  • Step 3: Liability Waiver & Assumption of Risk

Please read the following waiver carefully. Horse activities involve inherent risks. This section must be completed before participating.
  • WAIVER, RELEASE, ASSUMPTION OF RISK & INDEMNITY AGREEMENT
READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.

HORSES AND RANCH ENVIRONMENTS INVOLVE INHERENT RISKS, INCLUDING THE RISK OF SERIOUS INJURY OR DEATH.

    1. Activity and Released Parties
This Agreement applies to the Participant’s attendance at and participation in The Horseman Scientist Clinic presented by Monica O. Knight dba United Mustangs of America on September 12, 2026, including the Participant’s presence on the clinic property, observation of horse demonstrations, movement through ranch and horse areas, being in proximity to horses, and any clinic-related horse interaction specifically permitted by United Mustangs of America (collectively, the “Activity”).

The “Released Parties” are Monica O. Knight dba United Mustangs of America; Triple D Ranch; David Apodaca; Mary Apodaca; and their respective employees, volunteers, agents, contractors, and representatives.

    2. Acknowledgment and Assumption of Risk
I understand that horses are large, powerful animals whose behavior can be sudden and unpredictable. Horses may kick, bite, strike, step on a person, spook, bolt, rear, buck, collide with people or objects, or react unexpectedly to movement, sounds, animals, equipment, weather, or their surroundings.

I also understand that a working ranch presents risks including, but not limited to, uneven or slippery ground, dirt, mud, manure, fencing, gates, panels, corrals, vehicles, equipment, tools, other animals, wildlife, insects, weather, and changing conditions.

These and other risks may result in falls, collisions, bodily injury, illness, property damage, permanent disability, or death. Not every risk can be predicted or eliminated.

I voluntarily choose to participate, or permit the minor Participant to participate, with knowledge of these risks and knowingly assume the risks inherent in the Activity and ranch environment.

    3. Release of Liability, Including Ordinary Negligence
TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, I RELEASE, WAIVE, AND DISCHARGE THE RELEASED PARTIES FROM CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM THE ACTIVITY, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.

I understand that this means I am giving up certain legal rights, including the right to bring certain claims alleging that a Released Party’s ordinary negligence caused injury, death, or property damage associated with the Activity.

This release does not apply to gross negligence, reckless or willful misconduct, fraud, violations of law that may not lawfully be released, or any other liability that California law does not permit to be waived.

    4. Participant Conduct and Safety
Participant agrees to follow United Mustangs of America’s instructions and safety boundaries, remain within designated areas, and stop or modify participation when directed for safety or horse welfare.

United Mustangs of America may restrict, modify, or end Participant’s involvement in any activity when it determines that doing so is appropriate for the safety or welfare of a person or horse.

    5. Third-Party Claims
I agree to indemnify and hold harmless the Released Parties from third-party claims, damages, costs, or reasonable attorney’s fees arising from Participant’s own conduct or Participant’s failure to follow United Mustangs of America’s safety rules or instructions, except to the extent prohibited by California law.

    6. Emergency Medical Assistance
If Participant becomes injured or ill, I authorize representatives of United Mustangs of America to seek emergency medical assistance and to provide reasonable first aid within the training of the person providing it.

I understand that I am responsible for Participant’s medical expenses and insurance coverage.

    7. Parent or Legal Guardian of Minor Participant
If Participant is under 18 years of age, I represent that I am Participant’s parent or legal guardian and have authority to enter into this Agreement on Participant’s behalf.

I enter into this Agreement individually and on behalf of the minor Participant and consent to the minor’s participation in the Activity.

    8. California Law and Severability
This Agreement is governed by California law. Any legal proceeding concerning this Agreement shall be brought in San Luis Obispo County, California, to the extent permitted by law.

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain effective to the fullest extent permitted by law.

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THIS AGREEMENT, THAT I UNDERSTAND THE RISKS DESCRIBED ABOVE, AND THAT I UNDERSTAND I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING CERTAIN CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
