(Private Booking)

I acknowledge that I have received, read, and agree to comply with the
Incognito SD Community Rules, Consent Agreement, Orientation Materials,
Venue Policies, and any booking-specific instructions provided by Incognito
SD.

I understand that access to Incognito SD facilities and services is a revocable privilege and may be terminated at Incognito SD's discretion for safety, rule violations, illegal activity, or conduct inconsistent with community standards.

I voluntarily choose to participate in a private booking, appointment, rental, educational activity, consultation, social gathering, or other service offered or facilitated by Incognito SD.

I understand that such activities may involve adult-oriented content, BDSM, fetish activities, sexual activity, physical exertion, emotional intensity, use of equipment, or other activities that carry inherent risks.

I certify that I am at least twenty-one (21) years of age and physically and mentally capable of making informed decisions regarding my participation.

I understand that participation in activities occurring during a private booking may involve risks including physical injury, illness, emotional distress, property damage, disability, infection, or death.

I knowingly and voluntarily assume all risks associated with my participation, observation, use of equipment, interactions with others, and presence on the premises.

I understand that services and bookings may occur within a private residence rather than a commercial facility.

I voluntarily assume risks associated with entering and using residential property, including risks arising from stairs, flooring, furniture, fixtures, outdoor spaces, pools, equipment, and other residential conditions.

In consideration for being permitted to participate in this booking, I release, waive, and hold harmless Incognito SD, Incognito Operations, LLC, its owners, members, managers, employees, volunteers, contractors, affiliates, property owners, and representatives from any claims, demands, damages, liabilities, losses, costs, or expenses arising from or related to my participation, attendance, use of facilities, or presence on the premises, including claims based upon ordinary negligence to the fullest extent permitted by California law.

Nothing in this Agreement releases liability for gross negligence, willful misconduct, fraud, or any claim that cannot legally be waived.

If I or any of my guests become injured, incapacitated, or otherwise unable to communicate, I authorize Incognito SD personnel to seek emergency medical assistance on my or their behalf.

I understand that the person needing medical attention remains solely responsible for all medical expenses incurred.

I agree to be financially responsible for any damage caused to the property, furnishings, fixtures, equipment, or contents of the premises by myself or members of my booking party.

I understand that Incognito SD is not responsible for lost, stolen, or damaged personal property.

I acknowledge that Incognito SD is a private membership community and that I may learn confidential information regarding members, attendees, event locations, operations, services, and activities.

I agree not to disclose confidential information obtained through my participation without authorization.

These confidentiality obligations survive the conclusion of my booking.

If I am reserving the space on behalf of one or more guests, I acknowledge that I am the primary Booking Holder and accept responsibility for ensuring that all members of my booking party comply with Incognito SD Community Rules, venue policies, safety requirements, and applicable laws.

I understand that I may be held financially responsible for damage to the premises, equipment, furnishings, fixtures, or other property caused by any member of my booking party.

I further acknowledge that Incognito SD reserves the right to terminate a booking, remove participants, or deny future bookings if members of my booking party violate community standards, venue policies, or applicable laws.

I agree to leave all rented spaces, equipment, furnishings, and common areas in substantially the same condition in which they were provided.

I acknowledge that, if I do not follow cleaning procedures, I may be charged reasonable costs related to the actual cost of cleaning, repair, replacement, or restoration incurred by Incognito SD.

Any dispute arising from or relating to this Agreement, the booking, services rendered, facility use, or participation in Incognito SD activities shall be resolved exclusively through binding arbitration in San Diego County, California, under the rules of the American Arbitration Association.

I understand that this provision waives the right to a jury trial, except where prohibited by law.

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

I have read and understand this Agreement.

I understand that participation involves inherent risks.

I voluntarily assume those risks and agree to be bound by the terms of this Agreement.
