RULES AND REGULATIONS
FOR ALL OUTSIDE FOOD/COMMERCIAL VENDORS
Dates of Event are Tuesday, October 13 thru Saturday, October 17, 2026
1. Fairgrounds open at 5:00 p.m. Tuesday – Friday and at noon on Saturday. All work and set-up on food/commercial exhibits must be completed by noon on Tuesday, October 13, 2026. Booths must be open Tuesday thru Friday 5:00 p.m. - 10:00 p.m. and on Saturday from noon – 11:00 p.m. In addition to the foregoing times, food vendors may open as early as 7:00 a.m. on Wednesday morning during the livestock weigh-in and show.
2. Calhoun County Fair Association (“CCFA”) will charge a one-time fee of $600.00 for your first two primary menu items. If you would like to add menu items, there will be an additional fee of $400.00. Items will be approved first come first serve after all applications have been received and processed. We will allow no more than two vendors selling the same items and will advise vendors of their accepted additional items. Non-profit organizations will be charged a one-time fee of $300.00 for two primary menu items. All checks need to be made payable to Calhoun County Fair Association, to be mailed to P.O. Box 42, Port Lavaca, Texas 77979. We also accept Cash App payments at $calhouncountyfair. Feel free to call for inquiries. All nonrefundable fees will be due at the time of application turn in and you will receive an arrival time for set up by Oct. 8, 2026.
3. Food vendors may accept any form of payment that they wish.
4. Food vendors do not have exclusive sale rights on any items. CCFA seeks to keep a variety of food but retains the right to limit the sale of an item or category to 2 vendors. Food categories and will be approved as followed; based on submission date of an application along with all of the supporting documentation. NO EXCEPTIONS.
5. All food vendors must contact the Victoria County Environmental Health Department and obtain a Food Sales Permit before opening for business at the Calhoun County Fair. CCFA needs a copy of the permit before opening day and any vendor failing to provide such permit will not be permitted on the fairgrounds.
6. This application and the rights granted by CCFA are non-transferable. Booth/space may not be sublet to another party without approval from CCFA.
7. Four complimentary vendor gate passes will be issued for each booth/space for entrance into the fairgrounds. Additional vendor gate passes may be purchased for $10.00 each.
8. Delivery gates to the fairgrounds will be closed at 4:00 p.m. each day except Saturday which will be closed at 11:00 a.m. Vendors, their merchants or anyone else making deliveries to the fairgrounds must be finished with such deliveries and have their vehicles off the fairgrounds by that time. Vendors shall enter through such gates and travel only the routes through the fairgrounds as directed by CCFA. Vendors shall park in the areas designated by CCFA but in no event shall Vendors park inside the gated fairgrounds.
9. Vendors will not be allowed to solicit, barter, or entice patrons, nor be allowed to work or sell outside the perimeter of their assigned vender booth/space. No display may be put up outside your booth space.
10. All modifications to any booth/space will be done at the expense of the vendor. All modifications must be removed at the conclusion of the Fair at the expense of the vendor, and the booth/space must be left in the condition equal to or better than that at the time of occupancy. Any items not removed by vendor at the conclusion of the fair shall be deemed abandoned by vendor and CCFA will dispose of the items appropriately. Prior to closing each evening, refuse should be placed in trashcans provided.
11. CCFA must approve installation of any exhibit using utilities not furnished by the fairgrounds.
12. Use of electrical heaters must be approved by CCFA.
13. All vendors will be responsible for containing and properly disposing of all wastewater, including grey water. There will be a place on the fairgrounds to dispose of any wastewater. Failure to properly dispose of any waste will make vendor responsible for the costs incurred during remediation and vendor’s booth/space may be shut down immediately and vendors right to remain on the fairgrounds may be terminated without notice.
14. Vendor’s booth/space shall be kept clean of all trash and must be neat, clean and eye appealing.
15. No burning candles or heated items may be left unattended at any time in your booth/space.
16. Any merchandise considered vulgar, illegal or that advocates drugs, alcohol, etc. may not be distributed or sold by any vendor.
17. Outdoor spaces are not coded nor equipped for living quarters or overnight camping. Local RV campsites and park information is available at the fair office upon request.
18. In no case will CCFA, its directors, members or officers be held responsible or liable for any loss, damage, injury of any description or kind to any vendor, person, animal, article, third party or property arising from any use of the fairgrounds, or caused by a defect in any building, structure, improvement, equipment or facility on the fairgrounds or caused or arising from any act or omission of CCFA its directors, members or officers. Vendor shall protect, defend, indemnify and hold harmless CCFA and CCFA’s members, officers, directors, contractors, agents, successors, personal and legal representatives and assigns from and against any and all liabilities, obligations, losses, damages, penalties, claims, actions suits, expenses and disbursements of whatever nature, regardless of the cause thereof, and expense in connection therewith, including, without limitation, attorneys fees and expenses, penalties and interest, for damages to property or injury to or death to any person, to the extent arising out of or related to the use of the fairgrounds or the sale of products irrespective of whether such liability, damages, losses, claims and/or expenses are actually or allegedly caused wholly or in part through the negligence, strict liability, breach of warranty, or other legal fault of CCFA or its members, officers or directors. The indemnification arising under this paragraph shall survive the termination of vendor’s right to be on the fairgrounds.
19. Vendor shall in all respects comply with these Rules and Regulations, all general rules and regulations of CCFA and the Laws of the State of Texas or any other governing body or municipality.
20. CCFA will make reasonable efforts to provide limited overnight security beginning at 5:00 p.m. on Tuesday, October 13, 2026, continuing throughout the fair, and ending Sunday, October 18, 2026 at 6:00 a.m. However, CCFA is not responsible for stolen or damaged merchandise, displays, etc. or for any damages arising for such failure to provide security.
22. Every vendor shall maintain general liability insurance with limits of at least $1-Million and provide CCFA a certificate of insurance evidencing the same. The certificate must be submitted with the Food/Commercial Vendor application or at least seven (7) days prior to the start of the fair. The certificate MUST name in Calhoun County Fair Association as an additional insured and state the wording “Additional Insured – Calhoun County Fair Association.” Any Vendor unable or unwilling to provide such certificate of insurance meeting the requirements set forth herein will be required to pay $100.00 to CCFA and in return CCFA will secure such insurance coverage through its insurance provider. Payment for insurance through CCFA must be made at least seven (7) days prior to the start of the fair or vendor’s application will be rejected and vendor will not be permitted on the fairgrounds.
