    Notice of Demand to Nullify Unconstitutional Land-Use Regulation
    Notice to Agent is Notice to Principal and Notice to Principle is Notice to Agent  

    I, _________________________one of the People as seen in the Michigan Constitution Declaration of Rights Section 1, Sui Juris, do serve this notice that you may take due care;  

    Please take notice that the people have assembled and consulted, and now realize the current form of township government as regulated by Michigan public acts, is not the form of government the People have brought in their Michigan Constitution, and to which you are bound in trust. As trustee/servants of the People, township officers are sworn to support the Michigan and U.S. Constitutions; which enumerate inalienable rights of the People to assemble; consult; instruct; petition for redress of grievance; recur to fundamental principles; and regulate their internal government for the common good. (see evidence below)  

    Michigan Declaration of Rights Section 3: Assembly, Consultation, Instruction, Petition  

    “The people have the right peaceably to assemble, to consult for the common good, to instruct their representatives and to petition the government for redress of grievances.” 

    Maxim of Law: A frequent recurrence to fundamental principles, and a firm adherence to justice, virtue, and original law, are indispensably necessary to preserve the blessings of liberty and good government.  

    REGULATE. To fix, establish, or control; to adjust by rule, method, or established mode; to direct by rule or restriction; to subject to governing principles or laws (Black’s Law Dictionary Fourth Edition)  

    Please take notice that any (legislative) statutory law repugnant to the Michigan Constitution is void and not to be followed. Notice that regulatory rules such as public acts, serve only to restrict conduct of public trustees & other public entities, and have no force in law over the People as grantor, beneficiary, and protector of the Michigan Public Trust. Notice also that administrative agencies created by statute hold no delegated authority to make law. Therefore, it is incumbent upon you as administrator of the People’s township business that all written agency rules/regulations, e.g. Michigan Public Act 33 of 2008 (Planning Enabling Act), Michigan Public Act 110 of 2006 (Zoning Enabling Act) must be abolished as not in pursuance of the constitution. (see evidence below) 

    Maxim of Law: An unconstitutional Act is not a law; it confers no rights; it imposes no duties; it affords no protection; it creates no office; it is, in legal contemplation, as inoperative as though it had never been passed.  

    Maxim of Law: Where there is no authority to establish, there is no necessity to obey.   

    Please take notice that the Michigan Constitution clearly reserves the duty of self-governance to the People, with inalienable right to instruct their township trustee/servants in administrating their will. Take notice that the ‘body corporate’ Rock River Township officers are granted certain powers and immunities; and that the constitution mandates legislative & administrative powers to all township officers; and that it grants township officers immunity in event of unlawful transgression by external public entities (including government). (see evidence below)  

    Michigan Constitution Article VII Section 17: Townships; Corporate Character, Powers and Immunities  

     “Each organized township shall be a body corporate with powers and immunities provided by law.”  

    Michigan Constitution Article VII Section 18: Township Officers; Term, Powers and Duties  

    “In each organized township there shall be elected for terms of not less than two nor more than four years as prescribed by law a supervisor, a clerk, a treasurer, and not to exceed four trustees, whose legislative and administrative powers and duties shall be provided by law.”  

    Please take notice your voluntary trust indenture to serve the People of Rock River Township is considered as binding upon you at all times in conduct of your office; and that you are to protect the People’s rights from transgression by any external public entity; you are granted immunity by the People for performance under your contract. (see evidence below):  

    Maxim of Law: The act of a servant in those things in which he is usually employed, is considered the act of his master.  

    Maxim of Law: No guilt attaches to him who is compelled to obey.  

    Please take final notice the People of Rock River Township have the inherent right to regulate land use and commerce within the boundaries of Rock River Township to protect their community and property, ensuring control over local land use to prevent irreparable harm and adverse effects to private property. No Public Acts are necessary, nor can they regulate the people's private property rights, therefore it is my wish, order and demand that you nullify Resolution # 200209-18 Rock River Township Resolution Establishing Township Planning Commission, and Resolution # 2006-04-18-01 Resolution To Adopt A Zoning Ordinance.

    Maxim of Law: An obligation which arises from contract, or quasi contract, is dissolved in the same way in which it was contracted.

    Maxim of Law: Use your own property in such a manner so as not to injure that of another.

    Maxim of Law: It is unjust that freemen should not have the free disposal of their own property.

    If you believe any of the above claims are untrue or that you have the authority in any way, which would allow any PublicServant, Agent, or Corporate Entity to infringe on the People’s Rights, please show where you were granted these Constitutional Authorities. Any disputes by any public officials or private actors who are bound by contract to the Michigan Constitution or the United States Constitution, agrees to have these matters heard before an arbitrator of my choice and to be bound thereby. All responses must be submitted by affidavit, sworn under penalty of perjury, within 5 days of receiving this Notice or you agree, by tacit acquiescence, all statements in this Notice to be true and fact as judicial notice is a form of evidence. Further, you agree that you are acting with full knowledge, intent, and malice by trespassing on the Private People and our rights, and that no court shall be able to rehear this matter, but it shall stand as evidence, truth and law in all courts of record.  

    This notice is sent to you in peace and with the love of Christ, so that justice may be had and past transgressions may become restoration.
