Vendor Disclaimer and Agreement
By registering as a vendor at the Central Texas BBQ Roundup (“CTBR”), the vendor, its owners, employees, representatives, and agents (“Vendor”) acknowledge and agree to the following terms:
1. Assumption of Risk
Vendor understands that participation in a public event involves inherent risks, including weather conditions, crowds, vehicles, equipment, temporary structures, and the actions of other participants or attendees. Vendor voluntarily assumes the risks associated with its participation in the event.
2. Vendor Responsibility
Vendor is solely responsible for its booth, merchandise, equipment, displays, employees, representatives, and activities. Vendor is responsible for ensuring that its operations are conducted safely and in compliance with all applicable federal, state, and local laws, regulations, permits, licenses, and venue handbook requirements.
3. Indemnification and Hold Harmless
Vendor agrees to defend, indemnify, and hold harmless the Central Texas BBQ Roundup, its officers, directors, employees, volunteers, sponsors, affiliates, event partners, and venue from and against claims, damages, losses, liabilities, costs, or expenses, including reasonable attorney fees, arising from or related to Vendor's participation, operations, products, services, acts, omissions, or negligence.
4. Personal Property and Security
Vendor is solely responsible for the security and protection of its merchandise, equipment, vehicles, trailers, displays, and other personal property. CTBR is not responsible for theft, loss, damage, or destruction of Vendor property before, during, or after the event.
5. Booth Setup, Operation, and Cleanup
Vendor is responsible for setting up, operating, and dismantling its assigned space and maintaining a clean and orderly area throughout the event. All equipment, merchandise, displays, trash, and other materials brought onto the event grounds by Vendor must be removed or properly disposed of following the event.
Vendor must remain within its assigned space unless otherwise authorized by CTBR. Booth placement and space assignments are determined by CTBR based on event layout, safety, operational requirements, and the overall needs of the event.
6. Safety and Event Requirements
Vendor agrees to comply with all CTBR, venue, fire, health, safety, and operational requirements applicable to its activities. CTBR reserves the right to require the correction or removal of any condition, equipment, display, product, activity, or conduct determined to create a safety concern, interfere with event operations, or be inconsistent with the family-friendly nature of the event.
7. Weather and Event Conditions
Vendor acknowledges that much of the CTBR is an outdoor event and that weather and other circumstances beyond the control of CTBR may affect event operations. CTBR does not guarantee attendance, sales, revenue, weather conditions, or any particular level of business activity.
8. Compliance and Removal
CTBR reserves the right to refuse participation or require a Vendor to discontinue an activity or leave the event grounds for failure to comply with event rules, safety requirements, applicable laws, or instructions from authorized event or venue personnel.
Acceptance of Terms
By submitting registration and participating in the Central Texas BBQ Roundup, Vendor acknowledges that they have read, understand, and agree to comply with this Vendor Disclaimer and Agreement and all applicable CTBR vendor rules and requirements.
