creek Marina

By filling out this form, I have authorized Prairie Creek Marina, to be the exclusive agent (except as noted below) in listing my boat and/or trailer (description below) for a ninety (90) day period starting. The asking price of the boat (listed below) with Prairie Creek Marina retaining a commission percentage based on selling price below. If the boat is sold by the owner or any other party during the ninety (90) day period, Prairie Creek Marina is to receive 3% of the selling price (Exceptions are as noted below). Storage and Launch fees for boats in brokerage are set according to standard marina fees. This contract will automatically renew unless canceled by seller.

Hoist/Lift Listing Agreement Terms

• Asking Price - The Seller and Marina agree to an initial asking price for the lift. The Seller may adjust the asking price at any time by written notice to the Marina.

• Listing Term - This Agreement is effective for 90 days from the date of signing and will automatically renew after 90 days unless canceled in writing by either party.

• Dockage & Storage While Listed - If the lift remains in the slip during the listing period, standard dockage fees will continue to apply to the Seller. Alternatively, the Seller may have the lift removed at their own expense and placed into dry storage, in which case a monthly storage fee will be charged in place of dockage.

• Commission - Upon sale of the lift, the Marina will deduct a commission of 10% of the final sale price, along with any outstanding dockage or storage fees owed by the Seller, from the sale proceeds before issuing payment to the Seller.

• Seller Payment - Once the buyer's funds have cleared, the Seller's payment will be issued, less the Marina's 10% commission and any outstanding dockage or storage fees owed by the Seller.

• Cancellation - Either party may cancel this Agreement with written notice. The lift will be delisted within a reasonable time following cancellation.

 

Terms of Agreement

All parties agree that Prairie Creek Marina is Listing agent to this transaction and shall be held harmless from any and all disputes that should arise between the parties as to Boat/Trailer condition, mechanically or otherwise and that listing agency makes norepresentations as to same. Purchaser(s) further understand their rights to employ a Professional Marine Surveyor and/or professional marine mechanic to examine the boat/trailer prior to closing this sale. Sellers agree that should buyer(s) so elect to employ such professional services the result of which one or more defects in excess of $200.00 (Two Hundred Dollars) is discovered will either remedy such defect(s) or release purchaser(s) from any and all obligations to purchase under this agreement. Furthermore, all parties agree that listing agency is a party to this agreement and as such is legally authorized to construct this agreement.All parties agree that the transaction set forth through this listing agreement, is conducted between individual buyers and sellers, and Prairie Creek Marina, is solely a third party listing agency

 

Non-Storage/Slip customers will recieve 1 month free storage while listed with Prairie Creek Marina.

We will post-mark storage fees for one month after listing agreement submitted and will be prorated if needed.
