This Assumption of Risk, Hold Harmless, and Indemnification Agreement ("Agreement") is executed by the undersigned student-athlete and parent/legal guardian in favor of Andrews University, a Michigan nonprofit corporation that operates the Andrews Jr. Cardinals athletic program (collectively referred to as "Andrews University"). This Agreement shall remain in effect for the duration of the current athletic season.

1. Season Participation and Travel. The undersigned student-athlete has been selected to participate in one or more Andrews Jr. Cardinals sports teams for the current athletic season, including volleyball, soccer, basketball, golf, and/or pickleball (the "Activities"). Participation will include practices, home games, and travel to and from away games, meets, or tournaments, whether by vehicle, bus, or other modes of transportation arranged by Andrews University.

2. Acknowledgment of Inherent Risks. The undersigned understands and acknowledges that participation in athletic activities—including practices, games, training, and travel—involves inherent risks, including but not limited to: physical injury (e.g., sprains, fractures, or other injuries to bones, joints, muscles, and internal organs, concussions, and in rare cases, paralysis or death); heat-related illness or exhaustion; transportation-related incidents (e.g., vehicle accidents, delays, breakdowns); exposure to communicable diseases (e.g., COVID-19); and unexpected events at host venues.

3. Medical Insurance Affirmation. The undersigned affirms that the student-athlete is currently covered by valid medical insurance and agrees to maintain such coverage throughout the season. The undersigned agrees to be financially responsible for any medical treatment resulting from injury or illness arising from participation in the Activities. The undersigned further authorizes Andrews University to obtain emergency medical care for the student-athlete, if necessary, during any team activity or while traveling.

4. Assumption of Risk. The undersigned knowingly and voluntarily assumes all risks, known and unknown, associated with participation in the Activities and travel, including risks arising from the actions or inactions of other participants, coaches, volunteers, drivers, or third parties, and including those arising from the negligence of Andrews University, its officers, trustees, employees, agents, coaches, and volunteers ("Released Parties"), except where such risks result from gross negligence or willful misconduct.

5. Waiver and Hold Harmless. To the fullest extent permitted by law, the undersigned hereby waives, releases, and holds harmless the Released Parties from and against any and all claims, liabilities, damages, or causes of action arising from or related to participation in the Activities, including but not limited to those relating to personal injury, property damage or loss, illness or medical emergencies, transportation-related incidents, and wrongful death, except for claims resulting from gross negligence or intentional misconduct.

6. Indemnification. The undersigned parent or legal guardian agrees to indemnify and hold harmless the Released Parties from and against all third-party claims, liabilities, damages, costs, or expenses (including reasonable attorney fees) resulting from the student-athlete's negligent or wrongful acts or omission during participation in the Activities or while traveling, except to the extent caused by Andrews University's gross negligence or willful misconduct. This indemnification provision shall survive the end of the season and expiration of this Agreement.

7. Compliance with Program Rules. The undersigned agrees that the student-athlete will comply with all rules, codes of conduct, instructions, and safety procedures issued by Andrews University, the Andrews Jr. Cardinals program, and coaching staff. This includes behavioral expectations while traveling, at competitions, and when representing Andrews University. Failure to follow such rules may result in suspension or removal from the team.

8. Governing Law and Severability. This Agreement shall be governed by the laws of the State of Michigan. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

I affirm that the participant is physically fit to participate and gree to maintain medical insurance coverage during the term of this Agreement. I consent to the student's full participation in the Andrews Jr. Cardinals program, including gravel, and agree to all terms of this Agreement.
