  • RELEASE OF LIABILITY, WAIVER OF CLAIMS and INDEMNITY AGREEMENT. As the Participant, I freely consent to all such risks related to participation and fully assume all responsibility for the possibility and related costs of personal injury, death, disability, property damage or loss resulting thereof, howsoever caused, including negligence, with the sole exception being gross negligence on the part of the Spina Bifida and Hydrocephalus Association of Northern Alberta, their members, agents, employees, and directors. I further waive and release any and all claims that I have or may have in the future against the Spina Bifida and Hydrocephalus Association of Northern Alberta as a result of my participation in the Spina Bifida and Hydrocephalus Association of Northern Alberta. I also hold harmless and indemnify Spina Bifida and Hydrocephalus Association of Northern Alberta from any and all liability for all personal injury, death, property damage, or loss to any third party resulting from my participation in the programs run by Spina Bifida and Hydrocephalus Association of Northern Alberta. This consent shall be effective and binding on my heirs, next of kin, executors, and administrators, for the entirety of the year stated below. I confirm that I have read and understood this Release of Liability, Waiver of Claims, and Indemnity Agreement prior to signing it, and I am aware that by signing it I am waiving certain legal rights that I or my heirs, next of kin, executors, administrators, assigns and representatives may have against Spina Bifida and Hydrocephalus Association of Northern Alberta. BY ACKNOWLEDGING AND SIGNING BELOW, I AM DELIVERING AN ELECTRONIC SIGNATURE THAT WILL HAVE THE SAME EFFECT AS AN ORIGINAL MANUAL PAPER SIGNATURE. THE ELECTRONIC SIGNATURE WILL BE EQUALLY AS BINDING AS AN ORIGINAL MANUAL PAPER SIGNATURE.

  • PHOTO RELEASE: I have been informed and understand that the SBHANA is creating photographic and/or video images that may be incorporatednow or in the future into materials (the “Product”) used for one or more of the following: informational and promotional purposes relating to the event atwhich the photography and/or videography occurred, internal informational purposes, and public information and promotional purposes for the SBHANA, and that one or more of my likeness, image, voice, appearance and performance (my “Appearance”) is being recorded and may be incorporated into the Product. I hereby grant the SBHANA, and its successors or assigns (collectively, the “Producer”) the right to use my appearance in the Product whether recorded on or transferred to videotape, film, slides, photographs, audio tapes, digital or other media, now known or later developed, for use by the Producer in one or more of the following: on Web pages, YouTube, Twitter, Facebook, other socialmedia, commercial or non-commercial television, closed circuit exhibition,audio-visual presentations, publications and advertisements. This grant includes without limitation the right to edit, mix or duplicate and to use or re-use the Product in whole or part as the Producer may elect. I acknowledge that I have no interest or ownership in the Product or its copyright. I acknowledge that this Image Use Consent and Release Agreement constitutes a binding agreement and is the entire agreement between myself and the SBHANA. I confirm that I have the right to enter into this Agreement, that I am not restricted by any commitments to third parties, and that the Producer has no financial commitment or obligations to me as a result of this Agreement, except as set out in this Agreement. I here by give all clearances, copyright and otherwise, for the use of my Appearance in the Product. I expressly release the Producer and its officers, employees, agents and designees from any and all actions, causes of action, liability, claims and demands whatsoever in law orequity known and unknown that I may have now or in the future arising out of, or in any way connected with, the above granted uses and representations. The rights granted the Producer herein are perpetual and worldwide. This Agreement shall be governed and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein and the parties expressly attorn to the exclusive jurisdiction of the courts of the Province of Alberta.
