    • Food Vendor Terms & Agreement
      Jack and Jill Market – Ventura County, California

      These Terms & Agreements apply to all Mobile Food Facility (MFF) and Temporary Food Facility (TFF) vendors participating in Jack and Jill Market (“Event”). By submitting payment and/or participating in the Event, Vendor agrees to comply with the following terms.


      1. Permits & Regulatory Compliance
      All food vendors must comply with regulations set forth by the Ventura County Environmental Health Division and all applicable city, county, and State of California requirements.

      Mobile Food Facilities (MFF)
      Vendors operating as a Mobile Food Facility must:

      Possess a valid Ventura County MFF Health Permit.
      Display their permit prominently during the Event.
      Operate only within the scope of their approved permit classification.
      Maintain compliance with all inspection, food safety, and sanitation requirements.
      Temporary Food Facilities (TFF)
      Vendors operating under a Temporary Food Facility must:

      Obtain an approved TFF permit for the Event when required.
      Comply with all temporary food booth setup requirements (handwashing stations, overhead protection, temperature control, etc.).
      Submit required documentation to Event Organizer prior to participation.
      Vendors are solely responsible for ensuring their permits are valid and current.


      2. Business Licensing & Tax Requirements
      Vendors must maintain:

      Any required city business license for the event location.
      A valid California Seller’s Permit if applicable.
      Compliance with all sales tax reporting obligations.

      3. Insurance Requirements
      All food vendors must provide:

      Certificate of Liability Insurance and/or a Certificate of Insurance (COI).

      Commercial Auto Insurance (for MFF vehicles).
      Workers’ Compensation Insurance if Vendor has employees.
      Failure to provide proof of insurance may result in cancellation without refund.


      4. Setup & Operational Requirements
      Vendors must arrive and complete setup within assigned load-in times.
      Vehicles may not move during event hours without approval.
      Generators must be quiet, well-maintained, and placed safely.
      Vendors must maintain a clean, sanitary space at all times.
      Trash and grease disposal must be handled offsite in accordance with county regulations.

      5. Food Safety & Health Standards
      Vendors agree to:

      Maintain proper hot and cold holding temperatures.
      Provide required handwashing facilities (TFF).
      Ensure all staff possess valid food handler certifications where required.
      Cooperate fully with any on-site inspection by Environmental Health or Fire officials.
      Any vendor shut down by authorities for violations will not receive a refund.


      6. Fire & Safety Compliance
      Vendors using propane, open flame, or cooking equipment must:

      Have properly rated fire extinguishers.
      Maintain required clearances.
      Comply with local Fire Department regulations.

      7. Payment, Cancellation & Refund Policy

      All booth fees will be paid in full prior to the event.

      Booth fees are set per event and are subject to change for future events. Participation in any prior event does not guarantee the same pricing, placement, or terms. Jack and Jill Market reserves the right to adjust vendor pricing at its discretion.

      All booth fees are final, non-refundable, and non-transferable, without exception. No refunds, credits, transfers, or reimbursements will be issued for any reason whatsoever, including cancellations, no-shows, scheduling errors, illness, emergencies, personal circumstances, dissatisfaction, weather conditions, or other unforeseen events.

      Failure to attend or participate does not relieve Vendor of payment obligations.

      Jack and Jill Market reserves the right to modify, postpone, relocate, reschedule, shorten, suspend, or cancel the Event due to weather, acts of God, public safety concerns, governmental orders, or other circumstances beyond its control.

      In the event of any modification, postponement, or cancellation, Vendor is not entitled to any refund, credit, damages, or compensation. All event-related determinations are final. Vendor waives all claims related to cancellations, delays, weather, or event changes.



      8. Indemnification

      Vendor agrees to defend, indemnify, and hold harmless Jack and Jill Market, its owners, officers, directors, employees, contractors, volunteers, agents, affiliates, venue property owners, sponsors, and partners (collectively, the “Released Parties”) from and against any and all claims, demands, damages, losses, liabilities, judgments, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to Vendor’s participation in the Event.

      This includes, but is not limited to:

      Bodily injury, illness (including foodborne illness), death, or property damage caused in whole or in part by Vendor’s acts or omissions;
      Violations of local, county, state, or federal laws, regulations, or permitting requirements;
      Operation of Vendor’s vehicle, equipment, generators, propane, or cooking devices;
      Employee actions, contractor actions, or product-related claims.
      Vendor expressly assumes all risks associated with participation in the Event, including but not limited to weather conditions, equipment failure, power interruption, theft, vandalism, customer disputes, and governmental enforcement actions.

      Vendor further releases and waives any and all claims against the Released Parties for loss of income, property damage, personal injury, or other damages sustained in connection with the Event.

      Vendor’s indemnification obligations shall survive the conclusion, cancellation, or termination of the Event.


      9. Right to Refuse Participation
      Organizer reserves the right to deny participation to any vendor who:

      Fails to meet regulatory requirements
      Provides false documentation
      Engages in unsafe, unlawful, or disruptive conduct

      10. Agreement
      By submitting payment and participating in the Event, Vendor acknowledges they have read, understood, and agree to these Terms & Agreements.

      ★ Submitting an application does not guarantee a spot. Due to limited space, all vendors and products go through an approval process.

      ★ Check your email regularly (including spam/junk). If approved, you will receive an email within 1-5 days that includes:
      • Your digital receipt
      • The Vendor Guide
      • A link to the private vendor Discord channel

      ★ Approved vendors receive access to a private Discord channel for event updates, early application access, giveaways, and more.

      ‼️ Please click the Discord link as soon as you receive the email. The link expires and cannot be accessed later on. ‼️

      ★ If you do not receive an approval email within 7 days, we were unable to offer you a space for this event. We encourage you to apply again for future markets!
